Simms Division of | Revision No.: 11 Director Wage Determinations| Date Of Last Revision: 10/01/2019 Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.60 for calendar year 2019 applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.60 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2019. The EO minimum wage rate will be adjusted annually.

Collective Bargaining Agreement between Exelis, Inc (Security Officers Unit) and International Brotherhood of Electrical Workers Local 1260, effective October 1, 2015 through September 30, 2020 and amended on September 9, 2019.

Collective Bargaining Agreement between Exelis, Inc (PMRF contract) and Inlandboatmen's Union of the Pacific, Hawaii Region effective October 1, 2015 through September 30, 2020 and amended on June 10, 2019.

Collective Bargaining Agreement between Exelis, Inc (Main Unit) and International Brotherhood of Electrical Workers Local 1260, effective October 1, 2015 through September 30, 2020 and amended on September 9, 2019.

Collective Bargaining Agreement between KE'AKI Technologies, LLC, Inc. (Main Unit) and International Brotherhood of Electrical Workers Local 1260, effective October 1, 2015 through September 30, 2020 and amended on September 5, 2019.

In accordance with Sections 2(a) and 4(c) of the Service Contract Act, as amended, employees employed by the contractor(s) in performing beauty shop services covered by the Collective Bargaining Agreement(s) are to be paid wage rates and fringe benefits set forth in the Collective Bargaining Agreement between Gino Morena Enterprises and United Food and Commercial Workers International Union AFL-CIO Local Number 1996, effective April 20, 2015 through April 30, 2018.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors, applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is the victim of, domestic violence, sexual assault, or stalking. 18.3 Retirement Plans:

18.3.1 During the term of this Agreement, the Company agrees that eligible employees may participate in an Pension Plan for Hourly Employees at the Pacific Missile Range Facility as defined in the Plan documents. The Company will make available at the request of the employees Summary Plan Description of the Pension Plan.

18.3.1.1 It is understood that during the term of this Agreement and modifications made to the Pension Plan by the Company will apply automatically to employees covered by this Agreement. Such modifications will not be subject to negotiation with, or approval by, the Union. Further, it is understood that nothing in this Agreement is intended to modify the authority reserved by the Company in relation to qualified retirement plans as stated in the Plan documents.

18.3.2 During the term of this Agreement, the Company agrees that eligible employees may participate in the 401 (k) plan, as defined in the Plan documents.

18.3.2.1 It is understood that during the term of this Agreement any modifications made to the Plan by the Company will apply automatically to employees covered by this Agreement. Such modifications will not be subject to negotiation with or approval by the Union. Further, it is understood that nothing in this Agreement is intended to modify the authority reserved by the Company in relation to qualified retirement plans as stated, in the Plan documents.

18.4 Temporary Disability Insurance:

18.4.1 The Company shall furnish a Temporary Disability Insurance Plan at no cost to the employee. The plan will provide for 75% of the employee's weekly compensation with a three (3) day waiting period.

18.4.2 The Company further agrees to allow the employee to utilize his accumulated Paid Absence Allowance or Vacation to supplement up to one hundred percent (100%) of his/her weekly compensation.

18.5 Worker's Compensation:

18.5.1 The Company will furnish the equivalent of the State of Hawaii Worker's Compensation Plan at no cost to the employee. The plan will provide for 75% of the employee's weekly compensation with a three (3) day waiting period.

18.5.2 The Company further agrees to allow the employee to utilize his accumulated Paid Absence Allowance or Vacation to supplement up to one hundred percent (100%) of his weekly compensation.
