This is a Request for Proposals (RFP) for elevator modernization and replacement services at the VA North Texas Health Care System Garland VA Medical Center in Garland, Texas.

The solicitation seeks a certified Service-Disabled Veteran-Owned Small Business (SDVOSB) to modernize or replace ten electric elevators and four hydraulic elevators, correct functional deficiencies to meet current elevator codes and VA design guidelines, and provide one year of guaranteed maintenance and repair services. General construction work includes addressing elevator pits, machine rooms, control systems, hoistways, machine drives, landing doors, phones, safety systems, car operation panels, door operators, signaling devices, and elevator cab interiors. The contractor must complete all construction work within 512 calendar days of the notice to proceed and provide guarantee period services for 1 year after completion and acceptance of each elevator, with the total period of performance spanning 877 calendar days (512 days construction plus 365 days maintenance). The proposal submission deadline is May 27, 2026 at 1:00 PM EDT. Award is anticipated to be made on a best-value basis, with technical evaluation based equally on past performance and contractor qualifications, combined with pricing considerations. Performance and payment bonds equal to 100 percent of the contract price are required. This is a firm fixed-price contract with an estimated magnitude of $10 million to $20 million under NAICS code 238290. The procurement is restricted to certified SDVOSBs listed in the SBA certification database at both proposal submission and award; non-certified entities will not be considered. Offerors must submit proposals in three separate volumes (Technical, Price, and Administrative) via email, with the technical section limited to 35 pages and priced items submitted in whole dollar values only.

Failure to return the entire clause, with the appropriate box marked, the offeror’s name entered, and the certification completed and signed, with the proposal will result in the offer being deemed ineligible for evaluation and award.

(viii) Notice to SDVOSB Joint Venture/Mentor-Protégé. Any offeror submitting a proposal as a joint venture must provide a copy of the joint venture agreement, as well as a certification from the certified SDVOSB partner, signed by an authorized official of each partner to the joint venture, stating that the parties to the joint venture (A) have entered into a joint venture agreement that fully complies with paragraph (c) of 13 CFR § 128.402, and (B) will perform the contract in compliance with the joint venture agreement. The offeror must enter the company name and UEI of each party to the joint venture. Failure to submit the agreement and certification with the offeror’s proposal may result in the rejection of the proposal.

2.8 BASIS OF AWARD

(a) The intent is to award to the offeror that presents the best value to the Government. Best value means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirements.

(b) Using the tradeoff approach to source selection, it may be in the Government’s best interest to consider award to other than the lowest priced offeror or other than the highest technically rated offeror.

This process permits tradeoffs among price and non-price (technical) factors. The anticipated benefits of a higher priced proposal must merit the additional cost.

(c) The technical evaluation will be based on two factors: past performance and contractor qualifications. The total evaluated price will be the grand total provided in the price schedule. Past performance and contractor qualifications are equal in importance to each other and, when combined, are approximately equal to price.

2.9 TECHNICAL EVALUATION

(a) General.

(1) All proposals will be subject to evaluation by a team of Government personnel. Proposals will be evaluated based on the factors described herein. The technical evaluation and rating of proposals will be conducted in strict confidence without knowledge of the price offered.

(2) It is the intent of the Government to award without negotiations; however, the Government reserves the right to conduct negotiations if necessary. The evaluation will be based on the content of the proposal and any subsequent negotiations.

(3) If negotiations are deemed necessary, the Contracting Officer will establish a competitive range and proposal revisions will be requested.

(4) If none of the offers are within the available funding limitation or determined to be fair and reasonable, the VA reserves the right to enter into negotiations with those offerors who are within the competitive range.

(5) Proposals which merely restate the requirements or state that the requirements will be met, without providing supporting rationale, are not sufficient. An offeror who fails to meet the minimum requirements of the solicitation will be determined unacceptable and thus, ineligible for award.

(6) The offeror must not include remarks that take exception to the Government’s solicitation documents or pricing requirements, preclude the Government from evaluating the offer, or render the offer as nonconforming or unacceptable. If the offeror communicates in its proposal any qualifications, exceptions, exclusions, or conditions to the proposed prices or terms of the solicitation, the Contracting Officer may reject the proposal and exclude the offeror from further consideration.

(b) Criteria. The technical proposal must address the following evaluation factors.

(1) Factor 1, Past performance. The offeror must demonstrate successful performance on projects similar in size, scope, and complexity that were recently completed by the offeror* as the prime contractor. The offeror must provide the following for no more than three projects:

(i) Summary: For each project submitted, provide a detailed summary using the attached 14 - Project Information Sheet and include all information requested in the form.

(ii) Narrative: For each project submitted, provide a narrative describing the work performed, including specific aspects of the project that are relevant to the proposed effort, and any risk mitigation actions taken. This narrative should include:

(A) Project description (including specifics of elevator modernization scope, types of elevators included in work, sustainability and efficiency considerations, extent of system integration, etc.)

(B) Phasing approach taken, including how operation disruptions were minimized

(C) Infection control and interim life safety measures taken

(D) Cost control measures (cost containment measures, value engineering, etc.)

(E) Schedule impacts, including efficiencies and inefficiencies

(F) Challenges encountered (such as cost overruns, schedule delays, subcontractor issues, changes in key personnel or subcontractors, unforeseen site conditions, or other unusual factors) and the mitigation plan implemented to overcome the challenges

(G) Any documents or photographs that support the narrative

(iii) Performance assessment: For each project submitted, provide a completed performance assessment. If a project has an evaluation available in the Contractor Performance Assessment Reporting System (CPARS), the CPARS evaluation must be submitted. For any project that does not have an evaluation available in CPARS, the offeror must submit a completed and signed past performance questionnaire (PPQ) using the attached 15 - PPQ.

PPQs must be completed by the client and returned to the offeror to incorporate into their proposal. PPQs must not be submitted by the client directly to VHA PCAC. The offeror should follow up with clients to help ensure timely return of questionnaires. If the offeror requests a PPQ from a client but does not receive the completed form before the proposal due date, the offeror must submit a PPQ with Section 1 completed and only the Evaluator Information entered in Section 2, and documentation of the attempts to have the PPQ completed. The Government may make reasonable attempts to contact the client noted to obtain the PPQ information; however, the Government is not responsible for the failure to obtain a completed PPQ.

Since the Government may not necessarily interview all the sources provided by the offeror, it is incumbent upon the offeror to explain the relevance of the data provided. The burden of proving low performance risk rests with the offeror.

If an offeror has no relevant past performance history, the offeror must affirmatively state it possesses no relevant past performance history. Without this statement, the offeror may be rated less favorably for failure to submit the required information.

*When evaluating an offer from a joint venture, the Government will consider the past performance of the joint venture itself, as well as the past performance of each party to the joint venture.

(2) Factor 2, Contractor qualifications. The offeror must provide a company narrative/profile by submitting an organization chart indicating the prime responsible firm(s) and individuals, as well as the roles and responsibilities of individuals proposed as consultants and subcontractors. Include the month and year the business was incorporated, the month and year the SDVOSB certification was achieved, and the number of full-time employees.

The offeror must also provide the qualifications of key personnel by submitting a one-page resume for each of the individuals proposed to perform as the Project Manager, the Project Superintendent, the Quality Control Manager, the Safety Professional (SSHO), and all Elevator Mechanics/Technicians and Electricians. Resumes must include all required education, hours, certifications, licenses, and years of relevant experience.

(c) Methodology. Information submitted will be rated for each evaluation factor using the following methodology. All elements will be considered in the overall rating for each factor. Areas within the factors are not subfactors and will not be individually rated.

(1) Factor 1, Past performance. The evaluation of past performance will be based on recency, relevancy, and quality of work performed for no more than three projects. If any additional projects are submitted, only the first three will be considered.

(i) Recency: To be considered recent, the project must have been performed by the offeror* as the prime contractor and completed to 100% within the past 10 years from the proposal due date. If the recency requirements are met, the Government will evaluate the project for relevancy. Any project not performed by the offeror* as the prime contractor, not completed to 100%, or completed more than 10 years ago will not be evaluated further.

(ii) Relevancy: To be considered relevant, the project must meet the following requirements:

(A) Size: The project must have a total value of at least $5 million.

(B) Scope: The project must involve elevator modernization or replacement of several elevator banks in one building that includes phasing in an active healthcare setting.

Work must include, but is not limited to, installing, new controls, motors, electric, emergency phones, plumbing, air conditioning, fire alarms/suppression, and new cab interior finishes. Projects completed within VHA facilities are preferred.

(C) Complexity: The project must demonstrate successful coordination of a multi-disciplinary project team and coordination across all subcontractors. This involves effective phasing, coordination of critical path activities, and a detailed understanding of general construction specifications and provided design drawings.

If the relevancy requirements are met, the Government will evaluate the project for quality.

Any project not determined to be at least somewhat relevant in terms of size, scope, and complexity will not be evaluated further.

(iii) Quality: In addition to evaluating the extent to which the offeror’s performance met contract specification requirements, the assessment will also consider aspects such as:

adherence to schedules (including the administrative aspects of performance); reasonable and cooperative behavior and commitment to customer satisfaction; project cost control;

timeliness of contract completion and submission of deliverables; compliance with the terms and conditions of the contract; overall quality of the work performed on the contract;

effectiveness in program management (to include use and control of subcontractors); and whether or not the reference would enter into a contract with the contractor again.

(iv) Overall Confidence: The purpose of the past performance evaluation is to assess the degree of confidence the Government has in the offeror’s ability to meet the solicitation requirements based on the demonstrated record of performance. The Government will consider the performance quality of the submitted projects determined to be recent and at least somewhat relevant in order to arrive at an overall confidence rating of Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence, or No Confidence.

Per FAR 15.202(c)(1), an offeror without a record of relevant past performance or for whom information on past performance is not available may not be evaluated favorably or unfavorably on past performance. An offeror with no recent and relevant performance history or whose performance record is so sparse that no meaningful confidence rating can be reasonably assigned will receive a Neutral Confidence rating, meaning the rating is treated neither favorably nor unfavorably.

The Government reserves the right to conduct a past performance assessment using information obtained from CPARS and any other sources deemed appropriate by the CO.

Other sources may include, but are not limited to, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), and any other known sources not provided by the offeror. While the Government may elect to consider data obtained from other sources, the burden of providing current, accurate, and complete past performance information rests with the offeror.

(2) Factor 2, Contractor qualifications. The evaluation of contractor qualifications will be based on the submitted organization chart and resumes. The elements listed below will be considered more favorable. An offeror that does not demonstrate these attributes presents higher levels of risk and will be rated less favorably.

(i) An organization chart that demonstrates higher self-performance (or similarly situated status)

(ii) A resume for a Project Manager, Superintendent, Quality Control Manager, or SSHO that demonstrates:

(A) more years of service in the same proposed role

(B) more education and/or certifications relevant to the proposed role

(C) OSHA 30 certification

(iii) A resume for an Elevator Mechanic that demonstrates:

(A) licensure in the state of performance (Texas)

(B) training through NEIEP or equivalent

(C) at least 5 years of modernization experience

(D) OSHA 10 certification

(E) training in other applicable areas such as confined spaces, lockout/tagout, fall protection, and fire safety, as required for their roles in the construction project

2.10 SYSTEM FOR AWARD MANAGEMENT

The FAR requires that federal contractors register in the System for Award Management (SAM) at https://sam.gov/ and enter all mandatory information into the system. In compliance with FAR 52.204-7, an offeror must have an active registration in SAM at the time an offer is submitted and at the time of award.

2.11 DEVIATION NOTICE (FEB 2025)

System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations, including 52.222-25, Affirmative Action Compliance, 52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals—Representation, and paragraphs (d) and (t) of 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services.

https://sam.gov/

Contracting officers will not consider these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

2.12 DETERMINATION OF ACCEPTABILITY

Proposals received in response to this solicitation will be reviewed for acceptability. Failure to provide documentation as outlined in the solicitation by the date and time set for receipt of offers may result in the offer being deemed unacceptable and ineligible for evaluation and award.

2.13 RESPONSIBILITY DETERMINATION

In accordance with FAR subpart 9.1, Responsible Prospective Contractors, a responsibility determination will be made for the apparent successful offeror prior to processing the award. The Contracting Officer reserves the right to obtain information to assist the Government in determining the apparent successful offeror responsible, including information regarding the offeror’s previous experience (including points of contact), organization (including company officers), technical qualifications, financial resources, and other information deemed necessary. The Government may request additional information from all offerors after receipt of proposals solely for the purpose of making a responsibility determination. These requests for information do not constitute negotiations.

