2.14.1 - Recurring Work Preparation of

Proposals

We recommend adding separate ELINs for contractors to provide unit prices for pricing additions and deletions to the recurring work requirements post award. For example, if a building is added to the contract that requires recurring custodial services, it would be easier for contractors to provide a unit price for the various COLs related to custodial services.

Mississippi sales tax levies a 3.5% contractor's tax on all construction, renovation or repair of non-residential, real property when the total contract price or compensation received exceeds $10,000. If the contract exceeds $75,000 in scope or if the contractor is from another state, the contractors tax must be paid before work begins. Section C- 0100000 1.7

The paragraph states that "all facilities, systems and assets identified in this contract shall be accepted by the contractor in “AS-IS” condition. The contractor is fully responsible for all work up to and including the limits of liabilities specified”. How can any offeror other than the incumbent prepare an equitable proposal without know what the condition of systems are? Non-recurring work has a limit of liability of $2500 in direct material cost. Not knowing the status of systems puts offerors at a decided disadvantage while at the same time potentially allows the incumbent the ability to withhold repairs in order to save money. Respectfully request that repairs determined during a change on contractor allows for the incoming contractor to bill for work performed.

Section C- 0200000 2.9.5

The second paragraph states that “written documentation of the last weight test of the crane and all related weight handling equipment shall be maintained on site.” This reads as if the contractor is responsible for owning a crane. If this was a rental unit, there is no guarantee that the same machine would be provided each time one was sent thereby not allowing for any continuity regarding the weight test paperwork. Please clarify.

Section C- 1502000 1.1

The building systems (including FRCS) section of this paragraph includes fire protection however, we do not see any fire protection equipment listed in the Section J Inventories Listings.

All In evaluation of corporate and past experience, will the Government accept ongoing or completed projects that meet all listed relevancy requirements, from tier one subcontractors?

11/19/2021 CBA pg.

Article XVIII, Section 1

Referencing the CBA, specifically regarding vacation hours for project personnel, the Government has stated that continuous service accumulated with prior contractors will be counted in determining the amount of PTO for which an employee is eligible. In all other cases, service for PTO purposes will date from the employee's date of hire by the Company. However, no seniority/balance list has been provided to bidders to account for accrued time.

Additionally, SCA Length of service includes the whole span of continuous service with the present contractor or successor wherever employed and with the predecessor contractors in the performance of similar work at the same Federal facility. (Reg. 29
