RFP QUESTIONS ANSWERS

SOLICITATION N62742-19-R-1199

GUAM BASE OPERATIONS SUPPORT SERVICES, JOINT REGION MARIANAS (JRM)

Amendment 0008

Ques. # Reference (Sect/Para/Page or PWS Sect) Question Government Response

L.7, Factor C - Management Factor C requires resumes and letters of intent for 16 key personnel positions. Many of these positions require experience and qualifications very specific to operation of the Base Operations Support program at Naval Base Guam.

The Government's requirement affords the incumbent contractor with an unfair competitive advantage. The incumbent has operated this contract without competition since 2004, allowing them to identify and hire qualified personnel in positions onerously difficult for other offerors to fill in less than 60 days on a remote island contract. Additionally, Executive Order (E.O.) 13495, “Nondisplacement of Qualified Workers Under Service Contracts” requires the awardee to offer the current workforce right of refusal, obviating any qualified candidates the offeror included in their response.

Will the Government remove the key personnel requirement, or allow offerors to provide qualifications, in lieu of resumes, that meet or exceed the specifications included in the PWS?

Yes. Excel files will be posted.

This Government Response is being revised (originally issued in Amendment No. 0006):

No. See response to Question #49 in Amendment No. 0005.

Attachment_J-1502000- 17_FY18_Historical_Workload_Data

The tab labeled "4-PROJECT" has Work Orders whose Work Type is listed as "ROUTINE." Also, the tab labeled "3- ROUTINE" has Work Orders whose Work Type is listed as "PROJECT." Project and Routine work orders are defined differently in the RFP and require different levels of effort. Can the Government explain why Project Work Orders are listed in 3-ROUTINE, Routine Work Orders are listed in 4-Project?

Please see revised Attachment J-1502000-17 FY18 Historical Workload Data (190815), issued in Amendment No. 0008, reflecting a corrected Column A (Work Type) for tabs 3-ROUTINE and 4-

PROJECTS.

Section C 1602000 Section C - 1602000 Electrical, Section 3.1.1, Berthing and Hotel Services requires the contractor to "Connect sewer, steam, potable water and power within one hour of ship's arrival".

1. Is it the Government's inten on that 1 hour is the mandatory requirement?

2. Is it the Government's inten on that the Contractor should use any and all resources to accomplish the connec ons within the 1 hour time allotted?

3. How will the Government measure the me to connect on those vessels where Contractor personnel only bring the cabling up to the vessel and have to wait for vessel personnel to make the actual connection at whatever schedule they determine is appropriate?

Deferred.

Section F has no clause addressing this requirement or defining when work exceeds the recurring work requirements.

Please clarify what work excceds the recurring work requirements Please provide the referenced section F clause.

See revised Annex 2 Section C in attachment C 0200000 Mgmt Admin (190813), Spec Items 2.14.1 and 2.15 issued under Amendment No. 0007 and Attachment J-1501000-04 Public Works (PW) Work Type Definitions included in the file named N62742-19-R-1199 Section J.1. Recurring work requirements are identified in Spec Item 3 in each annex with Workload Data provided in the associated J Attachment. In accordance with the PWS, the Contracting Officer should be notified when work is expected to exceed these requirements.

Spec Item 2.14 Notification to the Government for work above the recurring work requirement Annex 0200000 Management and Administration.

Spec Item 2.14.1 requires KO notification when work is expected to exceed the recurring work requirements. We have not found anything defining work exceeding the recurring work requirements of port operations Annex 0600000.

How does the Government define work exceeding the recurring work requirements for Annex 0600000 Port operations Spec items 3.1 Ship movements, 3.2 Berth days, 3.3 spill response, 3.4 harbor boat security and 3.5 equipment maintenance? For example barge overhauls can cost nearly $1 million to complete. What portion of a barge or security boat overhaul would be work exceeding the recurring work requirements.

See response to Question #133

Spec Item 3.1 Ship movements Annex 0600000 Port Operations.

Spec Item 3.1 ship movements indicates all work and any overtime requirements shall be approved by the KO or KO designated representative prior to start of work and states the Contractor shall provide estimated labor hours, repair parts and material cost (if applicable) for all work requirements, per Section F.

At what point would estimated labor hours, repair parts and material cost cause the work to be classified as exceeding the recurring work requirements? If all work is considered recurring work please clarify why all work must be approved prior to start.

See response to Question #133. The Government is responsible/obligated to approve work prior to start.

Spec Item 3.5 Equipment Maintenance Annex 0600000 Port Operations and Spec Item 2.14 Notification to the Government for work above the recurring work requirement Annex 0200000 Management and Administration.

Spec Item 3.5 equipment maintenance states all corrective maintenance or repair work and any overtime requirements shall be approved by the KO or KO designated representative prior to start of work. It requires when a corrective maintenance or a need for repair is identified, the Contractor shall submit, within 2 hours, a cost estimate and completion schedule, per Section F. Contractor shall commence work when Government approval has been received.

At what point would estimated labor hours, repair parts and material cost cause the work to be classified as exceeding the recurring work requirements? Are repairs less than $5,000 considered recurring work and greater than $5,000 considered exceeding the recurring work requirement?

See response to Question #133.

Ques. # Reference (Sect/Para/Page or PWS Sect) Question Government Response

Annex 060000, spec. item 3.1.1.3 and 3.1.1.4 Spec. item 3.1.1.3 states that “the contractor will remove berthing equipment within 3 working days after ship movements”. However, spec. item 3.1.1.4 states that “all hoses and power cables will be stowed in designated locations and warehoused immediately or as practicable after disconnection.” Is it, immediately or within 3 days?

