FY20 MCAF P-9021/PAF189021 APSI – AIRFIELD DEVELOPMENT, PHASE 1 AND FY20

MCAF P-9022/PAF189022 APSI – PARKING APRON, TINIAN INTERNATIONAL

AIRPORT, TINIAN, CNMI

NOTE: The following questions and answers are provided for INFORMATION ONLY. The RFP remains unchanged unless it is amended in writing on a Standard Form 30.

THE GOVERNMENT WILL NOT RESPOND TO QUESTIONS RECEIVED AFTER

THE DATE OF THIS NOTICE.

RESPONSES DEFERRED FROM NOTICE NO. 8 DATED 20 JANUARY 2021

149. Page 4 of SF1442 that is part of the RFP states that “[a] firm fixed-price is required for all line items.” The RFP also states at page 4 of Document 00202 that the term “Logistical challenges” “is where construction materials, equipment, manpower, and workforce infrastructure are not readily available, similar to the Commonwealth of the Northern Mariana Islands.” In addition, the RFP includes a liquidated damages provision at section I.29 of page 4 of Document 00700. However, the RFP does not specifically refer to the current worldwide COVID pandemic except in connection with a one-time pre-proposal site visit referenced in section I.19 at page 12 of Document 00100 of the RFP (FAR 52.236-27, Site Visit (Construction) (FEB 1995)). As such, the RFP does not identify any COVID-related restrictions on contractor access to CNMI or Tinian International Airport. Please identify all COVID-related testing, prescreening, immigration, quarantine (including quarantine requirements associated with Saipan Island and Tinian Island), or other requirements for access to CNMI (“CNMI COVID requirements”) currently in existence that will apply to work to be performed under the contract – work that involves logistical challenges and provides for liquidated damages.

ANSWER: It is the Contractor’s responsibility to identify any COVID-related restrictions that will apply to the work to be performed under the resultant contract. Recommend that Contractors refer to the Guam government website at https://www.guam.gov/ and the CNMI government website at https://governor.gov.mp/ for the latest information on COVID-19 and for information on who to contact if Contractors should have any questions.

150. Please identify all COVID-related testing, prescreening, immigration, quarantine, or other requirements for access to Tinian Island currently in existence that will apply to work to be performed under the contract (“U.S. Government COVID requirements”), including any CNMI

COVID requirements that NAVFAC will impose on work to be performed at Tinian International Airport.

151. Does NAVFAC expect offerors to prepare their price proposals based on the currently existing CNMI COVID requirements and U.S. Government COVID requirements identified in response to questions 1 and 2 above?

ANSWER: Yes.

152. If NAVFAC requires compliance with CNMI COVID requirements or U.S. Government COVID requirements not currently identified, will such required compliance with subsequently imposed requirements constitute a change to the contract under FAR 52.243-4, Changes (JUN 2007) (section 1.121 at page 11 of 18 of Document 00700 in the RFP), potentially entitling the contractor to cost and schedule relief in accordance with the terms of the referenced Changes clause?

If no, what contract provision will provide cost and schedule relief for COVID related unavoidable delays?

ANSWER: No; however, FAR 52.249-10 Default (Fixed-Price Construction) (Apr 1984) will be incorporated in the resultant contract and could provide Contractors a potential time relief under warranted circumstances. Cost relief will not be provided.

153. Will pretesting documentation be required to allow bypassing of any quarantine restrictions in CNMI, specifically Saipan Island as well as Tinian Island?

If yes, please describe such documentation.

154. Are there sufficient medical infrastructure in place on Tinian in order to handle a COVID outbreak of greater than 25 people? If so, please describe that infrastructure.

155. With respect to COVID, will the contractor be required to contact trace, temperature check, and provide reports regarding status to the U.S. Navy during performance of this contract?

ANSWER: There are no contract specific COVID requirements; however, Contractors are expected to comply with all Guam, CNMI, and local government COVID protocols.

Recommend that Contractors refer to the Guam government website at https://www.guam.gov/ and the CNMI government website at https://governor.gov.mp/ for the latest information on COVID-19 and for information on who to contact if Contractors should have any questions.

156. Due to COVID concerns, will NAVFAC include FAR clause 48 CFR 52.249-14 – Excusable Delays – in the contract?

ANSWER: No; however, FAR 52.249-10 Default (Fixed-Price Construction) (Apr 1984) is included in the RFP and will be incorporated in the resultant contract.

