AMES BIOSCIENCES COLLABORATIVE FACILITY, N288

Construction of a new two-story, 40,000 ft2 reinforced concrete laboratory building. The building includes approximately 19,000 ft2 of wet lab and lab support space and approximately 21,000 ft2 of private and open office space, conference rooms, break rooms, and mechanical and electrical rooms.

The laboratory wing includes extensive laboratory electrical and plumbing systems. Fixed and mobile laboratory casework, and chemical fume hoods. The building is designed to achieve LEED Silver and includes energy efficient mechanical systems, LED lighting throughout with a lighting control system, natural ventilation of the office space, and a steel canopy structure to shade the extensive south facing glazing.

The project includes installation of underground utilities, an on-site parking lot, pedestrian paving, construction of storm water treatment bioswales, landscaping and irrigation.

(a) The Contractor shall provide all resources (except as may be expressly stated in the contract as furnished by the Government) necessary to deliver and/or perform the items below in accordance with the Description/Specifications/Statement of Work incorporated in Section J as Attachments J-1 and J-2.

(b) OPTION ITEMS

If Option Items are exercised pursuant to Clause 52.217-7, “OPTION FOR INCREASED

QUANTITY – SEPARATELY PRICED LINE ITEM,” the contractor shall provide all resources (except as may be expressly stated in this contract as furnished by the Government) necessary to furnish the items below in accordance with the Description/Specification/Work Statement in Section C.

02 Option Item 0001, Structured Cabling Provide and install the data communications horizontal cabling between the BDF/IDF Room

(Room 236) and the communication outlets throughout the building. This option also includes the wireless access points and the testing of the data communications cabling installation.

The base bid shall include all manholes, ductbanks, conduits and pull strings, cable trays, cable supports, racks, bonding and grounding, patch panels, boxes, faceplates and jacks, as shown on the contract drawings, to permit the future installation of the data communications horizontal cabling.

3 Option Item 0002, Laboratory Equipment

a. Provide and install a Cold Room as described in specification section 13 21 26, COLD-

STORAGE ROOMS (PREFABRICATED

PANEL TYPE), and located on the first floor;

identified as Room 183. Option item also includes all shelving and equipment located inside the cold room.

Base bid shall include all mechanical, plumbing, electrical, telecommunications and fire protection work, as shown on the contract drawings, to support the future installation of a cold room.

b. Provide and install a Glassware Washer as described in specification section 11 71 00, STERILIZERS, AND ASSOCIATED

EQUIPMENT, and located on the first floor inside Room 172.

Base bid shall include all mechanical, plumbing, electrical and fire protection work, as shown on the contract drawings, to support the future installation of a glassware washer.

c. Provide and install Autoclaves as described in specification section 11 71 00, STERILIZERS, AND ASSOCIATED EQUIPMENT, and located on the first floor inside Room 172.

Option item includes both the 20x20x38 autoclave and the 24x36x48 autoclave.

Base bid shall include all mechanical, plumbing, electrical and fire protection work, as shown on the contract drawings, to support the future installation of autoclaves.

04 Option Item 0003, Laboratory Furniture

a. Provide and install all movable tables shown in detail 2 on contract drawing AL004; this includes the movable tables shown in detail

2A on contract drawing AL302, the movable tables with casters shown in detail 2B on contract drawing AL302, and the movable tables with adjustable height legs shown in detail 7 on contract drawing AL303.

b. Provide and install the base cabinets D18G that are shown in detail 3 on contract drawing

AL004 and identified on the plan sheets

AL112, AL113, AL122, and AL123.

c. Provide and install the base cabinets LC18G* that are shown in detail 3 on contract drawing

AL004 and identified on the plan sheets

AL112, AL113, AL122, and AL123.

d. Provide and install the base cabinets B18RG and B18LG that are shown in detail 3 on contract drawing AL004 and identified on the plan sheets AL112, AL113, AL122, and

AL123.

e. Provide and install the Open Industrial

Shelving Units shown in detail 8 on sheet

AL303. These shelving units are located in rooms 175, 185, and 273.

05 Option Item 0004, Pavers and Planters

a. Install a 4-inch thick reinforced concrete slab under the precast pavers as specified in detail

4/L401, and install the L4”x4” galvanized steel edge angle as specified in detail 3/L402.

