About this file

This file is Amendment 0003 to a Request for Quote (RFQ) for wastewater treatment services, containing clarifications to previous amendments through a Questions and Answers format addressing six substantive issues (Questions 18-23).

The amendment clarifies critical requirements for contractor eligibility and evaluation. Regarding cybersecurity compliance, the Government confirmed that prospective vendors must have a current (not older than three years) NIST SP 800-171 DoD Assessment score posted in the Supplier Performance Risk System (SPRS) prior to contract award, not by the solicitation closing date, to be eligible for award. A vendor without an active score at the time of award decision will be rated "No-Go" and deemed ineligible, though contractors need not achieve a perfect score of 110 if they maintain a documented Plan of Action and Milestones addressing missing controls. The CAGE code requirement applies only to facilities that will store, process, or transmit Controlled Unclassified Information (CUI); subcontractor facilities outside PWS Sections 7.5 and Attachment 6 are exempt. The Government confirmed the correct solicitation number is N6264926QE025 and committed to revising all referenced documents accordingly. Solicitation Attachment (B), the Technical Information Sheet, was revised to include a requirement for offerors to demonstrate treatment capacity of 15,000 gallons per hour or higher for common evaluation basis. Reference documents (a) through (f) cited in PWS Section 2.1 are now included as solicitation attachments to ensure all offerors access identical information, and the COMUSFJ Memorandum of 29 May 2020 is confirmed as the intended reference for effluent limits. Regarding operational risks, the Government established that no target or maximum period will be provided for discharge approval timelines; contractors must factor this financial risk into firm-fixed-price quotations for CLIN x001, and delays in Government discharge approval are confirmed as excusable delays, with contractors authorized to transfer treated wastewater to other barges or tanks and required to coordinate with the Government Technical Point of Contact if capacity constraints arise.

Amendment 0003

Question 18 (Reference: RFQ Section M, Note 1 (as amended); Amendment 0002, Answer 09-b; DFARS 252.204- 7019(b), (c), (d); DFARS 204.7303(b))

Section M, Note 1, as inserted by Amendment 0001, provides that an Offeror must have a current NIST SP 800-171 DoD Assessment score posted in SPRS prior to the closing date of this solicitation, and that an Offeror without such a score will be ineligible for award.

Answer 09-b, reissued without change in Amendment 0002, states: “Offerors must have an active NIST SP 800-171 assessment score posted in SPRS prior to contract award.” The two provisions therefore state two different deadlines.

DFARS 252.204-7019(b) makes the requirement a condition for being “considered for award,” and DFARS 204.7303(b) directs the Contracting Officer to verify the posted summary level score prior to “(1) Awarding a contract, task order, or delivery order.” DFARS 252.204-7019(d) further provides that “scores for all assessments will be posted 30 days post-assessment in SPRS.”

Because the requirement was first announced by Amendment 0001 on 29 July 2026, the closing date is 17 August 2026, (interval of 19 days), and the posting interval in DFARS 252.204-7019(d) is 30-days, an Offeror that commenced its Basic Assessment on the date the requirement was first announced could not have a summary level score visible in SPRS by the closing date.

Please confirm:

(18-a) whether the timing is what is stated in Answer 09-b and DFARS 204.7303(b) — posting prior to award — and whether Section M, Note 1 will be corrected accordingly. or

(18-b) whether the Government adjust the closing date so that the period between announcement and clarification of the requirement and the closing date is consistent with the 30-day posting interval prescribed by DFARS 252.204-7019(d).

Answer 18 (18-a) FAR provision 52.212-2 A Note 1 is revised.

(18-b) Requires a score posted in SPRS prior to contract award.

Note 1 (Revised): The Government will evaluate the Offeror's compliance with DFARS 252.204-7012, DFARS 252.204-7019, and NIST SP 800-171 on an acceptable/unacceptable (Go/No-Go) basis.

A prospective vendor must have a current (not older than three years) NIST SP 800-171 DoD Assessment score posted in the Supplier Performance Risk System (SPRS) at the time the Government is prepared to make an award.

To be considered eligible for award, the vendor must have a qualifying score posted in SPRS prior to contract award. A vendor that does not have an active SPRS score posted at the time of the award decision, or has a score that does not cover the relevant CAGE code(s) for the facilities performing the CUI-related work, will be rated 'No-Go' and will be ineligible for award.

A contractor does not need a perfect score of 110 to be awarded the contract. They can have a lower score (even a negative score, as the scale ranges from -203 to +110) as long as they have a documented Plan of Action and Milestones (POA&M) in place to address the missing controls.

Question 19 (Reference: RFQ Section M, Note 1; Section L 1.0(8)(xii); PWS 7.5 and PWS Atch (6); Amendment 0002, Answer 12)

Section M, Note 1 provides that a score “that does not cover the relevant CAGE codes for the facilities performing the work” will be rated “No-Go,” and Section L 1.0(8)(xii) requires the Offeror to identify those CAGE code(s).

Local subcontractors are typically not DoD contractors and do not hold a CAGE/NCAGE code.

Please confirm whether “the facilities performing the work” means only those facilities that will store, process, or transmit the CUI (PWS 7.5) and specifically the segmented enclave that handles CUI (PWS Attachment (6)), rather than every subcontractor facility performing any portion of the PWS;

Answer 19 The Government confirms that 'the facilities performing the work' under Section M, Note 1, and Section L 1.0(8)(xii) refers strictly to those facilities (whether Prime or Subcontractor) that will store, process, or transmit Controlled Unclassified Information (CUI) in support of this contract.

Subcontractor facilities that will not handle, store, or transmit CUI, and whose performance is entirely outside the scope of PWS 7.5 and PWS Attachment 6, are not required to hold a CAGE/NCAGE code or be covered by an SPRS NIST SP 800-171 assessment score.

However, any subcontractor facility that will process, store, or transmit CUI must possess a valid CAGE code and have a current NIST SP 800-171 assessment score posted in SPRS prior to award.

The prime contractor is responsible for ensuring that any subcontractor handling CUI meets these requirements.

Question 20 (Reference: RFQ Section L 1.0(8)(i); Soli Atch (B), Technical Information Sheet; PWS Atch (6))

The solicitation number is shown as N6264926QE025. However:

- Section L 1.0(8)(i) requires submission of “SF 1449 for Solicitation No. N6824626QE025”;

- the header of Solicitation Attachment (B), Technical Information Sheet, reads “Solicitation:

N6824626QE025”; and

- PWS Attachment (6) reads “Solicitation Number: N6264925QE0025.”

Please confirm the correct solicitation number and issue corrected versions of Section L 1.0(8)(i), Solicitation Attachment (B), and PWS Attachment (6).

Answer 20 Confirmed. The correct solicitation number is N6264926QE025. All referenced documents, including Section L 1.0(8)(i), Solicitation Attachment (B), and PWS Attachment (6), have been corrected to reflect this number.

Question 21 (Reference: Soli Atch (B), item 1; RFQ Section M, C. Evaluation of Technical Quotation (b); PWS 4.1.2)

Technical evaluation factor (b) requires the Offeror to demonstrate the minimums set out in PWS 4.1.2.

Solicitation Attachment (B), item 1 does not address the treatment capacity of 15,000 gallons or higher per hour stated in PWS 4.1.2 and in Section M, factor (b)(iii).

Please confirm: whether Attachment (B) will be revised to capture and treatment capacity, so that all quotations are evaluated on a common basis under factor (b).

Answer 21 Confirmed. Solicitation Attachment (B), Technical Information Sheet, has been revised to include the requirement for offerors to demonstrate a treatment capacity of 15,000 gallons per hour or higher, ensuring all quotations are evaluated on this common basis.

Question 22 (Reference: PWS 2.1; Amendment 0002, Answers 03-a and 03-c; RFQ Section L 1.0(9); PWS 4.5.3.b)

Answer 03-a states that the PWS reference documents (a) through (f) “will be provided upon request to the Contracting Point of Contact (POC).” The COMUSFJ memorandum of 29 May 2020 cited in PWS 4.5.3.b establishes the below-50-parts-per-trillion combined PFOS/PFOA effluent limit that directly drives treatment cost, and CFASINST 5090.5 and the OASD memorandum of 01 May 2024 affect compliance scope.

(22-a) To ensure all quotations are prepared on a common basis, please post References (a) through (f) as solicitation attachments available to all Offerors, rather than furnishing them on individual request.

(22-b) Because Answer 03 as reissued in Amendment 0002 responds to sub-parts (03-a) and (03-c), but sub-part (03-b) is not addressed, please: confirm whether the reference cited in PWS 4.5.3.b for the USFJ effluent limit should be PWS 2.1 Reference (c), the COMUSFJ memorandum of 29 May 2020.

Answer 22 (22-a) To ensure all offerors have access to the same information, PWS reference documents (a) through (f) are included as attachments to this amendment.

(22-b) (b) Confirmed. The intended reference is PWS 2.1 Reference (c), COMUFJ Memo of 29 May 20.

PWS was updated in “20260729”.

Question 23 (Reference: Amendment 0002, Answers 02-b, 11-a, 11-b; PWS 4.1.2; PWS 4.5.3.d; CLIN x001)

Answer 02-b states that idle barge days spent awaiting laboratory results are not billable under CLIN x001.

Answer 11-a states that discharge approval is granted only after the Government has received and reviewed passing test results, and Answer 11-b states that a specific Government review timeframe is not guaranteed.

In combination, the contractor must incur the cost of holding treated wastewater for a period it can neither control nor bill, and the volume so held is not counted in the 2,000,000 gallon holding requirement in PWS

4.1.2 or the obligation to accept 50,000 gallons per job per day. Amendment 0002, Answer 14, places this risk entirely on the Offeror under the firm-fixed-price structure.

Please confirm:

(23-a) whether the Government will establish a target or maximum period between its receipt of passing test results and issuance of discharge approval under PWS 4.5.3.d;

(23-b) if no such period is established, the number of holding days per sampling event that Offerors should assume for the Government discharge approval response in a common pricing basis, so that this capacity risk is priced consistently into the CLIN x001 unit rate; and

(23-c) whether a delay in the Government’s issuance of discharge approval that prevents the contractor from accepting 50,000 gallons per job per day constitutes an excusable delay, not liable under the QASP.

Answer 23 (23-a) No target or maximum period is provided.

(23-b) No assumed number of holding days will be provided. Offerors must factor the financial risk of potential Government review timelines into their proposed firm-fixed-price for CLIN x001.

(23-c) Confirmed. The Government monitors the contractor’s remaining holding capacity by reviewing the submitted Form-N Weekly Contractor’s Barge Report. Pursuant to PWS paragraph 4.5.2.a, the contractor has the authority to transfer treated wastewater to other barges or tanks to conduct sampling, testing, and effluent analysis. If the contractor anticipates capacity constraints due to pending approvals, the contractor shall immediately notify and consult with the Government TPOC to coordinate operational adjustments.
