3 SECTION C — DESCRIPTION / SPECIFICATIONS /
PERFORMANCE WORK STATEMENT (PWS)
3.1 C.1 PURPOSE
The purpose of this contract is to provide all fabrication, supply, installation, testing, commissioning, integration, quality control, safety oversight, and supervision necessary to deliver a fully operational Wet Scrubber and Recirculation Water System for the industrial incinerator located at OIJ Ciudad Judicial, San José, Costa Rica. The Contractor shall deliver a safe, code-compliant, fully commissioned system with complete documentation and minimal operational disruption.
3.2 C.2 BACKGROUND
The U.S. Department of State (DoS), through the Bureau of International Narcotics and Law
Enforcement Affairs (INL), assists Costa Rican efforts to effectively address transnational crime through provision of equipment, training, expertise, and law enforcement cooperation.
The existing industrial incinerator (PENNRAM Model C-750, Series 220008, capacity 350 kg/h, manufactured September 2020) at OIJ Ciudad Judicial processes special waste, including psychoactive substances such as marijuana and cocaine. The combustion process generates gases at approximately 940°C containing particulates and acid compounds (HCl, HF, SO₂, NOx) that require treatment prior to emission to comply with applicable environmental regulations.
The existing gas treatment system — comprising an in-line gas scrubber and baghouse filter — is no longer adequate due to deterioration and increased gas flow rates versus the original theoretical design. INL, in cooperation with the Government of Costa Rica, is providing technical assistance for the design, supply, and installation of a replacement Wet Scrubber and
Recirculation Water System to ensure continued environmental compliance and operational effectiveness.
3.3 C.3 PERFORMANCE OBJECTIVE AND APPROACH
This Performance Work Statement is performance-based: the Government describes the required results and measurable performance standards, while allowing the Contractor to propose methods that achieve those outcomes efficiently and safely.
The Contractor shall provide all labor, materials, equipment, fabrication, installation, QA/QC, safety, and supervision necessary to complete the Wet Scrubber and Recirculation Water System at OIJ Ciudad Judicial, delivering a safe, code-compliant, fully commissioned system with complete documentation.
Note: The Government has established performance objectives and quality standards in this PWS. Section C.4 provides minimum performance specifications that contractors must meet or exceed. Contractors are encouraged to propose innovative solutions and methods to achieve these outcomes.
3.3.1 Fabrication and Installation Overview
Under this contract, the Contractor is solely responsible for:
• Conducting all necessary site investigations and assessments;
• Reviewing and verifying all approved engineering design documents prior to fabrication;
• Fabricating all equipment in full conformance with the approved design;
• Performing on-site installation, integration, testing, and commissioning;
• Coordinating with the separate INL contractor supplying recirculation pumps and pump house/enclosure, and providing all necessary interfaces, piping connections, instrumentation interfaces, controls integration, testing, and commissioning activities to achieve a fully operational system;
• Removing and disposing of the existing baghouse system;
• Delivering fully commissioned, operational systems with complete documentation.
The Government provides performance criteria — the required outcomes, functional standards, and quality thresholds — rather than prescriptive fabrication specifications. The Contractor has flexibility to propose solutions that meet or exceed these criteria, subject to INL approval.
3.3.2 Design Responsibility
The engineering design documents have been developed by INCINER8 LATINOAMÉRICA
S.A. and are provided as Government-Furnished Information (GFI). The Contractor assumes full professional responsibility for reviewing the design documents, identifying any discrepancies or constructability concerns prior to fabrication, and fabricating and installing all equipment in strict conformance with the approved design. Fabrication errors, omissions, or non-compliant installations shall be corrected by the Contractor at no additional cost to the Government.
3.3.3 Government Review Role
The Government's review of shop drawings and submittals is for conformance with performance criteria and contract requirements only. Government review and approval does not:
• Transfer fabrication or installation responsibility to the Government;
• Constitute acceptance of the design as structurally or technically adequate;
• Relieve the Contractor of responsibility for errors, omissions, or code non-compliance.
3.3.4 Single Point of Responsibility
The Contractor is the single point of responsibility for all fabrication, supply, installation, testing, commissioning, and integration activities within the defined scope. The Contractor shall manage and coordinate all disciplines, subcontractors, and activities to deliver a complete, integrated, and fully functional system.
The Contractor's role will consist of providing services to include, but not limited to, the fabrication, supply, installation, testing, and commissioning required for the Wet Scrubber and
Recirculation System, to include as-built drawings, Bill of Materials, schedules, operation and maintenance manuals, operational narrative, integration of the new equipment with the existing system, and itemized pricing for each deliverable in accordance with Section B.
The recirculation pumps and pump house/enclosure (separate from the recirculation tank) will be furnished under a separate INL contract by INL. The Contractor shall coordinate with the designated supplier and shall provide all necessary interfaces, piping connections, instrumentation interfaces, controls integration, testing, and commissioning activities required to integrate the supplied equipment into the Wet Scrubber and Recirculation
System.
The Contractor shall provide the necessary controls, instrumentation, and system integration to generate an alarm whenever the new Wet Scrubber and Recirculation System is not operating while the existing system remains operational. The alarm shall be integrated into the existing control system, providing operators with a clear indication of the system's status to prevent operating conditions in which the existing system is running without the required support of the new equipment.
The Contractor shall provide all equipment, instrumentation, controls, supports, and ancillary components required for operation of the chemical preparation system, including the mechanical agitator installed on the chemical preparation tank. The chemical dosing pump will be furnished by others under a separate INL contract and is excluded from the Contractor's supply scope. The Contractor shall provide all necessary tank nozzles, supports, piping connections, isolation valves, instrumentation interfaces, electrical provisions, and physical accommodations required for installation and integration of the owner-furnished chemical dosing pump.
The Contractor will be responsible for storage of tools and equipment required for the performance of this contract. Neither INL nor OIJ will be accountable for any loss of equipment during the period of performance. The Contractor shall bring temporary portable restrooms for their personnel and provide weekly cleaning (Friday afternoon).
The scope of this project consolidates the following into a single procurement and execution effort:
• Fabrication and supply of a centrifugal Wet Scrubber system;
• Fabrication and supply of a Water Recirculation and Sedimentation Tank System;
• Chemical preparation and dosing system for alkaline reagent (excluding owner-furnished chemical dosing pump);
• pH, temperature, and level monitoring and alarm system;