Any information received by the Government that would be cause for a determination of nonresponsibility may deem the offeror ineligible for award.

2.14 VETS 4212

Title 38 U.S.C. 4212(d), codified at 41 CFR 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at https://www.dol.gov/agencies/vets/programs/vets4212. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the confirmation email prior to awarding the contract.

2.15 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM

(a) As prescribed in FAR 42.1102(e), the VA evaluates contractor past performance on all construction contracts that exceed $900,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement, VA uses an online database, Contractor Performance Assessment Reporting System (CPARS), which is maintained by the Naval Sea Logistics Center in Portsmouth, New Hampshire. CPARS is available to all Federal agencies and is the system used to collect and retrieve performance assessment reports used in source selection determinations. CPARS also includes access to the federal awardee performance and integrity information system (FAPIIS). FAPIIS is a web-enabled application accessed via CPARS for contractor responsibility determination information.

(b) Each contractor whose contract award is estimated to exceed $900,000 is required to register with CPARS at http://www.cpars.gov/. Help in registering can be obtained by contacting the Customer Service Desk at cpars-helpdesk@us.navy.mil. Registration should occur no later than 30 days after contract award and must be kept current should there be any change to the contractor’s registered representative.

https://www.dol.gov/agencies/vets/programs/vets4212 http://www.cpars.gov/ mailto:cpars-helpdesk@us.navy.mil

(c) For contracts with a period of one year or less, the Contracting Officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the Contracting Officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report will be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have 30 days to submit any comments and re-assign the report to the VA Contracting Officer.

(d) Failure to have a current registration in CPARS or to re-assign the report to the VA Contracting Officer within those 30 days will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

2.16 BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS

All contractor employees are subject to the same level of investigation as VA employees who have access to VA sensitive information. The level of background investigation is commensurate with the level of access needed to perform all work as identified in the solicitation documents. This requirement is applicable to all subcontractor personnel requiring the same access. As per VA Directive 0710, costs of background investigations will be borne by the contractor. The awardee will need to coordinate with the VA Medical Center concerning badging requirements. If the site requires an investigation, the contractor must follow VA Directive 0710.

2.17 REFERENCES TO VA ENGINEER, RESIDENT ENGINEER, OR PROJECT

MANAGER

Any reference contained within the solicitation/contract specifications and/or drawings to the “VA Engineer,” “Resident Engineer,” or “Project Manager,” or their abbreviations must be replaced with “Contracting Officer’s Representative (COR).”

2.18 REFERENCES TO BIDS/BIDDERS

Within the solicitation/contract specifications and/or drawings, any reference to “bid” must be replaced with “proposal” and any reference to “bidder” must be replaced with “offeror.”

2.19 52.203-2 CERTIFICATE OF INDEPENDENT PRICE DETERMINATION (APR

1985)

(a) The offeror certifies that—

(1) The prices in this offer have been arrived at independently, without, for the purpose of restricting competition, any consultation, communication, or agreement with any other offeror or competitor relating to—

(i) Those prices;

(ii) The intention to submit an offer; or

(iii) The methods or factors used to calculate the prices offered.

(2) The prices in this offer have not been and will not be knowingly disclosed by the offeror, directly or indirectly, to any other offeror or competitor before bid opening (in the case of a sealed bid solicitation) or contract award (in the case of a negotiated solicitation) unless otherwise required by law;

and

(3) No attempt has been made or will be made by the offeror to induce any other concern to submit or not to submit an offer for the purpose of restricting competition.

(b) Each signature on the offer is considered to be a certification by the signatory that the signatory—

(1) Is the person in the offeror’s organization responsible for determining the prices being offered in this bid or proposal, and that the signatory has not participated and will not participate in any action contrary to paragraphs (a)(1) through (a)(3) of this provision; or

(2)(i) Has been authorized, in writing, to act as agent for the following principals in certifying that those principals have not participated, and will not participate in any action contrary to paragraphs (a)(1) through (a)(3) of this provision ____________________ [insert full name of person(s) in the offeror’s organization responsible for determining the prices offered in this bid or proposal, and the title of his or her position in the offeror’s organization];
