1. GENERAL

1. 1 GENERAL OVERVIEW OF PROCUREMENT PROCESS

This acquisition is being issued on an UNRESTRICTED basis with full and open competition, as a Design Build procurement conducted as a negotiated procurement utilizing procedures in accordance with FAR Part 15 – Contracting by Negotiation and FAR Part 36 – Construction and Architect-Engineer Contracts. The best value continuum source selection process used in this acquisition is lowest price technically acceptable (LPTA). Award will be made to that responsible offeror whose proposal, conforming to the solicitation, is determined to offer the best value to the Government, considering price and non-price factors stated herein. Best value is expected to result from selection of the technically acceptable proposal with the lowest fair and reasonable evaluated price.

The appropriate Northern American Industry Classification System (NAICS) code for this procurement is 236220 and the size standard is $45M.

This acquisition will result in the award of a Firm-Fixed Price (FFP) contract for Design-Build construction to a single contractor for Base CLINs 0001 and 0002 and one of the two (2) priced Option CLINs. A firm fixed proposed price is required for ALL CLINs (CLINS 0001 through 0004). No provision is made for economic price adjustment. Offerors who do not submit prices for all CLINs will be considered nonresponsive to the solicitation and will not be evaluated.

Award will be made in U.S. Dollars.

In accordance with DFARS 236.204, the magnitude of construction for this project is between $1,000,000 and $5,000,000.

The Government intends to issue the Solicitation, electronically via the Procurement Integrated Enterprise Environment (PIEE) Solicitation Module (https://piee.eb.mil). This will also be the method for distributing amendments. Therefore, it is the offeror’s responsibility to check the website periodically for any amendments to this solicitation.

The contract completion time for this project is 1265 calendar days from Notice to Proceed.

1.2 GENERAL OVERVIEW OF CONTRACT SCOPE

This project will repair electrical distribution substations at NSA Souda Bay, Crete, Greece. It includes six (6) substations (SS2, SS4, SS5, SS6, SS7 and SS9) and one (1) Medium Voltage (MV) switchgear (SS7A) which are approaching the end of their service life. Substation equipment and electrical items to include but not limited to-existing substation ring main units (RMUs), transformers secondary circuit breaker cabinet combination and substation cabling shall be replaced. New dry-type transformers, Medium Voltage (MV) & Low Voltage (LV) switches, outdoor enclosures, Capacitor Bank, Advanced Metering Infrastructure (AMI) meters, reconfiguration of existing AMI meters, grounding, protective relaying, other electrical items and civil work are required for complete and usable substations.

Contractor Performance Information: Contractor’s performance will be evaluated using the respective contractor performance evaluation report entry system located on the website: https://www.cpars.gov. Prior to commencement of work the contractor is required to provide the Government with the name, phone number and email address of the “Contractor’s Representative” that will be responsible for receipt and review of draft performance evaluations prepared by the Government in the appropriate system. It is the contractor’s responsibility to keep this contract information current.

English Speaking Representative: At all times when any performance of the work at the site is being conducted by any employee of the Contractor or its subcontractors, the Contractor shall have a representative present on the site capable of explaining the work operations and receiving instructions in the English language. The Contracting Officer shall have the right to determine, without appeal of such decision, whether the proposed representative has sufficient technical and lingual capabilities, and the Contractor shall immediately replace any individual not acceptable to the Contracting Officer.

2. BASIS FOR AWARD

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.

As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price

An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

SYSTEM FOR AWARD MANAGEMENT:

To be eligible for award, your firm(s) must be registered in the System for Award Management (SAM) database as required by FAR 52.204-7, System for Award Management (Oct 2018).

Note that the System for Award Management (SAM) registration is required for all offerors; including Joint Ventures (JV) (registration must state the NAME of the JV). Offerors not currently registered in SAM must obtain a Unique Entity Identifier (UEI) and a CAGE or NCAGE prior to registering in SAM.

All offerors, including JV offerors, must submit with their proposal a UEI. In addition to the UEI required for JV offerors, JV offerors must submit with their proposal a UEI number for each member comprising the JV. UEIs can be obtained at https://sam.gov/content/entity-registration. The UEI is required in order to register in SAM (see above).

CAGE/NCAGE – A CAGE/NGAGE code is required for all offerors, including JV offerors. JV offerors must acquire a CAGE Code registered in the JV name.

(a) U.S. offerors, including Joint Venture offerors: U.S. offerors must obtain a CAGE Code prior to registering in the SAM database, part of the SAM registration process (see paragraph above).

(b) Non-U.S. (foreign) offerors ONLY, including JV offerors: Non-U.S. offerors must obtain a NATO CAGE (NCAGE) Code instead of a CAGE Code prior to registering in the SAM database. NCAGE codes may be obtained at the NCAGE website https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx.

IMPORTANT NOTICE: If the offeror is registering a new entity in SAM.gov, the offeror must follow new procedures, which include providing an original, signed notarized letter indicating authorized entity Administrator for the entity associated with the UEI before a new SAM.gov entity registration will be activated.

IT IS HIGHLY RECOMMENDED FOR THE NEW REGISTRANTS TO CHECK WITH SAM.GOV HELPDESK

DIRECTLY TO ENSURE THAT ALL REQUIREMENTS FOR TIMELY REGISTRATION ARE MET.

3. EVALUATION FACTORS FOR AWARD

This Two-Phase procurement will result in the award of one contract. The proposal is a two-phase submission process.

Phase I of the solicitation is a narrowing of offerors based on responsiveness and evaluation of non-price factor submittals. Only the most highly rated offerors will be invited to submit a Phase II proposal. The maximum number of offerors selected to submit Phase II proposals will be five. For the exclusive purpose of determining which Phase I proposals are the most highly rated, the SSEB will establish a performance confidence assessment rating for each offeror’s Past Performance (Factor 4).

If an Offeror is rated “Unacceptable” for any of the Phase I Technical Factors, such offeror will not be invited to participate in Phase II, regardless of its rating under any of the other factors. Additionally, an Offeror with a past performance assessment of “Limited Confidence” or “No” Confidence will not be invited to participate in Phase II, regardless of its overall “Acceptable” rating for Phase I Technical Factors.

The solicitation requires the evaluation of price and the following non-price factors. For this Two-Phase procurement, the following non-price factors will be evaluated in:

Phase I:

Factor 1 – Corporate Experience

Factor 2 – Technical Approach

Factor 3 – Safety

Factor 4 – Past Performance

Phase II will evaluate the following factors:

Factor 5 – Price

Factor 6– Management Approach

The distinction between corporate experience and past performance is that corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Narrative shall not exceed one (1) double-sided page (or two (2) single-sided pages).

(ii) Basis of Evaluation:

The Government will evaluate the Offeror’s Design Plan, considering the extent to which the Offeror demonstrates a clear understanding of the requirements of the project. The Government will evaluate the Offeror’s capability to deliver a quality design package that meets the RFP requirements. The Government will evaluate the effectiveness of the Offeror’s technical approach to perform the work in accordance with the technical requirements of the RFP.

(3) Factor 3, Safety:

The offeror shall submit the following information on Attachment C – Format Outline for Safety: (Only one safety narrative is required for a partnership or joint venture).

Describe the offeror's technical approach to safety, as well as the plan that the Offeror will implement to evaluate and measure safety performance of potential subcontractors, as a part of the selection process for all levels of subcontractors. If subcontractors will not be used, the offeror shall provide a statement to that effect.

Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to two (2) pages; pages in excess of the limit will not be evaluated.

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors if any will be used. The Government will evaluate the Offeror's overall safety record, the Offeror's plan to select and monitor subcontractors, if used, and any innovative safety methods that the Offeror plans to implement for this procurement. The Government's sources of information for evaluating safety may include, but are not limited to, Government agencies, OSHA, NAVFAC's Facility Accident and Incident Reporting (FAIR) and Contractor Incident Reporting System (CIRS) databases, and other related resources. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the offeror. The evaluation will collectively consider the following:

Offeror's Technical Approach for Safety Other sources of information available to the Government

Regarding subcontractors, the Government will evaluate the narrative to determine the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project, unless the offeror provides a statement that no subcontractors will be used. The Government will also evaluate the narrative to determine the degree to which innovations are being proposed that may enhance safety on this procurement. Those Offerors whose plan proposes innovative methods to enhance a safe working environment may receive a higher rating.

(c) Past Performance

(1) Factor 4, Past Performance:

The offeror shall provide a past performance evaluation for each project submitted under Factor 1 – Corporate Experience. IF A COMPLETED CPARS EVALUATION IS AVAILABLE, IT SHALL BE SUBMITTED WITH THE PROPOSAL. IF THERE IS NOT A COMPLETED CPARS EVALUATION, the Past Performance Questionnaire (PPQ), included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 1 – Corporate Experience.

AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CPARS IS AVAILABLE.

If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment D), which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Ms. Angela Tsukala, via email at angela.tsukala.ln@us.navy.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not available to the Government, such as interviews with Program Managers and Contracting Officers.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Corporate Experience. Offerors may also address any adverse past performance issues. Explanations shall not exceed four (4) pages in total.

Performance awards or additional information submitted will not be considered.

Past Performance information should be submitted in chronological order with oldest information first and most recent last.

The Government is seeking to determine if there is a reasonable expectation that the offeror will successfully perform the required effort. The Government will evaluate the degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., CPARS, FAPIIS, e-SRS, performance recognition documents, and information obtained from any other source reflect a minimum of satisfactory performance considering:

A pattern of successful completion of tasks;

A pattern of deliverables that are timely and of good quality;

How recently the tasks that are identical to, similar to or related to the task at hand were performed.

Tasks that are identical to, similar to, or related to the task at hand”

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.
