QUESTIONS AND ANSWERS #5
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
1. C-1.7.1.4.7 What is the expected length of time for the familiarization period? Also, without knowing whether the familiarization period is 14 days, 45 days, or somewhere in between, we do not see how this can be priced adequately. Please clarify and clearly define.
ANSWER: Sections C-1.7.1.5, C-1.7.11.4, C-1.7.11.5, C-3.5.1, and C-3.5.2 will be revised in a future amendment to change/clarify the familiarization period requirement.
2. C-3.5.1 Contract Phase-In: The Contractor assumes all duties and responsibilities under this contract for operating these ships during the Phase-In period. Contract begins upon the delivery of the first vessel.
Please clarify when the Contractor assumes control of the vessel as the Phase-In period can begin as far ahead of the scheduled delivery date by as many as 30/14 days.
ANSWER: See answer to Question 1 above.
3. C-3.5.6.2 Phase-Out Transition Plan: The contractor relinquishes all duties and responsibilities under this contract for the operating and maintaining of the ships during the Phase-Out period.
This item has the same issue as the above question (C-3-5-1) in regards to the Phase-Out period.
The Phase-Out period can take up to 120 days. Please clarify.
ANSWER: The phase-out period for the incumbent contractor shall be included in the option four per-diem rate. The phase out period shall be in accordance with the contract requirements.
4. In reference to Section C 3.24 and Section I Clauses Incorporated by Reference 252.204-7012
(A) – please confirm that it is at the Contractor’s Account to pay for the expenses associated with ISO/IEC 27001 and NIST compliance. This is a substantial cost if a company is not already compliant.
ANSWER: Yes, ISO/IEC27001 and NIST compliance is for the contractor’s account.
5. Section L(j) Budget and Financial Management – Is it acceptable to submit information regarding our Subcontractor’s purchasing system if they will be performing the procurement for this contract? Or should only the Prime contractor’s purchasing system information be included?
ANSWER: Please submit the purchasing system information that will be used during performance of this contract. If other than the prime contractor, provide notice with the offer.
6. M-1A.1. Should the language in the last sentence of this section read as follows for purposes of clarify regarding evaluation? “Award will not be made to an offeror who receives an Unacceptable rating for the technical factor, a Limited or No Confidence rating for Past Technical Performance, or an Unacceptable rating for the Small Business Participation Factor”.
Please clarify.
ANSWER: Yes. This language will be updated by a future amendment.
7. We are respectfully requesting that you extend the date for proposals to be submitted under the T-
AGS/USNS WATERS RFP. The reason for this request is that the union, SIU, has been so late in providing a Collective Bargaining Agreement with wages and fringe benefits. They say this is due to their need to evaluate the DOL Wage Determination. While we just today got a first draft from SIU, is does not include the USNS WATERS as that is under a different DOL Wage Determination.
Bids are currently due July 22, 2016. It would be most helpful if MSC could extend that due date by just one week until July 29, 2016.
ANSWER: The due date for RFP N32205-16-R-3100 has been extended to 03 August 2016.
Amendment 0003 will reflect the updated change.
8. We respectfully request a 2-week extension to the current closing date.
ANSWER: See answer to question #7 above.