The time constraints for the two Spec Items are correct. The two Spec Items address different equipment utilitzed at Port Operations. Spec Item 3.1.1.3 is berthing equipment (brows, platforms, fenders, etc) and Spec Item 3.1.1.4 is utility equipment (shore power cables, CHT hoses, oily waste hoses, etc ).

Annex 170000, spec. item 3.1.4 Fuel Delivery Fuel has to be delivered within 15 minutes of the Government accepted scheduled time or within 1 hour for un-scheduled requests during normal working hours or 2 hours outside of normal working hours. How many calls for fuel are outside of normal working hours?

Based on workload data, the number of calls for fuel outside of normal working hours average less than 2 % of scheduled request as specified in Attachment J-1700000-04 included in the file named N62742-19-R-1199 Section J.1. File N62742-19-R-199 Section J.1 includes workload data for all Annexes.

Annex 060000 spec. item 3.5 Equipment Maintenance In part it states that all corrective maintenance or need for repairs to Harbor Security Boats will be identified and a cost estimate submitted within 2 hours and a cost estimate and completion schedule. It also states that all corrective maintenance or repair work and any overtime requirements will be approved by the KO or KO designate prior to the start of any work. However, the Harbor Security Boats are operated 24/7/365 by security. For this type of response, the KO or KO designate are only available during normal working hours.

A Government representative will be available for approval 24/7/365. The KO designate for Annex 0600000 - Port Operations is the COR.

Annex 170000, Spec. Item 3.3.6 Calls out that the contractor will conduct regular patrols of Joint Region Marianas to identify cranes operating out of compliance of P-307. How frequent does the Government consider “regular” patrols?

Please see Spec Item 3.3.6 in Attachment J-1700000-04 included in the file named N62742-19-R-1199 Section J.1. File N62742-19-R-199 Section J.1 includes workload data for all Annexes.

Annex 060000, spec. item. 3.4.1 Harbor Security Boats. Annex 0600, spec. item. 3.4.1 Harbor Security Boats. States that “Five or seven Harbor Security Boats will be full mission capable (FMC)”. Please define Full Mission Capable (FMC).

See revised Attachment J-0200000-01 Definitions and Acronyms (190815) issued in Amendment No.

Deferred.

Spec Item 2.14 Notification to the Government for work above the recurring work requirement Annex 0200000 Management and Administration.

Spec Item 2.14.1 requires KO notification when work is expected to exceed the recurring work requirements. We have not found a PWS or RFP paragraph defining work exceeding the recurring work requirements of utilities Annex 1601000.

How does the Government define work exceeding the recurring work requirements for Annex 1601000 Utilities, spec items 3.1 Utility work orders? In order to demonstate an understanding of the work with our proposed staffing we need to understand the definition of recurring work and at what point the work becomes work exceeding the recurring work requirements. For example are work orders greater than $30,000 "work above the recurring work requirements" for Annex 1601000 Utilities?

See response to Question #133.

Attachment J-1605000-03 Workload data identifies 2 projects greater than $25,000 that require approval by the COR.

Are these projects considered work above the recurring work requirement?

If not, at what value is the work no longer project work and considered work above the recurring work requirement

No, the 2 projects identified in Attachment J-1605000-03 Workload Data, included in the file named N62742-19-R-1199 Section J.1, do not exceed the recurring work requirement.

See response to Question #133 for recurring work requirements. Project work is considered a type of recurring work requirements.

Annex 10502000 Spec Item 3.3 Integrated Maintenance Program and Attachment J-1502000-07.

Annex 1502000 Spec Item 3.3 requires and Integrated Maintenance Program. Attachment J-1502000-07 identifies functions and locations, but does not identify the equipment items for the Integrated Maintenance Program. Please provide the Equipment List for the Integrated Maintenance Program.

JH-3 CBA Will Memorandum of Agreement #4, dated 07/17/2019, that increases wages $2.00 per hour effective 08/01/2019 for all Journeyman Water Plant and Waste Water Plant Operators level II thru IV be incorporated in a future amendment?

Deferred.

Section C - Table 0200000 -Management and Administration Spec Item: 2.9.1.1 - Experience Modified Rate (EMR)

Spec Item 2.9.1.1 states: "No subcontractor on the project shall have an effective EMR greater than 1.10 when entering into a subcontract agreement with the prime contractor or a subcontractor at any tier as computed by the National Council on Compensation Insurance (NCCI) or if not available, as computed by the state agency’s rating bureau in the state where the subcontractor is registered. Prime Contractor may submit a written request for additional consideration to the Contracting Officer where the specified acceptable EMR range cannot be achieved for a particular subcontractor whose performance is uniquely critical to the project. Relaxation of the EMR range shall only be considered and/or granted on a case-by-case basis for special conditions and shall not be anticipated as tacit approval.

Background: Unlike most all states, insurance companies do not use a rate modification plan and routinely assign a fixed rate plan to Guam pure/registrered subcontractors, which does not use any sort of deviation.

Question: For those essential Oconus or Guam-based sub-contractors that may not have an EMR rating may the Offerer qualify using the elements of Spec Item 2.9.1.2 which includes historical Day-Away-Restricted-Time (DART) of <3.0?

Contractors and subcontractors shall submit the following based on location:

Hawaii, Alaska, & CONUS: EMR rate for the three year period, as well as the TCR and DART rates.

Guam & Foreign: TCR and DART rates for the requisite 3 year period.