NOTICE NO. 9

158. 20R1313_SPECS_PARTA_Vol1of3, Storm Water Pollution and Prevention Plan, paragraph 5.3. In the Specifications, section 01 57 19.01 20, the Storm Water Pollution Prevention Plan and Water Discharge Permit for this project are provided. In Paragraph 5.3 of the Permit, it is stated that major equipment repairs will not be allowed to be performed within the Project area. Additionally, it is stated that, “A designated are will be provided to the contractor/operator for equipment maintenance.”

This project requires a large quantity of heavy construction equipment that will be used over a period of 4 years. Major mechanical failures of the equipment will occur and will need to be repaired.

Will the Government please indicate the location where the Contractor will be allowed to perform major equipment repairs, as indicated in paragraph 5.3 of the Storm Water Pollution Prevention Plan?

ANSWER: The contractor may mobilize fueling equipment and repair equipment within the project area. The contractor must provide containment pads and areas where fueling and maintenance of vehicles occur. If the aggregate aboveground storage capacity is greater than 1,320 gallons, it requires a Spill Prevention Control and Countermeasures Plan (SPCC Plan).

Additional permits may be required, which should be coordinated between the contractor and

GEPA.

159. 20R1313_SPECS_PARTA_Vol1of3, 01 14 00, Final EBS, Island of Tinian, CNMI, Page

vii. On page vii of the Environmental Baseline Survey, it is recommended by the study that, “Prior to construction activities, a soil management plan should be prepared to address the elevated metals.” However, no requirement for dealing with metals in the soil are included in the scope of work for this RFP.

1) Please confirm management, remediation, removal, or control of metals from the exiting soil is not part of this contract.

2) Have the metals been removed by a previous contract?

3) If no, please provide the requirements for how the metals in the soil will be handled for this Design Bid Build Project.

ANSWER: If metals are encountered, they must be managed in accordance with federal, state, and local regulations and as indicated in Specification Section 01 57 19 corresponding to concentrations encountered. Metals have not been removed by a previous contract. Documents containing the best available information on the presence of metals in the field are provided in the contract documents.

160. 20R1313_SPECS_PARTA_Vol1of3, 01 50 00, Para. 2.1.2. In the project specifications section 01 50 00, page 3, paragraph 2.1.2, the Contractor is instructed to provide the project sign within 15 calendar days after receipt of the notice to proceed. Given the project location, the specified requirements for the project sign, Sign manufacturer duration and shipping duration to the project site, it is not possible to in stall the project sign within this time frame. The Contractor needs a minimum of 90cal days to provide the project sign.

Can the Government please extend the duration for the install of the project sign to 90days?

ANSWER: No.

161. 20R1313_SPECS_PARTA_Vol1of3, 01 50 00, Para. 3.6. In section 01 50 00, paragraph 3.6, the Contractor is required to provide a government field office within 60 calendar days of notice to proceed. This is not possible for the following reasons:

1) As stated in 01 50 00, 3.3.1, no utilities are available. As a result, utilities will need to be installed from existing island utilities.

2) The install of new utilities will require earthwork and soil disturbance, which will not be allowed until the BECQ earthmoving permit is approved.

3) Erosion control and stormwater permits need to be in place before the utilities can be installed.

4) Existing utilities are a significant distance away from the project site.

5) Before equipment can be used to install the utilities or office, an air permit will need to be approved by BECQ per 01 57 19, 1.4.2, which can take up to 90days.

6) The project quality Control plan, Environmental protection plan, and Safety Plan will need to be prepared, submitted, reviewed, and approved before any work to install the site office can begin.

7) The materials required for the installation of the Government office will need to be shipped to the project. Currently MATSON is making one (1) Trip to Tinian per month. It will not be possible to get the materials submitted, approved, purchased, delivered to port, and shipped to Tinian within 60 days. This will require a minimum of 120day just to get the material to Tinian.

An additional 60days will be required to install the facility and all the temporary utilities.

The current requirement to provide a site office within 60days in not possible with the current contract requirements. Will the Government please extend the Duration for the Contractor to install the Government field office to 180days?

ANSWER: No.

