Number REF/#: Industry Question/Comment Government Response 1 Volume 5 ‐ Cost The Government has emphasized employee retention, reduction of operational risks, and cost realism in the RFP. In order to eliminate cost gaming strategies by aggressive bidders, will the Government confirm the hourly positions in Attachment – TE9 Historical LOE Labor Hours.xlsx, on the “Labor Categories as of 11 28 18” tab in rows 86 through 112 are part-time positions?
The TE9 Historical LOE Labor Hours.xlsx, “Labor Categories as of 11 28 18” tab in rows 86 through 112 are hourly personnel and were utilized on an as needed basis.
2 Volume 5 ‐ Cost In Attachment – TE9 Historical LOE Labor Hours.xlsx the “Labor Categories as of 11 28 18” tab identifies the part-time positions and the number of FTE’s, however, in Attachment_CA- 1_Prime_Cost_Spreadsheet_5.31 there are only two labor categories, Subject Matter Expert, Range RCS Data Reduction and Subject Matter Expert, Range Electronic Warfare Threat Definition that have hours below 1920. Will the government please identify which of these documents is the governing document for determining the part-time or full-time status of the labor categories?
TE9 is a snapshot of the historical LOE and staffing. It was provided to give offerors an idea of staffing levels on the current contract to assist with preparing proposals. CA-1 Identifies the anticipated LOE for the follow-on contract and the required number of hours to be proposed for each position. There is no set direction or governance of how potential offerors need to propose on the basis of full-time versus part-time employees to meet the total hour requirement.
3 Volume 5 ‐ Cost There are multiple discrepancies between attachment TE9 Historical LOE Labor Hours.xlsx, on the “Labor Categories as of 11 28 18” tab, and the Attachment_CA-1_Prime_Cost_Spreadsheet_5.31.
For example, the “Computer Programmer III” position in TE9 states one part-time position, one full-time position, and three hourly positions. However, in the government provided cost spreadsheet for the “Computer Programmer III” position, there are only 1920 ATR labor hours identified. Discrepancies also exist for “Engineering Technician I,II,III and IV,” “General Clerk I,” “Management Analyst, Senior,” “Order Clerk II,” and “Project Support Specialist I, II, III, and IV”. Will the government please identify which of these documents is the governing document in preparing cost, or how the offeror should account for the discrepancies between these two provided documents in preparing the cost?
TE9 is a snapshot of the historical LOE and staffing. It was provided to give offerors an idea of staffing levels on the current contract to assist with preparing proposals. All Offerors must use the the lasted version of the Attachment_CA-1_Prime_Cost_Spreadsheet in prepairng their cost proposals in terms of required labor categories and associated hours per contract year.
4 1. Will the Government allow an Overtime Rate column to be added after Column G in both CA-1 and CA-2 Attachments? Subcontractors could provide fully loaded overtime rates in CA-2 to calculate subcontractor overtime cost. The rates would be used to populate the Prime CA-1 cost sheet.
Offerors should not add an additional column for an Overtime rate.
Per Instruction 5 for the CA templates, "Within the work sheet any cell colored "blue" contains a formula. These formulas should not be edited unless an offeror needs to account for additional overtime premiums or any other premiums in accordance with the offerors disclosure statement. Any changes to formulas in blue shaded cells should be explained in the Offerors Cost Narrative in order for the Government to evaluate cost realism and reasonableness."
Offerors proposing subcontractors with labor categories with Overtime hours should populate the formula for OT with a fully burdened rate provided by a subcontractor times the OT hours as neccessary. The Primes cost narrative should explain either the rate in the cell is further expalined in the subcontractors CA-2 and cost narrative as appropriate, or state that the rate in the cell was provided via the subcontractor.
5 2. Will the Government allow the Prime to copy the overtime cost values from the Subcontractor CA-2 worksheet, columns K and O, and paste the values to the Prime CA-1, columns K and O, for each subcontractor?
Subcontractor rates provided within the CA-1 should be fully burdened and the calculation of costs should be based off of rates provided within the CA-1 attachment. Primes are to complete the subcontractor sections of the CA-1 attachment based off of rates provided by the subcontractor. Column G should be a fully burdened direct labor rate used to calculate normal working hours. The OT rate used for subcontractors in the CA-1 will either link to the rate as provided in column G or the formula will need to be altered to account for the subcontractors fully burdened OT rate if not a straight calculation. For example, if a subcontractor adds different premiums or indirect rates to OT hours, then the subcontractor would need to provide the Prime with the fully burdened OT rate so that the Prime could change the formula in columns K and/or O to reflect a formula "=$XX.XX*OT hours". Primes would then explain in their narrative why the formula was altered and justify the reasonableness of all rates.
6 Question 20 in document N00421-18-R- 0038_Final_RFP_Questions_-_3 stated the following:
“It appears the government provided minimum rates for Engineering Tech I, II, III, and IV for Key West, FL positions are below the mandated AWD minimum.
Will the government please review the rates in question and advise offerors accordingly?”
The Government replied, “According to WD 15-4540, Rev. -8 dated 12/26/2018, occupation codes 30081 - 30084, the rate range minimums are in accordance with the AWD mandated minimums. However, the Government will be updating these rates in the forthcoming Amendment 0002.”
