Hours

All MEC work shall be performed during daylight hours with suitable visibility. UXO personnel shall perform MEC-related tasks no more than 10 hours per day for a maximum of 40 hours per week. Two consecutive weeks shall be separated by 48 hours of rest.

2. PART 2 PRODUCTS

2.1. Security

The Contractor is responsible for providing physical security to prevent the theft of explosives. The degree of physical security shall comply with installation requirements.

3. PART 3 EXECUTION

3.1. CONSTRUCTION SUPPORT

The Contractor shall provide construction support or standby support IAW requirements of Engineer Pamphlet (EP) 75-1-2. Construction support is inspection of suspect MEC found on the site during construction activities, disposal of confirmed MEC, oversight of construction operations to identify potential MEC risks, investigative clearance of areas not included that are found to pose a moderate to high risk of encountering MEC, down hole monitoring, and anomaly avoidance.

3.1.1. MEC Avoidance for Non-Intrusive Activities

The Contractor shall utilize UXO qualified personnel to escort all survey crews, brush-cutting crews, geotechnical crews and similar crews as they access the construction area to perform the work required under this contract. The UXO qualified personnel shall, for this type of work, provide UXO avoidance support. UXO avoidance consists of on-site UXO-qualified identifying safe work locations and safe work practices within areas potentially containing hazardous surface or subsurface MEC. If, after a site inspection of the Contractor's UXO qualified personnel determine that MEC avoidance support is not necessary in a specific area, this area can be clearly marked by the Contractor and MEC avoidance support within that area terminated.

3.1.2. MEC avoidance for Incidental Intrusive Activities

For all the contractor's activities that require incidental, shallow excavation, including but not limited to:placing survey stakes into the ground, setting fence and sign posts, pile driving, trenching, or setting silt fences, the Contractor shall first investigate the specific location to be disturbed with an approved magnetometer. If an apparent metallic anomaly is detected by the magnetometer, a different, nearby location free of apparent metallic anomalies shall be selected and designated. The incidental shallow excavation shall be moved to that location.

3.1.3. Vehicular Traffic Areas

UXO avoidance techniques shall be employed in establishing vehicle access throughout MEC contaminated areas.

3.2. TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

Hot or cold weather does not constitute severe weather and is not subject to this clause nor does it justify time extension. This provision specifies the procedure for determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be unusually severe, i.e. more severe than the adverse weather anticipated for the project during the given month.

b. The unusually severe weather must actually cause a delay to the completion of the project.

The delay must be beyond the control and without the fault or negligence of the Contractor.

Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor shall record on the daily Contractor Quality Control (CQC) report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for fifty percent (50%) or more of the Contractor's scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month) and be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification to the Contract.

3.3. AREAS CLEARED OF MEC

The Contractor shall mark the limits of MEC areas cleared for construction operations as required for construction safety purposes.

3.3.1. Identification of Responsible Personnel

Each report shall identify the specific members and title of the Contractor's staff and subcontractors that had significant and specific input into the preparation or review of the report.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.

Union Identifiers

An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination.

The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.

Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rates.

0000/9999: weighted union wage rates will be published annually each January.

Non-Union Identifiers

Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA2004-007

5/13/2010. SU indicates the rates are not union majority rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.

Survey wage rates will remain in effect and will not change until a new survey is conducted.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

7. The previous Small Whorled Pogonia Survey according to the 24 Jul 12 Memorandum for the

Record in the Environmental Assessment notes the survey area only extended approximately 50 feet into the tree line from the existing roadway. However the preliminary engineering plans note several locations where slope grading and SWM facilities exceed the 50’ limit. Additionally the 35% plans do not appear to allow sufficient disturbance to address contraction scour and countermeasures at culvert extension locations.

a) Please verify the new survey limit will extend at a minimum to the proposed cut slopes, utility relocations, and facilities noted on the 35% PE plans or better.

RESPONSE: Yes, the new survey will cover these areas if it is deemed necessary by Quantico’s environmental branch (NREAB).

b) If not is the contractor responsible for additional survey areas?

RESPONSE: No, the contractor is not responsible to perform the survey.

8. In several locations it is noted that grading work cannot begin without a UXO Technician III in attendance. Please clarify if the DB Contractor is to provide the UXO Technician or if the government will provide one.

RESPONSE: See response to RFI 6, e in this amendment.

9. Section 01 35 26.05 (1.5.1) notes the contractor shall bear all costs associated with the UXO briefing and the cost of the UXO Tech III during all excavations. If the UXO technician is a military employee, please provide costs per hour for this personnel.

10. Attachment 15 contained an Environmental Assessment however we could not locate a Finding of No Significant Impact, or documentation regarding NCPC coordination status.

a) Please clarify the DB contractor responsibilities in regards to NEPA documentation and

NCPC coordination.

RESPONSE: The NEPA documentation has been completed. NCPC requirements stated in the RFP, Part 2, Section 01 33 10.05 20, paragraphs 1.8.4 thru 1.8.4.3 which state the Design Build Contractor’s responsibilities for NCPC.

b) Will the DB be responsible for obtaining a FONSI for the project?

RESPONSE: No, the NEPA documentation has been completed.

c) Will the DB be responsible for presenting the project to the NCPC or was that completed during the EA preparation?

RESPONSE: Yes, per the RFP, Part 2, Section 01 33 10.05 20, paragraph 1.8.4 Historic Preservation and Planning Commission Submission.

11. In the Environmental Assessment Section 4.2 Water Resources it is noted that the existing pipes will accommodate the widening of Russell Road and replacements are not expected.

a) Were hydrologic studies conducted to make this determination? If so please provide them.

RESPONSE: Preliminary investigations indicate that the existing culverts were adequate; however, the Designer of Record (DOR) is required to perform their own calculations based on the final road design.

b) No changes were noted in the PE drawings so for pricing purposes, should the contractor assume this statement is true and only price the extensions.

RESPONSE: The RFP drawings are concept drawings, the DOR is required to deliver a finished product per the requirements of the RFP.

12. Sections 01 33 10.05 20 and 1 33 10.05 20 (1.8.4 & 1.8.4.2)) notes the DB is to prepare the presentation materials required to obtain approval from the Historic Preservation and Planning Commissions having jurisdiction over the site, then goes on to note that submission will address the NCPC the CFA and the SHPO requirements as well noting the Contractor is to prepare a submittal package to present the project at a public meeting.

a) As no buildings are proposed for the project please verify this requirement is to be included in the Contractors bid.

RESPONSE: NCPC requirements stated in the RFP, Part 2, Section 01 33 10.05 20, paragraphs 1.8.4 thru 1.8.4.3 and are required as part of the Contractor’s bid regardless if no buildings are part of the contract. CFA does not apply to this project and SHPO has been completed.

b) If so, has any prior submission been conducted to these agencies for the project and provide prior submittal materials and prior comments from these agencies.

RESPONSE: No prior submissions have been conducted.

c) As this section notes a 3-6 month time frame for this coordination, is the contractor to include this coordination in the project schedule?

RESPONSE: Yes, the 3-6 month time frame shall be included in the project schedule.

13. Section 01 33 10.05 20 Page 9 (1.8.4.1) notes the DB is to prepare a submission to the SHPO, and that the action proponent files a NEPA compliance checklist plus a copy of the Work Request to the CRM and the CRM determines if the project will effect historic properties.

a) Given this project has been coordinated with the SHPO for the two archaeological sites, and an EA has been completed. Please clarify if SHPO and NCPC coordination and submittals are required in addition to those items noted in the MOA.

RESPONSE: Submission to NCPC is still required for this project.

b) Has a final data recovery plan been approved by the SHPO or is that to be a requirement of the DB contractor?

RESPONSE: 10/11/2013 received approval of the data management summary from VA DHR. Final report will be available Summer 2014.

c) If one has been prepared please provide a copy or a schedule for completion to assure our schedule incorporates the data recovery.

