4.3 PRE-PROPOSAL INQUIRIES (PPIs):
All inquiries regarding the Request for Proposal shall be submitted electronically to Brittany Briggs by e-mail at brittany.d.briggs2.civ@us.navy.mil AND Kathleen Delashmitt at kathleen.a.delashmitt.civ@us.navy.mil. Offerors are requested to use the Pre-Proposal Inquiries Submittal Form (Attachment A). Responses will be published as an amendment to the solicitation.
The Government does not intend to respond to any pre-proposal inquiries submitted after June 5, 2025.
Responses to PPIs:
51. Inquiry: According to the four (4) Statements of Special Inspections, the SIOR is required ONLY for the Earth Covered Magazine. The SIOR is NOT required for the AROS, Recycling Center nor Forklift Charging Station.
The Schedule of Special Inspections, however, does not specify if the tasks listed are applicable to all the four locations, or only the Earth Covered Magazine (where the SIOR is required).
Please, clarify.
Response: The Schedule of Special Inspections is applicable to all buildings/ locations in the project.
52. Inquiry: According to the paragraph 4.2. Proposal Submission Instructions, the proposal must be delivery in Naval Facilities Engineering Systems Command, Atlantic, Norfolk, VA 23508-1278. Hand delivery or mailed via postal services take up time for the proposal preparation. We kindly request the Government to considerer the option of electronic submission proposal by email or Procurement Integrated Enterprise Environment (PIEE).
Response: Proposal submission instructions are unchanged.
53. Inquiry: Section 02 82 00 ASBESTOS REMEDIATION is included in the project SPECS. However, we find no reference in the contract drawings nor the project documentation about presence of asbestos or potential areas/existing materials containing asbestos.
Is there any report available providing more information about this topic? If not, can you please details the assumptions that we should implement for bidding purposes?
Response: A site investigation conducted in April 2023 did not detect the presence of asbestos in the collected samples. However, please refer to Specification 01 35 26 Section 3.1.4 for instructions regarding encountering unforeseen hazardous materials.
54. Inquiry: Division 03 CONCRETE contains two sections. The first one (03 3 00 CAST-IN-PLACE CONCRETE) is adapted to EU/Spanish standards. The second one (03 30 00.02 CAST-IN-PLACE CONCRETE MAGAZINES) is mostly referred to american standards.
Please, confirm that European/Spanish standards are acceptable under Division 03 Concrete.
Response: Specification 03 30 00.02 applies to magazines only, and US reinforcing and properties are required. Under this specification, quality control may be per European standards. Specification 03 30 00 applies to every other structure in the project, and European standards are acceptable.
55. Inquiry: According to drawing S-701, in the building there is a door type 'A'. However, the contractor could not find the located and use of this door in the documentation provided. Please clarify the location and use of the door.
Response: Please see replacement drawings issued via attachment to Amendment 0003.
56. Inquiry: For greater speed, could you consider submitting the documentation via email instead of messaging?
Response: No, email submission is not supported. Proposal submission instructions are unchanged.
57. Inquiry: Qualifications. There are some qualifications related to the Fire Protection and Electrical sections that can only be obtained in the USA. QUESTION: Would a similar or equivalent European Host Nation certification be acceptable as an alternative? - SECTION 21 13 13. 1.4.2 The sprinkler system designer must be certified as a Level III Technician by National Institute for Certification in Engineering Technologies (NICET) in the Water-Based Systems Layout subfield of Fire Protection Engineering Technology in accordance with NICET 1014-7, or equivalent. Since the design will be reviewed by a Fire Protection Engineer, please confirm if the designer can hold a similar title in the Host Nation and/or demonstrate years of experience.
Response: Per the specification, an equivalent certification is acceptable.
58. Inquiry: Qualifications. There are some qualifications related to the Fire Protection and Electrical sections that can only be obtained in the USA. QUESTION: Would a similar or equivalent European Host Nation certification be acceptable as an alternative? - SECTION 28 31 70 1.8.2.1 The fire alarm system designer must be certified as a Level III (minimum) Technician by National Institute for Certification in Engineering Technologies (NICET) in the Fire Alarm Systems subfield of Fire Protection Engineering Technology or meet the qualifications for a QFPE. Since the design will be reviewed by a Fire Protection Engineer, please confirm if the designer can hold a similar title in the Host Nation and/or demonstrate years of experience.
Response: Per the specification, an equivalent certification is acceptable.
59. Inquiry: The Note D-1 indicate that no demolition on this Sheet, but Is it possible that there are several tree to remove? Please confirm that.
Response: Please see revised drawing provided via Amendment 0006.
60. Inquiry: Paragraph 4.2 PROPOSAL SUBMISSION INSTRUCTIONS mentions that PROPOSALS
MAY NOT BE HAND DELIVERED. ALL PROPOSALS MUST BE MAILED VIA POSTAL
SERVICES OR COMMERCIAL COURIERS SUCH AS FEDEX OR UPS.
