About this file

This is a Maintenance Bond form required by the City of Carmel, Indiana for the 116th Street and Hoover Road Roundabout Construction project. The successful bidder must execute this bond or an alternative form containing equivalent material conditions and provisions approved in advance by the City. The bond must be dated on or after the contract date and, if the contractor is a partnership, all partners must execute the bond. The surety company must appear on the U.S. Treasury Department's current list of "Surety Companies Acceptable on Federal Bonds" as specified in Circular 570, as amended, and must be authorized to conduct business in the State of Indiana.

The maintenance bond requires the contractor to warrant all workmanship and materials used in the construction, installation, and completion of the roundabout project to be of good quality and constructed in a workmanlike manner in accordance with the contract documents and all applicable local, state, and federal laws, ordinances, rules, standards, and regulations. The surety's obligation remains in effect for a three-year period following the City's acceptance of the work for public maintenance. During this period, the contractor must make all necessary repairs or replacements at its own expense for any defective workmanship or materials, or failures to conform to the contract documents. Upon satisfactory completion of all required repairs and replacements, the surety's obligation becomes null and void. Any repairs or replacements made under the bond remain subject to the same terms and conditions.