These items are also shown in the following details:

The base bid shall not include the 4-inch thick reinforced concrete sub-slab. The precast paver edge support for the base bid shall be provided by ¼” x 5” galvanized steel edging in 16 foot lengths (Heavy Duty DuraEdge as manufactured by the J.D. Russel Company, or approved equal) , instead of the L4”x4” galvanized steel angle. The precast paver subgrade elevation shall be raised 4 inches and all other requirements of the paver installation shall be unchanged. The galvanized steel edging shall be installed in accordance with the manufacturer’s written requirements.

b. Install the reinforced concrete planters located in the precast paver areas as specified in details 1/L402, 2/L402, and 2/L503 and as shown in the following plans, sections and details:

This option item also includes all landscape planting and materials, irrigation, drain lines and other work required to install the concrete planters as shown in the above referenced details.

The base bid for these areas is to install precast pavers in the areas where the planters are shown. The precast paver installation in these areas shall match the detail for the adjacent pavers.

06 Option Item 0005, Roof Screen and Canopy Panels

a. Provide and install the roof screen panels identified as option items in Details A6 and

D6 on sheet A201.

The base bid includes all structural steel framing for the roof screen shown in Details 2, 3 and 4 on sheet S501, and all roof screen panels not identified as option item 5.

b. Provide and install the shade canopy panels identified as option items in Details B6 and

D6 on sheet A441.

The base bid includes all structural steel framing for the shade canopy structure shown on sheets S113, S501, and S511, and all shade canopy panels not identified as option item 5.

7 Option Item 0006, Metal Plank Ceiling Install metal plank acoustic ceiling (ACT-3 and ACT-4) in the following areas as shown on drawings A141, A142, A151, and A152:

The base bid ceilings for the areas listed above shall be ACT-2 suspended tegular acoustic ceiling in a pattern similar to the ceiling in

Provide and install the interior storefront system as described in specification section xxx and as shown in the following elevations:

The base bid for each of the wall elevations listed above shall be Type S4.FD painted gypsum board partitions with painted hollow metal door frames installed in accordance with the typical details shown on the drawings. Note the base bid includes interior storefront in three locations as shown in the following wall elevations:

Description of Work:

Construction of a new two-story, 40,000 ft2 reinforced concrete laboratory building. The building includes approximately 19,000 ft2 of wet lab and lab support space and approximately 21,000 ft2 of private and open office space, conference rooms, break rooms, and mechanical and electrical rooms.

The laboratory wing includes extensive laboratory electrical and plumbing systems. Fixed and mobile laboratory casework, and chemical fume hoods. The building is designed to achieve LEED Silver and includes energy efficient mechanical systems, LED lighting throughout with a lighting control system, natural ventilation of the office space, and a steel canopy structure to shade the extensive south facing glazing.

The project includes installation of underground utilities, an on-site parking lot, pedestrian paving, construction of storm water treatment bioswales, landscaping and irrigation.

E.2. INSPECTION OF CONSTRUCTION (FAR 52.246-12) (AUG 1996)

(a) Definition. Work includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The

Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to

Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not -

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may -

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor's right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the

Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

F.2. COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10) (APR

The Contractor shall be required to (a) commence work under this contract within fifteen (15) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 660 calendar days after the date the contractor receives the notice to proceed. F.3. LIQUIDATED DAMAGES – CONSTRUCTION (FAR 52.211-12) (SEP 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,000.00 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

F.4. BUILDING INFORMATION MODELING (BIM)

(a) The majority of the project design has been performed using 3D Building Information Modeling (BIM). Autodesk Revit software has been used to develop the BIM. The civil drawings and some elements, such as details, are in 2D AutoCAD.

(b) Following Notice to Proceed, the contractor may request a copy of the Government’s BIM model that may be used as a starting point if the contractor elects to use BIM as a management tool on this project. The contractor may use these BIMs at its own risk. The contractor shall verify all information contained in this model. The Government and the Government’s design team accept no liability for the accuracy of the BIMs or any other electronic files provided to the contractor. At the completion of construction, the Contractor may submit current Autodesk Revit BIMs for Building N288 that have been updated to reflect the accurate as-built conditions as part of the contract required as-built documentation.

