About this file
This document is a federal contracting provision template that requires offerors to certify the domestic content status of end products being offered in response to a solicitation.
The provision mandates that offerors certify each end product as either domestic or foreign, with specific disclosure requirements for each category. For domestic end products, offerors must separately identify any that contain critical components as defined in FAR 25.105. For foreign end products manufactured in the United States that do not qualify as domestic, offerors must list the line item number, country of origin, and indicate whether the product exceeds 55 percent domestic content—with an exception for commercially available off-the-shelf (COTS) items and cases where domestic content percentage is unknown. The provision includes two tables for completion: one for foreign end products and one for domestic products containing critical components. The government's evaluation of offers will follow the policies and procedures outlined in FAR Part 25 (Buy American provisions). Key terms including "COTS item," "critical component," "domestic end product," "end product," and "foreign end product" are defined in the related "Buy American—Supplies" clause referenced in the solicitation.
