The following have been added by full text:
DESCRIPTION OF AMENDMENT
SOLICITATION N40080-14-R-8600, P572 INFRASTRUCTURE WIDEN RUSSELL ROAD, MARINE
CORPS BASE, QUANTICO, VA
The purpose of this amendment is to accomplish the following:
A. Incorporate and clarify the following:
1. Incorporate Clause 52.219-6 Notice of Total Small Business Set-Aside. and 52.219-14
Limitations on Subcontracting, in Section 00700 of the Solicitation.
2. Revised Clause 252.232-7006 Wide Area WorkFlow Payment Instructions is incorporated, in Section 00700 of the Solicitation.
3. The RFP closing date is 12/18/2013, 2:00 PM, as stated on page 8 of 40 of the Solicitation.
The closing date (12/19/2013) reflected on the Federal Business Opportunities electronic site at www.fbo.gov is incorrect.
4. On page 5 of 40, incorporate the following statement:
“(8) The Government reserves the right to exercise Option Item 1 (CLIN 0003) and Option Item 2 within 90 calendar days after contract award.”
5. On page 14 of 40, paragraph 5, “If the Offeror is a Joint Venture (JV)…”, is corrected to read:
“If the Offeror is a Joint Venture (JV), relevant project experience should be submitted as follows: one (1) relevant project for the JV Member that is the primary construction firm and one (1) relevant contract for the JV Member that is the primary design firm. JV Offerors are limited to a total of two (2) projects combined.”
6. On page 15 of 40, second paragraph “Offeror may provide… Factor 2, Experience.” Should read “Factor 2, Past Performance.
RESPOND PRE-PROPOSAL INQUIRIES
B. Respond to Pre-Proposal Inquiries (PPIs) as follows:
Question #1: Is this proposal a two-step proposal process?
Answer: This is a Two Phase Solicitation.
Question #2: If this is two parts, when will the short listed firms be notified?
Answer: Date to be determined.
Question #3: What is the anticipated Phase II due?
Answer: Date to be determined.
Question #4: Once Phase 2 is submitted how long until there is an award & what would be the anticipated notice to proceed date?
Answer: Date to be determined.
Question #5: Is there any chance the Phase I date will be pushed until after the holidays?
Answer: The closing date and time 12/18/2013, 2:00 PM will remain unchanged.
Question #6: Can you tell me the dollar range of this one?
Answer: Solicitation page 1 of 40 states the range of the Design-Build amount is between $10 to $15 million.
Question #7: At the bottom of Page 13 of 40 there are four (4) criteria listed for inclusion in the description of relevant project experience. Are these four (4) items meant to be “Either/Or” items, or are ALL four (4) items supposed to apply to the relevant projects that are submitted with a proposal?
Answer: All four (4) elements need to be met for a project to be considered relevant.
Question #8: Is there a bid bond that is required for the Phase I proposal submittal? If so, how much should be shown for the bond amount?
Answer: See in the solicitation Page 24 of 40, FAR Clause 5252.228-9302. Bid Bonds are not required in Phase I.
Question #9: Can the proposal include a cover and back, and will that count against the number of required pages? If a cover is allowed, can it contain the name of the project, picture(s), etc., as long as it does not include any write-up material(s)?
Answer: A cover and back can be included and it will not count against the number of required pages. A cover can contain the name of the project, picture(s), etc., as long as it does not include any information responding to the evaluation factors.
Question #10: I am trying to determine from the RFP whether our firm, a small business, can be prime on this project? Our proposed subcontractor, who would be doing the construction work is not a small business. Or does the 100% small business set aside need to correspond to the NAICS code of 237310? Must the small business be responsible for over 50% of the work? I don’t see any explicit provisions of this requirement in the RFP. Could the subcontractor post the required bonds or must this be done by the prime or even a third party?
Answers: The Small Business has to be the prime contractor. To determine Small Business size, please refer to the U.S. Small Business Administration table of Small Business Standards, under NAICS Code 237310. FAR 52.219-14 (c)(3) Limitation on Subcontracting (Nov 2011) incorporated to the Solicitation by amendment, clarifies the percentage of work to be performed the prime contractor. The prime contractor must provide the required bonds.
Question #11: The solicitation refers to “… station 79+00 to station 143+79 complete in accordance with the RFP specifications and drawings…” Where are the specifications and drawings that the solicitation is referring to? Are they available in CAD format?
Answer: The drawings and specifications for this project will not be available for Phase I. The drawings and specification will be available for Phase II.
Question #12: Page 14 of 40 in the RFP states “The attached Construction & Design Experience Project Data Sheet (Attachment A) is MANDADTORY … Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed two (2) single-sided pages (minimum 11 font).”
The provided Attachment “A” consist of 3 pages. Please revise RFP.
Answer: Revised Attachment A is provided with this amendment. Block #11, “Other Information” has been deleted.
Question #13: In regards to the above solicitation, can you provide the previous contract numbers/incumbent information since this project is the third of four projects? We would like to match up the follow-on to the previous project. Please let me know if you can provide this information?
Answer: That information is not available.
Question #14: When is the site visit for Solicitation Number: N4008014R8600?
Answer: See in the solicitation Page 7 of 40. The date and time for the site visit will be part of Phase II.
Question #15: I am looking at the solicitation on Fed Biz Ops for the P572 Road Widening project at Quantico and the announcement refers to plans being available for the project. Are these plans available for review during the proposal development phase?
Answer: The drawings and specifications for this project will not be available for Phase I. The drawings and specification will be available for Phase II.
Question #16: With regards to Section H. (a) 3, specifically “If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for a project completed by the Joint Venture entity. Offerors are still limited to a total of one (1) project combined.” May the Offeror submit a project completed by one of the members of the JV (primary construction firm) and a project by the primary design firm and still be in compliance/responsive to the solicitation. If so, what effect does the aforementioned cited paragraph have on the evaluation of the Offeror’s proposal?
Answer: Factor 1 has been updated in this amendment (see paragraph A.5.)
Question #17: For modification of proposal purposes, specifically modification of teaming and joint venture arrangements, when is the solicitation closing date and time; at the end of Phase I or Phase II?
Answer: Offerors are expected to submit phase I proposals by 18 December 2013, at 2:00 PM.
Phase I proposals may not be modified beyond this date and time.
Question #18: May the Offeror subcontract the design and/or other parts of the Work to a non-small business, and to what extent?
Answer: See response to Question #10.
Question #19: Please verify the correct response date for this solicitation:
12/19/2013 2:00 PM (per Original Synopsis “General Information” on fbo.gov site)
12/18/2013 2:00 PM (per RFP document on page 8)
Answer: The RFP closing date and time is 12/18/2013, 2:00 PM EST.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