H.2. SAFETY AND HEALTH Measures and Mishap Reporting (NFS 1852.223-70) (DEC 2015)

(a) Safety is the freedom from those conditions that can cause death, injury, occupational illness, damage to or loss of equipment or property, or damage to the environment. NASA’s safety priority is to protect: (1) the public, (2) astronauts and pilots, (3) the NASA workforce (including contractor employees working on NASA contracts), and (4) high-value equipment and property.

(b) The Contractor shall take all reasonable safety and occupational health measures in performing this contract. The Contractor shall maintain an effective worksite safety and health program with organized and systematic methods to—

(1) Comply with Federal, State, and local safety and occupational health laws and with the safety and occupational health requirements of this contract;

(2) Describe and assign the responsibilities of managers, supervisors, and employees;

(3) Inspect regularly for and identify, evaluate, prevent, and control hazards;

(4) Orient and train employees to eliminate or avoid hazards; and

(5) Periodically review the program’s effectiveness.

Authorized Government representatives shall have access to and the right to examine the work site and related records under this Contract in order to determine the adequacy of the Contractor’s safety and occupational health measures.

(c) The Contractor shall take, or cause to be taken, any other safety, and occupational health measures the Contracting Officer may reasonably direct. To the extent that the Contractor may be entitled to an equitable adjustment for those measures under the terms and conditions of this contract, the equitable

H-2 adjustment shall be determined pursuant to the procedures of the changes clause of this contract; provided, that no adjustment shall be made under this Safety and Health clause for any change for which an equitable adjustment is expressly provided under any other clause of the contract.

(d) The Contractor shall immediately notify the Contracting Officer or a designee any Type A, B, C, or D Mishap, or close calls as defined in NASA Procedural Requirement (NPR) 8621.1, Mishap and Close

Call Reporting, Investigating, and Recordkeeping. In addition, service contractors (excluding construction contracts) shall provide quarterly reports specifying lost-time frequency rate, number of lost-time injuries, exposure, and accident/incident dollar losses as specified in the contract Schedule.

(e) The Contractor shall cooperate with any Government-authorized investigation of Type A, B, C, or D Mishaps, or Close Calls reported pursuant to paragraph (d) of this clause by providing access to employees; and relevant information in the possession of the Contractor regarding the mishap or close call.

(f)(1) The Contracting Officer may notify the Contractor of any noncompliance with this clause and specify corrective actions to be taken. When the Contracting Officer becomes aware of noncompliance that may pose a serious or imminent danger to safety and health of the public, astronauts and pilots, the NASA workforce (including contractor employees working on NASA contracts), or high value mission critical equipment or property, the Contracting Officer will notify the Contractor orally, with written confirmation.

The Contractor shall promptly take any necessary corrective action.

(2) If the Contractor fails or refuses to institute prompt corrective action in accordance with subparagraph (f)(1) of this clause, the Contracting Officer may—

(i) Invoke the stop-work order clause in this contract;

(ii) Require the Contractor to remove and replace Contractor or subcontractor personnel who fail to comply with or violate applicable requirements of this clause;

(iii) Record the Contractor’s failure to comply in the appropriate databases of past performance; and

(iv) Consider the Contractor’s failure to comply in any responsibility determination or evaluation of past performance.

(g) The Contractor shall insert the substance of this clause, including this paragraph (g) in all subcontracts above the simplified acquisition threshold when the work will be conducted completely or partly on federally-controlled facilities.

H.3. KEY PERSONNEL AND FACILITIES (NFS 1852.235-71) (MAR 1989)

(a) The personnel and/or facilities listed below (or specified in the contract Schedule) are considered essential to the work being performed under this contract. Before removing, replacing, or diverting any of the listed or specified personnel or facilities, the Contractor shall (1) notify the Contracting Officer reasonably in advance and (2) submit justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on this contract.

(b) The Contractor shall make no diversion without the Contracting Officer's written consent; provided, that the Contracting Officer may ratify in writing the proposed change, and that ratification shall constitute the Contracting Officer's consent required by this clause.

(c) The list of personnel and/or facilities (shown below or as specified in the contract Schedule) may, with the consent of the contracting parties, be amended from time to time during the course of the contract to add or delete personnel and/or facilities.