We kindly request to Government Representative to reconsider this instruction in order to authorize to offerors to emailing the proposal. Emailing bid proposal guarantees that all documents are delivered on time before due date.
61. Inquiry: We are greatly interested to bid on the subject project, we would like to address our concern of unduly restrictive requirements as below:
Reference to evaluation criteria in pages 17 and 18 of 24 of the solicitation, the RFP requires that the bidder to be registered and classified by the MOF in Spain at the time of submitting a bid. :
1- This is unduly restrictive as the requirements would result in substantial resources, investment and efforts without a guarantee of award.
2- This condition violates the principle of fair full and open competition whereas the RFP makes only bidders with existing registration and classification are eligible for award.
3- The requirement is unreasonable whereas the registration and classification may take from 90 to 160 days considering that 1322 days of the contract duration is more than enough to register and perform in compliance with Spanish laws. Taking in consideration the long lead items supply period of approximately 300-500 days. So the contractor can still register and almost complete the superstructures prior to the arrival of the long lead items whiles the site utilities and development works can be concurrent with the structure/s construction with no impact to the critical path within the 1322 days.
4- The certification and classification is part of performance requirements rather than bidding whereas the cost of such registration and certification is not reimbursed if the bidder is unsuccessful. This is unfair competition provided that the local and other bidders with existing certification would not bear this upfront cost. This is unfair competition criteria. Additionally, this requirement favors local contractors or contractors with existing registration over qualified contractors that are not yet registered and willing to expand for overseas business. Such requirements will consistently favor the growth of those contractors over bringing new qualified contractors to the international growth.
Response: The U.S. Navy is required to comply with instructions implementing international agreements. Therefore, the requirement will remain unchanged.
62. Inquiry: The design level for the recycling center is +27,40m, which is significatively higher than the existing terrain (+25,75m), so backfilling would be necessary to reach those elevations. Could you please confirm this point?
As for the Forklift Charging building, ground levels are not available. Could you provide them and together with the tests conducted in that area?
Response: Refer to grading sheets for existing surface grades and contours. Design finish floor elevations are as indicated on the drawings. Earthwork fill/cuts will be required as necessary to reach finish subgrade elevations.
Boring C-5 is the closest sampling point to Forklift Charging building, refer to drawings B-101 and B-
603. Boring records provide surface elevations at the boring location, existing and design spot elevations are provided on the grading sheets.
63. Inquiry: In Note 3 of plan S002A, it is stated that “ground improvement is necessary to provide adequate support for the foundations and concrete slab. The ground improvement shall consist of excavation of the existing clay subsoil within the building limits, extending 1.5 m horizontally beyond the exterior perimeter walls. The fill shall be done with mass concrete.”
However, in Zone 7 of plan S101A, it is indicated that the minimum depth of improvement is 1.2 m below the finished ground level, and the slab is to be backfilled with selected material.
Yet, in Note 8 of the same plan, it is stated that the foundation for walls and columns shall be improved using mass concrete.
However, in plan S502A, it is indicated that the concrete fill must reach at least 3 m below the top face of the slab.
Clarification is requested.
Response: Refer to Detail C3/S502A. Undercut to start minimum 1.2m below FFE and have a minimum overall depth of 3m below FFE. The undercut must extend 1.5m beyond perimeter wall. Backfill must be lean concrete with minimum compressive stress of 3.5MPa.
64. Inquiry: This Note 7: Civil Earthworks Notes- Construction Phasing Requirements: indicates that the
Magazines must be built before any other element for the project. Does this mean that AROS and the Recycling Center cannot be started before the Magazines are finished?
Response: Note 7 on drawing C-001 refers to the magazine area only.
65. Inquiry: “This Note 7: Civil Earthworks Notes-indicates that magazines must be phased such that magazine buildings 3401 and 3400 are constructed prior to magazines buildings 3399 and 3398. This note 7 conflicts with base bid CLIN1A and CLIN1B, and options #1 and #2. Please, clarify.
Response: Note 7 on drawing C-001 applies only to work on the awarded contract.
66. Inquiry: Please, clarify the following statement: "the placement of concrete pavements for the magazine structures must be delayed a minimum 90 calendar days after the successful placement and compaction of the earthen embankment and earth cover for the magazines structures.”
Response: “[T]he placement of concrete pavements for the magazine structures” refers to the concrete apron in front of the referenced magazine.
67. Inquiry: Solicitation Submittal Requirements: Is it acceptable to provide references for projects that are currently under construction but substantially completed?
Response: Please propose in accordance with the Solicitation. As stated under Section 00 21 00 Factor 1
– Experience, “Projects submitted for the Offeror shall be completed within the past ten (10) years of the date of issuance of this RFP.”
68. Inquiry: Solicitation Submittal Requirements: Would industrial buildings with cast-in-place reinforced concrete foundations and metal or prefabricated structures be considered valid?
Response: Please refer to solicitation section 00 21 00, 3.2.
69. Inquiry: Solicitation Submittal Requirements: Under these same conditions, would references for non-industrial buildings with cast-in-place reinforced concrete structures also be acceptable?
Response:
