About this file
This is Amendment 0002 to solicitation N6247024R0072 for a Single Award Environmental Remedial Action Contract issued by NAVFAC Atlantic. The amendment addresses questions received and makes several key changes, including updating the small business size standard from $25,000,000 to 1,000 employees under NAICS code 562910.
The amendment clarifies that rates in Attachment JL.2 are to be unburdened (no indirect costs), expedited actions include time-critical actions with response times over 72 hours, and the three pages of Notes on JL.12 will not count toward page limitations. It confirms that submitting CPARs for PMO on Navy IDIQ contracts is acceptable for Factor 3 Past Performance. The government declined a request to change the procurement from single award to multiple award task order contract (MATOC), maintaining the current strategy for this small business set-aside with a maximum value of $95M over a 5-year period. The solicitation closing date remains unchanged.

AMENDMENT 0002
Amendment 0002
QUESTION 17: Per the solicitation notice and the SBA’s table of small business size standards, please change the small business size standard to 1,000 employees instead of $25,000,000 in Section K 52.204-8 ANNUAL
REPRESENTATIONS AND CERTIFICATIONS.
ANSWER 17: Section K 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATION is changed from $25,000,000 to 1,000 employees.
QUESTION 18: Please confirm that the rates in Attachment JL.2 are to be unburdened (i.e., no indirect costs applied to the base labor rate).
ANSWER 18: These rates are to be unburdened.
QUESTION 19: Attachment JL.12 Corporate Experience Form, Table 1 requests the number of services for “Expedited / Emergency Response Actions.” Section C defines fast action/emergency response as having personnel at the identified location within 24 to 72 hours of notification, but doesn’t define “Expedited” response actions.
Please confirm that Expedited actions include time-critical actions that had response times more than 72 hours of notification.
ANSWER 19: Yes, expedited actions include time-critical actions that have response times more than 72 hours of notification.
QUESTION 20: Amendment 1 answer to Question 7 states that the “Notes for Completing JL.X” page may not be deleted. Please confirm that this page is excluded from the page limitation in Factor 1. Since there are three Attachment JL.12 forms to be submitted, three pages of our 40-page limitation would be taken by this instructions page if it is not excluded.
ANSWER 20: The three pages of Notes on JL.12 will not count towards the page limitation.
QUESTION 21: Factor 3 Past Performance (Page 130 of the solicitation) requests a completed CPAR evaluation for an IDIQ contract. Please confirm that submitting CPARs for the PMO for Navy IDIQ contracts is acceptable.
ANSWER 21: This is acceptable.
QUESTION 22: How can a single award of a $95M contract potentially for a 5-year contract period be promoting Small Business concerns?
ANSWER 22: The Single Award Environmental Remedial Action Contract is a small business set-aside.
QUESTION 23: Does this type of contract mechanism ensure that the Navy is getting best value on a Task Order basis for projects bid/awarded during the life of this contract? We request the Navy to consider changing this opportunity to a multiple award task order contract (MATOC) to allow for more participation by small business. Based upon the Navy's response on the Sources Sought, there are multiple qualified small businesses that responded to this request that could execute this contract and provide cost-competitive services for the duration of the contract.
ANSWER 23: The Government has considered the question and determined that the procurement strategy will remain unchanged.
