PAYMENT OF FIXED FEE (COMPLETION TYPE)
FIXED FEE: * The Government shall make payment to the task order when requested as work progresses, but no more frequently than biweekly, on account of the fixed fee, equal to ** percent of the amounts invoiced by the task order under the “Allowable Cost and Payment” clause hereof for the related period. In the event of discontinuance of the work in accordance with clause of this contract entitled “Limitation of *** ,” the fixed fee shall be redetermined by mutual agreement equitably to reflect the diminution of the work performed; the amount by which such fixed fee is less than, or exceeds payments previously made on account of fee, shall be paid, or repaid by, the task order, as the case may be.
* To be completed in individual task orders.
** Percentage rate of fee established in the task order. Cost Plus Fixed Fee Task Orders may not exceed ____% Fixed Fee.

PAYMENT OF FIXED FEE (TERM TYPE)
(a) For purposes of this task order, “fee” means "fixed fee" in cost-plus-fixed-fee type contracts for level of effort type task orders.
(b) The Government shall make payments to the Contractor, subject to and in accordance with the clause in this contract entitled "FIXED FEE" (FAR 52.216-8). Such payments shall be submitted by and payable to the Contractor pursuant to the clause of this task order entitled "ALLOWABLE COST AND PAYMENT" (FAR 52.216-7), and fee shall be paid at the hourly rate(s) specified in the table below per direct labor hour performed and invoiced. It is understood and agreed that the rate of man-hours per month may fluctuate in pursuit of the technical objective, provided such fluctuation does not result in the use of the total man-hours of effort prior to the expiration of the term hereof, except as provided in the following paragraph.
(e) If the total level of effort specified in paragraph (a) above is not provided by the Contractor during the term of this task order, the Task Order Contracting Officer, at its sole discretion, shall either (i) reduce the fee of this task order as follows:

(g) Notwithstanding any of the provisions in the above paragraphs and subject to the LIMITATION OF FUNDS or LIMITATION OF COST clauses, as applicable, the period of performance may be extended and the estimated cost may be increased (without increasing the fixed fee) in order to permit the Contractor to provide all of the man-hours listed in paragraph (a) above. The contractor shall continue to be paid fee for each man-hour performed in accordance with the terms of the task order.
(h) Notwithstanding any of the provisions in the above paragraphs, if the Contractor has provided all of the man-hours required in paragraph (a) prior to expiration of the term of the task order, the Contracting Officer may require the Contractor to continue performance until the expiration of the term or until the expenditure of the estimated cost of the task order. The fee shall remain as set forth in Section B.
