Block 14. DESCRIPTION OF AMENDMENT (cont.)
A. The following provides the Government’s responses to preaward inquiries:

Page Section Para.
QUESTION GOVERNMENT
RESPONSE
There are 4 buildings that may be in construction simultaneously. Is there to be a QC and SSHO on each building or can one SSHO and one QC be allowed to work on all 4 buildings?
One person may fill the roles of Superintendent and Safety and Health Officer (SSHO), if duly qualified for both positions as defined in the project specification.
However, the Quality Control (QC) Manager must be a stand-alone position. Where construction is actively being performed on a building site, the contractor shall provide a Superintendent / SSHO and QC Manager at each site.
RFP Letter The current liquidated damages value of $13,950/calendar day is significantly higher than those we typically encounter on recent Government projects. The perceived risk/cost of the liquidated damages affects our ability to engage multiple qualified subcontractors, whether small business or large business.
Additionally, costs for this perceived risk from subcontractors that are willing to submit proposals, may be included as contingency costs in their final pricing. In order to facilitate more competitive pricing, please consider reducing the liquidated damages amounts.
Liquidated damages are updated to $2,156/calendar day.
B. Replace the language in the RFP under “Liquidated Damages” to state the following:
“In accordance with FAR 52.211-12 Liquidated Damages, if the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $2,156/calendar day for each calendar day of delay until the work is completed or accepted.”
C. All other contract terms and conditions remain unchanged.
