About this file

This document is a Request for Proposal (RFP) issued by the Office of Family Nutrition Services (OFNS) and the Department of Health (DOH) of the State of South Dakota for Electronic Benefits Transfer (EBT) Services for the Women, Infants, & Children (WIC) Program. The RFP seeks to establish a contract with a qualified EBT Contractor to provide electronic benefit transfer services, with proposals due by November 6, 2025. The contract will be for five years with the possibility of two one-year extensions, and aims to transition to the new contractor's EBT system by October 1, 2026. The project involves providing comprehensive EBT services for WIC participants, including system components, hardware, software, interfaces, professional services, WIC cards, equipment, transaction processing, and all other necessary WIC program requirements.

The Cost Per Case Month (CPCM) pricing will be based on the total number of active cases for each billing month, with core services including all system components, WIC cards and equipment, transaction processing fees, compliance cards, online WIC purchases, and other specified requirements. As of June 2025, the program serves 13,765 participants across 8,955 families, with 160 WIC vendors including independent stores, chain stores, and mass merchandisers. The proposal evaluation will consider factors such as specialized expertise, technical competence, resources, past performance, project management techniques, system development, vendor management, contract transition, and overall approach to meeting the state's EBT service needs.

As part of the negotiation process the contract terms listed in Appendix A may be altered or deleted. The offeror must indicate in its response any issues it has with specific contract terms. If the offeror does not indicate that there are any issues with any contract terms, then the State will assume those terms are acceptable to the offeror. There is also a list of technical questions, Security and Vendor Questions which is attached as Appendix G, the offeror must complete. These questions may be used in the proposal evaluation. It is preferred that the offeror’s response to these questions is provided as a separate document from the RFP response. If the offeror elects to make the Security and Vendor Questions part of its response, the questions must be clearly indicated in the proposal’s Table of Contents. A single numbering system must be used throughout the proposal.

Any contract or agreement resulting from this RFP will include the Food and Nutrition

Service WIC federal procurement clauses listed in Appendix B - FNS-WIC Federal Procurement Clauses. If the offeror does not indicate that there are any issues with any contract terms, then the State will assume those terms are acceptable to the offeror

1.3 CONFLICT OF INTEREST DISCLOSURE

Offerors must disclose any potential conflict of interest in connection with a Proposal. A conflict of interest may include, but is not limited to, access to any non-public information regarding the RFP or the subject matter of the RFP by the Offeror, or any of the Offeror’s employees, contractors, or agents, including any individual who may have had access to non-public information in a prior capacity before entering into a relationship with Offeror.

If the State determines that a conflict of interest exists, the State, in its sole discretion, may reject any Proposal or cancel the award of a contract. In the event the Awarded Offeror was aware of any conflict of interest prior to the award of the contract and failed to disclose the conflict to the State, the State may terminate the contract for cause.

UPDATED MAY 21, 2025 3

The provisions of this section regarding disclosure of conflicts of interest to the State must be included in any subcontracts in connection with performance of the work. Additionally, Pursuant to SDCL 5-18A-17 to 5-18A-17.6, no Department of Health (DOH) employee who approves, awards, or administers a contract with the state involving the expenditure of public funds or the sale or lease of state property, may have an interest in a contract which is within the scope of the employee's official duties. Specifically, these laws apply to state officers and employees who:

• Approve, award, or administer a contract;

• Recommend the approval or award of a contract;

• Supervise persons who approve, award, or administer a contract;

A state employee who suspects the existence of a conflict of interest, fraud, or theft shall report the matter immediately to any of the following:

• The employee's immediate supervisor;

• The Department of Legislative Audit.

To determine if a conflict of interest exists with the contract being recommended, employees must complete the Bureau of Human Resources and Administration (BHRA) Conflict of Interest Waiver Matrix.
