About this file
This is a Payment Bond form template required by the City of Carmel, Indiana for the Raised Crosswalk Improvements project at Gray Road and Hazel Dell Roundabouts. The bond must be executed by the successful bidder and a surety company approved under U.S. Treasury Department Circular 570, authorized to conduct business in Indiana. The bond secures the contractor's obligation to promptly pay all amounts due to subcontractors, material suppliers, and laborers performing work on the project. The bond date must not precede the contract date, and the penal sum amount is to be specified by the city. If the contractor is a partnership, all partners must execute the bond. Sealed bids for the project are due by 9:00 am on Wednesday, February 4, 2026, with a non-mandatory pre-bid conference scheduled for Thursday, January 22, 2026, at 1:00 pm, available both in-person and virtually. The project encompasses construction of raised crosswalks at six intersections, including installation of storm sewer, full depth patching, curb and gutter replacement, and sidewalk construction, with substantial completion targeted for August 10, 2026, and final completion by September 10, 2026.
The surety agrees that defects in contract proceedings, changes to contract terms, extensions of time, alterations or additions to work, and delays in owner enforcement will not release its obligation on the bond. The surety waives notice of any such modifications and agrees that the payment bond shall remain in effect for one year after the owner's final settlement with the contractor. Bidders must submit a bid bond or certified check equal to 10 percent of the bid amount, along with evidence of insurance, a surety letter of intent, completed manufacturers and subcontractors lists, and a non-collusion affidavit. The successful bidder will be required to provide 100 percent performance and payment bonds and maintain a 10 percent maintenance bond for three years following final acceptance. The general contractor must contribute at least 15 percent of the contract price in work, materials, or services. The contract will be awarded to the lowest responsive and responsible bidder, with the City of Carmel funding the project through municipal appropriations.
