SECTION L – ADDITIONAL INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

I. GENERAL

This acquisition uses FAR Part 12 – Commercial Items supplemented with FAR Part 15.

This is a competitive acquisition for the award of a Firm-Fixed Price (FFP) contract for the demolition and disposal of the Dry Dock # 2 Complex at Portsmouth Naval Shipyard, Kittery, Maine. A contract will be awarded to the Offeror whos proposal represents the best value to the Government. This determination will be made based on a comparative assessment of proposals against all source selection criteria set forth in Section M of the solicitation.

All Non-Price Factors are of equal importance. All Non-Price Factors combined are significantly more important than price. The impact that price will have on the source selection decision will depend, in part, on the differences among the competing Offerors. The Government will not select an Offeror for award on the basis of a superior technical proposal without concern for the amount of its evaluated price.

The evaluation factors applicable to this procurement are:

FACTOR I : Technical Approach FACTOR II: Management Approach FACTOR III: Past Performance FACTOR IV: Small Business Participation Plan and Subcontracting Plan

FACTOR V: Total Evaluated Price

The Government intends to award a single firm-fixed price contract. Offerors shall submit sufficiently detailed and complete proposals, which demonstrate compliance and understanding of all solicitation requirements and shall contain only material directly related to this acquisition. Failure to comply with the RFP terms and conditions may result in the Government removing the Offeror from award consideration.

A. Questions from Offerors

All contractor questions concerning this solicitation shall be submitted to the Contract Specialist via email. Emails should be sent to: tana.anderson@navy.mil. Questions submitted must address specific content of the solicitation only and shall be submitted, in Microsoft Word format, as soon as possible, but no later than 1300 hrs (ET) on 30 December 2019. Requests received by 30 December 2019 will be answered in writing and posted to FedBizOpps.gov (beta.SAM.gov) prior to the required date for submittal of proposals. The Government reserves the right to not answer any requests received after 30 December 2019. Furthermore, Offerors should note that the proposal due date will not be extended solely on the basis of requests received after 30 December 2019. Request for Clarification and offeror questions/submissions shall clearly note questions that are considered to be proprietary or business sensitive. E-mails must use the subject line: N3094019R0288 Offeror Questions.

D. The primary place of performance under this solicitation is at the Portsmouth Naval Shipyard, Kittery, Maine.

E. Proposal Information: Offerors shall not presume the Government has knowledge outside of information provided in the proposal. Additionally, offerors are advised that statements such as: “the offeror understands”, “the offeror has a long history of outstanding support”, “standard procedures shall be used”, “well known techniques shall be employed” or any paraphrasing of the solicitation, shall be considered inadequate to demonstrate experience, knowledge of, or compliance with solicitation requirements. Offerors are encouraged to provide specific and concise information to validate all assertions.

F. Amendments: The Government may revise the solicitation at any time by means of an Amendment. It is an offeror’s responsibility to ensure it is accessing the FBO website to view potential amendments and procurement notifications for this solicitation.

G. Teaming Arrangements: Proposals must be submitted by one (1) prime contractor. Offerors may be listed as subcontractors in multiple proposals but may only submit one (1) proposal as a prime contractor with a unique Commercial and Government Entity code and Taxpayer Identification Number. To be evaluated as a Joint Venture (JV), offerors must provide a notarized agreement (with the price proposal) delineating roles and responsibilities for all proposed work.

The Government reserves the right to award sooner or later if necessary and will adjust the period of performance as necessary.

I. Section M of this solicitation provides the relative importance of the evaluation factors.

J. Offerors are cautioned that, in accordance with the clause “Instruction to Offerors-Commerical Items” (FAR 52.212-1), the Government intends to award a contract on the basis of initial proposals received, without discussions. Therefore, each proposal shall contain the Offerors’ best terms from a Price and technical standpoint.

K. Solicitation Responsiveness. Offerors are advised to submit Proposals that are complete, clear, and consistent in all respects without the need for additional explanation or information. Offerors are cautioned against the use of general, vague, or unsubstantiated statements, which prevent concise proposal evaluations. Each factor will be evaluated on how well the response meets the requirements of the solicitation. The response that completely addresses all of the solicitation requirements may be judged superior to the response that minimally addresses solicitation requirements.