162. 20R1313_SPECS_PARTA_Vol1of3, 01 50 00, Para. 3.8. In section 01 50 00, paragraph

3.8 the Contractor is required to install Temporary Project safety Fencing at the work site. Given the project area is currently undeveloped with no public spaces or pedestrian traffic the requirement to provide safety fencing around the entire project site seems unnecessary and will add additional cost to the project.

1) Will the Government allow the Contractor to install safety fencing and a locking gate along the Project Limit that is parallel to Broadway and the Project limit that follows 8th avenue? This limits the quantity of fence to be mobilized, installed, removed, and disposed.

ANSWER: Safety fence can be installed at the locations identified, but the Contractor will be responsible for any injury, damage or any equipment/material lost due to not having a completely enclosed site. Security of the airfield is to be maintained at all times and any disruption of the airfield perimeter fence must be addressed per the construction phasing plans.

163. 20R1313_SPECS_PARTA_Vol1of3, 01 50 00, Para. 3.8. In section 01 50 00, paragraph

3.8 the Contractor is required to install Temporary Project safety Fencing at the work site. Will the Government require the Contractor to install temporary Safety fencing around the electrical work that will occur adjacent to 8th avenue?

ANSWER: Yes. The safety fencing must be provided.

164. 20R1313_SPECS_PARTA_Vol1of3, 01 57 19, paragraph 3.15. In the specifications section 01 57 19, paragraph 3.15, the Contractor is informed that Fuel and Oil Storage on the project site is prohibited and that fuel must be brought to the site each day that work is performed. This project requires a large quantity of heavy equipment and will consume tens of thousands of gallons of fuel. The requirement to deliver this large quantity of fuel on a daily basis will result in schedules delays and additional cost. This will also result in significant additional air pollution being produced by the transportation trucks making daily trips to the project site for refueling.

Will the Government please remove this requirement and allow the Contractor to store fuel and oil on the project site with the proper secondary containment?

ANSWER: Please see response to Q158. Specification Section 01 57 19 is revised via Amendment No. 0010, accordingly.

165. 20R1313_SPECS_PARTA_Vol1of3, 01 57 19, paragraph 3.1. In the specifications section 01 57 19, paragraph 3.1, the Contractor is instructed to perform clearing in the dry season if possible and that Construction during 5months of the year should be avoided or minimized during the rainy season.

If, during the performance of this contract, the Contractor is instructed by the Government to stop work during the rainy season, will the Government compensate the Contractor for the delay?

ANSWER: No additional compensation will be provided if stoppages indicated in paragraph 3.1 of Specification Section 01 57 19 are due to inadequate BMPs. If stoppages are due to inclement weather, additional time will be provided in accordance with Specification Section 01 32 17.00 20.

166. 20R1313_SPECS_PARTA_Vol1of3, 01 57 19, paragraph 3.1. In the specifications section 01 57 19, paragraph 3.1, the Contractor is instructed to perform clearing in the dry season if possible and that Construction during 5months of the year should be avoided or minimized during the rainy season.

A majority of the scope of work for this RFP involves soil disturbances. Is the Contractor required to stop soil disturbing activities during the 5month rainy season?

ANSWER: The contractor should coordinate with BECQ and JRM to determine appropriate contractor means and methods to minimize need for stoppages due to inadequate BMPs. The contractor may not be required to stop soil disturbing activities with proper BMPs.

167. 20R1313_SPECS_PARTA_Vol1of3, 01 74 19 Paragraph 1.5. In the specifications Paragraph 01 74 19, Paragraph 1.5, the Contractor is instructed that all construction solid waste must be disposed off Island.

Will the Green Waste generated from Clearing and Grubbing be required to be shipped off Island or can the green waste be disposed on Tinian? Importing green waste into another country for disposal poses a significant risk of introducing invasive species into the country of disposal.

ANSWER: Green Waste is not considered “construction solid waste.” As such, green waste may be disposed of properly (as prescribed in the HACCP Plan) on Tinian to address Little Fire Ants (LFA), coconut rhinoceros beetle (CRB), and other invasive species that proliferate in green waste piles.

168. 20R1313_SPECS_PARTA_Vol1of3, 01 57 19, paragraph 3.15 & Storm Water Pollution Prevention Plan. In the specifications section 01 57 19, paragraph 3.15, the Contractor is informed that Fuel and Oil Storage on the project site is prohibited and that fuel must be brought to the site each day that work is performed. However, this is contradicted by the Storm Water Pollution Prevention Plan (SWPPP) provide in the specifications, which says in paragraph 5.3 that, “No Fueling will take place on-site.”