RESPONSE: The Data Management Summary Report will be provided to the successful offeror post award. The Design Builder is responsible to provide an archeological monitor as stated in RFI 6, a response in this amendment.

14. Part 4 Section G30 page 24 (1.1) Provide an oil /water separator to remove free oil and to provide grit protection upstream of oil/water separator.

Please verify this requirement is applicable to Phase 3.

RESPONSE: An oil / water separator is not required on this project. See stormwater requirements in Part 3.

15. Was a jurisdictional determination (JD) or a preliminary JD obtained for the delineation conducted? If so, please provide a copy.

RESPONSE: No, a JD process was initiated but the report was not obtained.

A Phase 3 report was submitted to the Army Corps of Engineers and a final determination from the USACE is pending.

16. It is noted that wetland mitigation through mitigation bank purchases is required for the project

a) There appears to be tidal wetland impacts and a quick search of the RIBITS database note no available tidal wetland credits, were tidal credits reserved for this project?

RESPONSE: Wetland credits were not obtained; the Design Build Team is required to obtain the required credits post award.

b) Are alternative forms of mitigation allowed?

RESPONSE: No, the Design Build Team is required to purchase credits.

c) Who is responsible for obtaining the mitigation and making payment for the wetland mitigation?

RESPONSE: As part of the overall project cost, the Design Build Team is required to obtain mitigation and make payment for the wetland mitigation. Wetland credits can be purchased from the following:

http://www.wetlandstudies.com/services/mitigation-banking.html

17. Given the project environmental constraints and narrow corridor, has NAVFAC identified any locations for potential contractor laydown areas, parking or offices?

RESPONSE: To be determined post award.

18. Please note given the recent regulatory agency changes, the E&S control Guidance appears to be outdated with regards to VSMP application fees, personnel and submittal requirements. Please verify this is the case for this project.

RESPONSE: Refer to PART 3 - CHAPTER 2 - Page 2 - 2.3.2 Storm Water Management (Low Impact Development).

The contractor is required to “Comply with applicable Virginia State SWM requirements.”

19. Please provide any existing utility agreements that the Base may have with the Private Utility

Companies/Operators located through the corridor.

RESPONSE: The following are the utility companies through the corridor: Verizon, Comcast, Columbia Gas, Base Water, Base Sewer, Base Electric, and G6.

20. The RFP documents depict proposed alignment and pathways for ductbanks and utility relocation. Have these locations already been coordinated with the Utility Operators?

RESPONSE: No. The locations shown on the plans are proposed locations; all coordination must be between the Design Build Team and the utility operators.

21. Contrary to Part 3-Chapter 1 - Page 1 Paragraph 5, the RFP documents depict a new communication relocation duct bank on the South Side of Russell Rd. Is this correct?

RESPONSE: The majority of the utilities will be on the North side of the road; however, utilities that exist on the southern part of the road will need to be relocated as indicated on the plans. The contractor is required to perform a utility survey as stated in the RFP Part 3, ESR G10 Site Preparation. The contractor is also required to perform a topographic survey.

22. Please provide utility relocation engineering plans or as-built documents for the Russell Road Phase 2 Project that the Phase 3 must tie-in and meet with.

RESPONSE: This information will not be available, prior to award of Phase III. The Government intends to provide when available, but this will not be a reason to delay the design or the project. In the event the Government does not have the necessary information when needed, or if the as-builts are deficient, incorrect, or missing any information, the Contractor for Phase 3 will coordinate with the contractor on Phase 2, or perform test pitting to verify actual location of any/all utilities in the field.

23. If in order to obtain the required Virginia Health Department (VDH) plan approval for the water main relocation, information on the water demands and hydraulic capacity of the Base water system is required. Will this information be provided to VDH by the Owner and not be the responsibility of the Contractor to provide to VDH to VDH’s satisfaction?

RESPONSE: A VDH permit is not required since the Base owns the utility.

24. If the Virginia Department of Health determines that the existing water main line sizes to be relocated are undersized and need to be replaced with larger diameter piping will the Contractor be required to determine the larger pipe size required and construct the larger pipe size without reimbursement?

