About this file
This is Addendum #5 to RFP 6124, issued by the State of Oregon Department of Human Services (ODHS) and Oregon Health Authority (OHA) on August 8, 2025, addressing price-related inquiries submitted by prospective contractors for Agency with Choice services. The addendum clarifies critical operational and financial parameters for the procurement. The state confirmed that authorized services for Direct Support Workers (DSWs) are documented in Individual Person-Centered Service Plans provided by Case Managers or Service Coordinators, with maximum service hours specified for each 14-day period. Contractors must bill the state at approved hourly rates in 15-minute unit increments for authorized services rendered on a weekly basis, with all services authorized through the Medicaid Management Information System (MMIS).
The addendum establishes that the previously mandated $42.12 loaded hourly rate for DSWs is no longer fixed, allowing proposers to submit their own proposed loaded hourly rates. The state clarified that Collective Bargaining Agreement requirements do not apply to Agency with Choice contractors, who may elect to provide pay differentials based on work experience, training, or other factors at their discretion. Regarding tax implications, the state directed inquiries regarding Corporate Activity Tax and Corporate Excise Tax exemptions to the Oregon Department of Revenue, as such determinations fall outside the RFP scope. The point of contact for additional questions is Stephanie Morgan and Geoffrey Nowak at the provided email addresses.

See below the State’s responses to price-related questions received against this RFP.
1. Question: To accurately reflect authorization activity in our pricing, can the state describe how OHA and ODHS provide authorizations to the Agency with Choice?
Answer: OHA and ODHS provided guidance on authorized services for DSW work in the RFP and Oregon Administrative Rules. The maximum hours of services allowed for an individual per a 14-day period is listed in the Individual's Person-Centered Service Plan that is provided by the Case Manager or the Service Coordinator. The Contractor shall bill at the approved hourly rate to the State for authorized services provided to Individuals in 15-minute unit increments up to the authorized amount of units on a weekly basis after the services are rendered. Services are authorized in the Medicaid Management Information System (MMIS).
2. Question: How does the $42.12 loaded rate take into consideration the differentials and pay scale in the current Collective Bargaining Agreements?
Answer: The requirements of the Collective Bargaining Agreement do not apply to the Agency with Choice. The Agency with Choice can elect to provide differences in pay scale per work experience, training or other factors, but it is not required. The loaded rate is no longer required to be $42.12. Per Addendums 3 & 4 to this RFP, Proposer(s) must propose a loaded hourly rate amount for the DSW.
3. Question: Is the AWC exempted from the Corporate Activity Tax or Corporate Excise Tax?
Answer: For this information you are advised to contact Oregon Department of Revenue by phone at (503) 945-8005 (CAT-specific questions ), or via email at cat.help.dor@dor.oregon.gov. You may also visit their website at www.oregon.gov/dor.