This project requires extensive use of heavy equipment. Most of the equipment is not highway legal, such as excavators and paving machines, and cannot be driven off site for refueling.

1) Where does the Government expect the Contractor to refuel their equipment if refueling is not allowed on the project site?

2) Will the Government please confirm the SWPPP is incorrect, and that refueling of equipment can be performed on the project site?

ANSWER: The contractor may mobilize fueling equipment and repair equipment within the project area. The contractor must provide containment pads and areas where fueling and maintenance of vehicles occur. If the aggregate aboveground storage capacity is greater than 1,320 gallons, it requires a Spill Prevention Control and Countermeasures Plan (SPCC Plan).

Additional permits may be required, which should be coordinated between the contractor and

GEPA.

169. 20r1313_p9021dwgs, A1/GC500. In the Silt fence detail A1 on GC500, Item 1 states, “SET POSTS AND EXCAVATE A 0.1M X 0.1M TRENCH UPSLOPE ALONG THE LINE

OF POSTS.” However, the dimensions in the detail show the trench should be 900mm deep and 900mm wide.

Will the Government please confirm the trench for the silt fence fabric shall be 0.1M x 0.1M?

ANSWER: Concur. The trench for the silt fence is 0.1 M x 0.1 M (100mm x 100mm).

170. Contract Documents, Sheet E-600. Sheet E-600 Detail A1 shows a 350 MCM copper feeder & Keyed Note #2 says to reference: B1/E-503 for additional information. This detail shows a #6 grounding conductor to the rod. Per NEC Article 250 table 250.66 the size of the grounding conductor should be a #2 to the rod.

ANSWER: See revised Sheet E-503 via Amendment No. 0010 with updated ground connection.

171. Contract Documents, Sheet E-506. Sheet E-506 Detail A1(ADJ TO PAVEMENT) & note #2 shows the #4 bare copper counterpoise halfway between the duct bank & full strength pavement. What is the reason behind having to dig a separate trench to install this when counterpoises are meant to be over the duct bank. Do we need to have detectable warning tape above this so it won’t get dug up later?

ANSWER: This is an Air Force standard detail from UFC 3-535-02, Chapter 2 UNDERGROUND CABLE, CONDUIT AND DUCTS, Figure 1A. No additional warning tape is required.

172. Subject: Tinian Airfield Development – Mobilization. The scope of work for P-9021, Airfield Development Phase 1 and P-9022, Parking Apron requires the purchase & mobilization of essential resources to execute the work such as Batch Plant/delivery trucks/paving spread, on-site testing, temporary offices, storage & man camp facilities to name but a few. These same resources are likewise included in the price proposal for Project P-9030 Cargo Pad with Project P-9040, Maintenance Facility which has already been submitted and continues to remain open for acceptance by the Department of Navy.

Are the Offerors required to treat the Airfield Development/Parking Apron as a stand-alone price proposal and incorporate duplicate resources to those already included in the earlier price proposal for the P-9030 Cargo Pad & P-9040 Maintenance Facility? Please clarify.

ANSWER: Please treat the Airfield Development/Parking Apron project separate, as a stand-alone price, even though a price proposal for the P-9030 Cargo Pad & P-9040 Maintenance Facility project has duplicate resources.

173. N62742-20-R-1313 DOCUMENT 00700, Para. 1.168, Page 23 of 23. In the RFP, section 00700, paragraph 1.168 incorporates DFARS 252.236-7004 by reference. However, the percentage of the lump sum that will be paid upon completion of mobilization is not specified.

Will the Government please confirm that 80% of the Contractors Bid item 0001AB and 0002AB will be paid upon completion of mobilization, and the remaining 20% will be paid upon completion of demobilization?

ANSWER: 60% of the lump sum price will be paid upon completion of the contractor’s mobilization at the work site, and the remaining 40% will be paid upon completion of demobilization. Document 00700 is revised via Amendment No. 0010.

174. N62742-20-R-1313 DOCUMENT 00700, Para. 1.29, Page 4 of 18 (pg. 81 of RFP).

Would the Government please consider capping the Liquidated Damages daily amount stated in

1.29 paragraph (a) of FAR 52.211-12 to a maximum of 15% of the contract value?

ANSWER: No.

File details come from the government source that posted it. Updated .