H.4. DENIED ACCESS TO NASA FACILITIES (NFS 1852.242-72) (OCT 2015)

(a)(1) The performance of this contract requires contractor employees of the prime contractor or any subcontractor, affiliate, partner, joint venture, or team member with which the contractor is associated, including consultants engaged by any of these entities, to have access to, physical entry into, and to the extent authorized, mobility within, a NASA facility.

(2) NASA may close and or deny contractor access to a NASA facility for a portion of a business day or longer due to any one of the following events:

(i) Federal public holidays for federal employees in accordance with 5 U.S.C.

6103.

(ii) Fires, floods, earthquakes, unusually severe weather to include snow storms, tornadoes and hurricanes.

(iii) Occupational safety or health hazards.

(iv) Non-appropriation of funds by Congress.

(v) Any other reason.

(3) In such events, the contractor employees may be denied access to a NASA facility, in part or in whole, to perform work required by the contract. Contractor personnel already present at a NASA facility during such events may be required to leave the facility.

(b) In all instances where contractor employees are denied access or required to vacate a NASA facility, in part or in whole, the contractor shall be responsible to ensure contractor personnel working under the contract comply. If the circumstances permit, the contracting officer will provide direction to the contractor, which could include continuing on-site performance during the NASA facility closure period. In the absence of such direction, the contractor shall exercise sound judgment to minimize unnecessary contract costs and performance impacts by, for example, performing required work off-site if possible or reassigning personnel to other activities if appropriate.

(c) The contractor shall be responsible for monitoring the local radio, television stations, NASA

Web sites, other communications channels, for example contracting officer notification, that the NASA facility is accessible. Once accessible the contractor shall resume contract performance as required by the contract.

(d) For the period that NASA facilities were not accessible to contractor employees, the contracting officer may—

(1) Adjust the contract performance or delivery schedule for a period equivalent to the period the NASA facility was not accessible;

(2) Forego the work;

(3) Reschedule the work by mutual agreement of the parties; or

(4) Consider properly documented requests for equitable adjustment, claim, or any other remedy pursuant to the terms and conditions of the contract.

(e) Notification procedures of a NASA facility closure, including contractor denial of access, as follows:

(1) The contractor shall be responsible for monitoring the local radio, television stations, NASA Web sites, other communications channels, for example contracting officer notification, for announcement of a NASA facility closure to include denial of access to the NASA facility. The contractor shall be responsible for notification of its employees of the NASA facility closure to include denial of access to the NASA facility. The dismissal of NASA employees in accordance with statute and regulations providing for such dismissals shall not, in itself, equate to a NASA facility closure in which

H-4 contractor employees are denied access. Moreover, the leave status of NASA employees shall not be conveyed or imputed to contractor personnel. Accordingly, unless a NASA facility is closed and the contractor is denied access to the facility, the contractor shall continue performance in accordance with the contract.

(2) NASA’s Emergency Notification System (ENS). ENS is a NASA-wide Emergency Notification and

Accountability System that provides NASA the ability to send messages, both Agency-related and/or

Center-related, in the event of an emergency or emerging situation at a NASA facility. Notification is provided via multiple communication devices, e.g. Email, text, cellular, home/office numbers. The ENS provides the capability to respond to notifications and provide the safety status. Contractor employees may register for these notifications at the ENS Website:

H.5. EQUITABLE ADJUSTMENTS (NFS 1852.243-72) (APR 1998)

(a) The provisions of all other clauses contained in this contract which provide for an equitable adjustment, including those clauses incorporated by reference with the exception of the "Suspension of

Work" clause (FAR 52.242-14), are supplemented as follows:

Upon written request, the Contractor shall submit a proposal for review by the Government. The proposal shall be submitted to the contracting officer within the time limit indicated in the request or any extension thereto subsequently granted. The proposal shall provide an itemized breakdown of all increases and decreases in the contract for the Contractor and each subcontractor in at least the following detail:

material quantities and costs; direct labor hours and rates for each trade; the associated FICA, FUTA, SUTA, and Workmen's Compensation Insurance; and equipment hours and rates.

(b) The overhead percentage cited below shall be considered to include all indirect costs including, but not limited to, field and office supervisors and assistants, incidental job burdens, small tools, and general overhead allocations. "Commission" is defined as profit on work performed by others.