L. Competitive Range. In accordance with FAR 15.306, if an award is not made on the basis of initial proposals, the Contracting Officer will make the determination as to which proposals are in the “competitive range.” The competitive range shall be determined based on the results of the evaluation of initial proposals, considering all evaluation criteria, and shall include the most competitive proposals. The number of proposals within the competitive range may also be reduced if the Contracting Officer determines the number of most competitive proposals that might otherwise be included within the competitive range exceeds the number at which an efficient competition can be conducted. However, the Government intends to award based on initial proposals, but reserves the right to enter into discussions.

M. Discussions/Final Proposal Revision (FPR)

(1) The PCO intends to make award without conducting discussions. At their discretion, the PCO may determine the competitive range and elect to conduct either verbal or written discussions, or both. Written answers to discussion questions will become part of the proposal only if subsequently specifically referenced in the FPR. When discussions are completed, the PCO will close discussions and request FPRs.

(2) If discussions are held, all Offerors selected to participate in discussions shall be advised of weaknesses and risks in their proposals, and shall be offered a reasonable opportunity to correct or resolve such weaknesses and risks and to submit such technical and Cost/Price information, or other revisions to their proposal, that may result from such discussions.

(3) Subsequent to the conclusion of discussions, Offerors may have the option of providing a complete new Proposal, not to exceed the page limitations addressed in paragraph 2.0. In addition, a red-line version is requested as part of your revised Proposal and/or additional pages to the original Proposal.

VOLUME II – FACTOR IV SMALL BUSINESS PARTICIPATION and SMALL BUSINESS

SUBCONTRACTING PLAN.

All Offerors (both large and small businesses) regardless of size status shall address their planned small business usage for this requirement and will be evaluated on the level of proposed participation of U.S. small businesses in the performance of this acquisition (as small business prime Offerors or small business subcontractors) relative to the objectives, requirements and goals established herein.

Large business contractors may achieve the small business participation goals through subcontracting to small businesses. Small business contractors may achieve small business participation goals through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and subcontracting to other small businesses in order to achieve the small business participation goals.

The Offeror shall articulate within their Small Business Participation Plan (SBPP) how they intend to meet the small

- business objectives and participation goals. Nothing precludes an Offeror from further demonstrating their extent of commitment to use small businesses beyond what has been required by the subject solicitation as articulated below. Offerors are encouraged to submit proof of awards, accolades, etc., received for their current and/or past support of small businesses. Examples include clear pictures of award(s) received, successful Small Business Administration Surveillance Review findings, CPARS ratings that address small business utilization, testimonials, etc. Discuss and submit proof of any specific outreach efforts performed in support of this requirement (e.g. holding internal or external meetings with potential small business subcontractors, ads, any conference attendance or host) that demonstrate the Offerors’ effort to identify small business subcontractors specifically in support of this requirement (e.g. roster, attendance sheet, etc.), and proof of any other pertinent information that demonstrates the Offerors’ current and/or past efforts to support small businesses.

Material submitted in support of this factor shall be organized sequentially under applicable tabs and all pages must be numbered to facilitate evaluation. The Evaluations will not look to obtain information in support of an Offeror’s SBPP proposal from other binders/binders or within the Subcontracting Plan (when applicable). The SBPP (IAW DFARS PGI 215.304) and the subcontracting plan (IAW DFARS PGI 219.705) are two distinct separate documents with different elements and should not be combined for submission. Offerors shall utilize the SBPP Proposal Format for submissions found at Attachment 16. Offerors submitting SBPP for this project should limit submissions to data essential for the evaluation of plans.

The SBPP proposal shall address the following:

Describe what types of commitments if any are in place for this specific acquisition either – small business prime, written contract, verbal, enforceable, non-enforceable, joint ventures, mentor-protégé, teaming agreements, partnership letters of commitment(s), etc.). Provide documentation regarding commitments to small business for this effort. Copies of such agreements should be provided as part of your small business participation plan and will not count against the page limitation for this binder.

Note: Enforceable commitments are: (1) with a small business, (2) identification of socioeconomic type of the small business and the services/supplies to be provided e.g. ABC Company, a WOSB, will provide commissioning, (3) specific to the subject requirement by indicating the solicitation number, and (4) include legible signature blocks and signatures from BOTH parties acknowledging the business relationship. Outside of the 20% SB participation goal, the remaining socioeconomic SB participation goals (SDB, HUBZone, WOSB, VOSB and/or SDVOSB) shall be proposed by Offerors using their best effort. The Government does not recognize a proposed zero percent as a goal, with the exception of the HBCU/MI socioeconomic category because it is an aspirational goal.
