The performance bond must be issued by a surety company appearing on the U.S. Treasury Department's current list of "Surety Companies Acceptable on Federal Bonds" and authorized to conduct business in Indiana. The bond's penal sum shall equal the contract amount and shall remain in full force throughout the original contract term, any extensions granted by the Owner, and any guarantee or warranty periods. The surety agrees that no defect or irregularity in contract proceedings, no changes or extensions to the agreement or work, and no delay in enforcement shall release it from its obligations. The performance bond shall not be released until one year after the Owner's final settlement with the contractor. Bidders are required to provide a bid bond or certified check equal to 10 percent of the bid amount, with liquidated damages assessed at $5,000 per calendar day for delays beyond completion dates and road closure not to exceed 75 consecutive calendar days.
