GOVERNMENT PRE AWARD INQUIRY FORM
Page Section Para.
1 22‐Jul 42 Section L L.13(b)(1)(f)
Is the evaluation of Financial Statements being used as a Standards of Responsibility or scoring for evaluation? In either case, what is the Standard to which a Contractor will be deemed "Acceptable vs Unacceptable"?
In accordance with FAR 9.103, an award cannot be made without an affirmative determination of responsibility. The responsibility standards are in accordance with FAR 9.104. Evaluation of Financial Statements are not included within the Evaluation Factors, which are stated in Section M.3 of the Solicitation.
2 22‐Jul 42 Section L L.13(b)(1)(g)
Same question as above: What is the Standard that the Government will consider to be "Acceptable" evidence of availability of working/operating capital? Is it a specific amount or percentage of capital proportionate to the estimated program cost, a debt‐to‐income ratio, credit score, etc.?
Per FAR 9.104‐1(a), a prospective contractor must have adequate financial resources or the ability to obtain them. Refer to FAR 9.104‐3 regarding additional information on the ability to obtain resources.
If based upon the information provided within the offerors proposal, the Contracting Officer makes a determination of nonresponsibility, the matter will be referred to the Small Business Administration under the Certificate of Competency Program; the SBA has the ultimate determination regarding responsibility for small business concerns. 2
3 22‐Jul 43 Section L L.13(b)(1)(i)
Same question as above: What is the Standard that the Government will consider to be "Acceptable vs Unacceptable"? Is answering the items 1‐5 deemed responsive?
Submission of a plan in accordance with DFARS 252.237‐7024 is required per L.13(b)(1)(i). Yes, the plan must address at a minimum the items identified in paragraphs (i) through (v) of this clause.
4 22‐Jul 50 Section M M.10(1) Factor 1
It is unclear which attachment is to be used. JM‐1 N6945019R1830 Corporate Experience or JM‐3 N6945019R1830 PPQ both appear to require completion by a Client and not the Contractor submitting the proposal. Additionally, attachment JM‐1 uses definition/note language consist with FAR Table 42‐1, however the attachment JM‐3 provides no such definitions. How will consistency be upheld in the completion and evaluation of these two separate documents?
A revised JM‐1 and JM‐3 Document will be provided via Amend 0002.
5 22‐Jul 50 Section M M.10(2) Factor 2
The Government reserves the right to determine the criteria "Unacceptable" if the staffing levels for each trade classification are 5% lower than what the Government anticipates? If this is so, then what does the Government anticipate the staffing levels to be for each trade. If not provided, than Offerors are left to "guess".
As stated in Factor 2 (or Section M.3, Factor 2) of the Solicitation, Staffing evaluations will be performed by one or more of the following techniques to identify adequate staffing levels:
1. Comparison of proposed staffing levels received in response to the RFP.
2. Comparison of proposed staffing levels with the IGE.
3. Comparison of proposed staffing levels with available historical information.
The staffing levels anticipated by the Government cannot be disclosed.
This is a performanced based requirement. Offerors are advised to use industry knowledge and experience to determine the staffing levels required to meet the requirements of the RFP including the Post Manning Requirements in Attachment J‐ 0401000‐12.

General question
We are aware that employed officers must hold specific guard licenses, but we have learned that state licensure requirements for the offeror’s organization have recently been waived for vendor contracts situated on military bases in order to make it more cost effective. For example, Fort Bragg, Homestead, NASA and Nellis Air Force Base all waive the requirement for the contractor to hold a state license. Could you advise us as to what NAVFAC will be requiring in regards to license requirements for the offeror’s organization?
There are no permit or licensure requirements waivers for performance of this contract. Refer to Section C, Annex 020000 spec item 2.3.4.