RESPONSE: Coordination with VDH is not required since the Base owns the utility.

25. If the Virginia Department of Environmental Quality determines that the existing water main line sizes to be relocated are undersized and need to be replaced with larger diameter piping will the Contractor be required to determine the larger pipe size required and construct the larger pipe size without reimbursement?

RESPONSE: Coordination with VDEQ is not required since the Base owns the domestic water utility. However, a VDEQ permit is required for storm water management, per the RFP, Part 3, Chapter 2, 2.3.2 Storm Water Management (Low Impact Development).

26. Will the Base have sufficient valving to allow the new water and force main pipe connections to be cut in without the need for wet tap tapping sleeves and valve connections? Can there be a short interruption is water service and sewage service and will the Base coordinate notifications and pump station shut downs to allow cut in of the new piping?

RESPONSE: The Contractor is required to maintain water and sewage service at all times, unless an outage permit is requested by the Contractor and approved by the Government in writing. Valving is present, but if a wet tap is acceptable and is a sensible solution, then it may be considered by the Government. However, it is subject to approval post award. The Contractor is responsible for all outage notifications; however, NAVFAC will assist if necessary.

27. Does the Contractor have to do hydrant tests for the Basis of Design report per the above UFC 3- 200-10N requirement?

RESPONSE: Yes, hydrant tests are required.

28. There is concerned about the safety of the transition areas for the reversible lanes. Generally speaking reversible lanes add a lane during particular times of day. This reversible lane appears to be a bit unique in that (as shown in the plans) it requires traffic in one direction exit from the lane in the same general area that traffic is entering the lane from the opposite direction. This looks feasible on 35% plans, but the actual implementation of this lane striping would put a lot of confusing lines on the road. Does the Contractor assume liability for accidents that occur when the reversible lane is in operation if the design plans have been approved by the reviewing agencies?

RESPONSE: The Contractor is responsible for traffic control during construction.

29. Phase 3 contains extensive conduit and cabling (and water pipe) work that MUST be coordinated with the conduit and cabling work being performed in Phase 2. Is the Phase 2 contractor doing anything to facilitate this coordination? (See sheet C4.06A)

RESPONSE: The phase 2 Contractor is required to end new work at the nearest Manhole or Junction Box. The Contractor is required to perform their own utility survey post award to verify location of all utilities prior to start of design.

30. Will alternatives to reinforced concrete retaining walls, as specified in the VDOT Manuals of the Structure and Bridge Division - Volume V Series, Part 11 Geotechnical Manual for Structures, be allowed?

RESPONSE: No, it is a requirement from the base that these walls be reinforced concrete.

31. The RFP included the Scope of Work for an Archaeology Data Recovery (Phase III) dated October 5, 2012. Is the Contractor provision of this work included in the RFP, or has this work already been completed? If so, what areas were targeted for Phase III, and are any reports available for review? Temporary construction outside of the Limits of Disturbance shown on the 35% plans may be required to construct the project. We would like to review any existing Phase III reports to determine if all necessary areas were targeted, or if additional recovery work is required.

RESPONSE: See response to RFIs 6 and 13.

32. Did the USACE confirm the wetland delineations?

RESPONSE: See responses to RFIs 15 and 16.

33. Can the inverts of the existing storm drain culverts be provided in order to confirm whether or not the elevations are adequate for draining the proposed dry swales?

RESPONSE: The Contractor is required to perform a survey after award to complete the final design. The existing dry swales are designed to drain as indicated on the plans. Refer to existing conditions drawing # V1.06 for existing invert elevations.

34. Schedule Concern – Project Program Part 3 – Chapter 1 (page 2) states the Small Whorled

Pogonia (SWP) survey will be contracted by NAVFAC under a separate work order. The SWP survey is time-of-year restricted to 6/1 through 7/20. Please confirm this survey is already scheduled to occur in 2014 to avoid the potential for impacting the 18-month Russell Road DB schedule.

RESPONSE: See response to RFI 7, a in this amendment. If the survey is deemed necessary, it will occur in 2014.