WD 15-4540 Rev 8 is for Florida counties Baker, Clay, Duval, Nassau and Saint Johns. WD 15-4584 Rev 10 is for Monroe County (Key West). Will the Government also update Section J to include this WD schedule?
WD 15-4584 Rev 10 was added via Amendment 0003 and provided with the amendment on FedBizOps. The Direct Labor Rates Table was updated accordingly to reflect this WD for Key West labor category locations. Amendment 0005 will annotate the Rev number within Section J of the solicitation.
7 Section J, Attachment 4: references Wage Determination Schedule 15-4280 Rev 8. A new revision (9) was issued on June 4, 2019. Will the Government update Section J to include the new revision?
The new revision number for the AWD will be updated in Amendment 0005 to the solicitaiton. Offerors shall propose in accordance with the AWD Revisions listed in Section J as of Amendment 0005.
8 The table provided on pages 22-26 in Amendment 0003, Paragraph 5.3.2.1 Direct Rates, lists several Labor Categories that have Rate Ranges lower that the AWD schedule for the location provided.
Can the Government clarify if offerors are to use the low-end rates in the rate table as parameters, or should offerors use the latest AWD Schedule and rates as guidelines for the low-end rate for these labor categories?
Offerors shall ensure that the proposed direct rates are in compliance with all AWDs listed in Section J as of Amendment 0005. The direct rate table was provided to the Offerors to identify the range of direct rates historically paid for an individual labor category. In accordance with Section L, Volume 5, paragraph 5.3.2.1, "For any proposed prospective hires, Offerors shall utilize the table below that provides a rate range of direct labor rates based off of historical rates for each labor category. The only acceptable substantiation for proposing less than the Government provided labor rate range for each category is payroll verification for current employees or Letters of Intent for Contingent Hires. Therefore, Offerors shall propose direct labor rates in accordance with the provided direct labor rate ranges and ensure compliance with the Service Contract Act.
9 AWD Schedule 15-4280 has a revision as of June 4, 2019. Will the Government update Section J and any applicable rates on pages 22-26 of Amendment 3 accordingly? Also, would the Government provide the revision number for AWD 15-4584? The Government website provided currently lists a Revision 10.
AWD Revision numbers will be updated in Amendment 0005 to the solicitaiton. Offerors shall bid in accordance with the AWD's listed in Section J as of Amendment 0005.
10 On page 19 of Amendment 0003, paragraph 5.1 (last full sentence continuing to the top of page 20), the Government states: “Additionally, the Offeror shall propose an H-clause that clearly identifies what equipment and/or material, and the associated data and data rights that are conveyed to the Government, and that also specifically states the fiscal adjustment(s) and identifies the Offeror’s liability in Volume 5 Section 5.3.1, Ground Rules and Assumptions, and in Volume 6, Terms & Conditions, Assumption and Exceptions or Deviations, of its proposal.”
However, on page 21 of Amendment 0003 Cost Proposal Instructions, Paragraph 5.3.1 is titled “LOE Services” and there are no instructions on where the Ground Rules and Assumptions should be included in this part of the cost volume. Would the Government please provide instructions on where offerors should include the Ground Rules and Assumptions?
The solicitation will be amended to require that Ground rules and Assumptions related to the Cost Volume be included under Section L, Part B, paragraph 5.3.2 (Cost Narrative).
11 Reference: Amendment 0003, Paragraph 2.2 Transition Phase-In Plan, paragraph b)ii in page 12.
Are there specific areas (similar to the RFP language for Aircraft Support Services) that Offerors should address in their proposal regarding Vessel Support Services?
The Offeror's proposal shall consider the SOW paragraphs as listed in the Cross Reference Matrix pertaining to Vessel Support Services when responding to the Section L 2.2 Tranisition Phase-In Plan.
12 Amendment 0003, Paragraph 2.1.1 states that “The Offeror should put as much proposal material as possible on each CD-ROM, keeping the portions of the proposal that contain pricing information on separate CD-ROM(s) from the portions of the proposal that do not contain pricing information.”
Would the Government please clarify whether offerors are allowed to provide multiple volumes on one CD- ROM, keeping the pricing portions separate.
Offerors are permitted to submit multiple Volumes on a single CD- ROM. However, if submitted on the same CD-ROM, Volumes and Annexes need to be separate files. However, Volume 5 and Annex A must be submitted on a separate CD-ROM from the other Volumes/Annexes.
13 The Instructions tab in Vol 3 Att L-3 CE Table states “T.O.s and D.O.s should be treated as a contract and assigned a separate contract reference number.” It also states that “all contract references shall be numbered the same throughout all of the Offeror’s proposal volumes (i.e. the contracts identified as P1, S1, T1 etc.”
Instructions for Vol 4 Att L-5 PP-1 PP Cont Data states “The offeror may only put multiple DO or TO numbers in this box if they can be grouped because they are the same work effort and are evaluated under the same CPAR.”
Would the Government please clarify if offerors can put multiple DOs and TOs as a single reference in the Vol 3 Att L-3 CE Table if they can be grouped because they are the same work effort and are evaluated under the same CPAR.”
Offerors shall follow the instructions stated in CE-1 and provide a seperate entry for each of the DO/TOs provided in Vol 3 Att L-3 CE -1.
The primary contract reference (P1, P2, S1, S2 etc.) shall remain the same accross volumes. For CE-1 the separate entries shall be included as separate Excel workbook tabs, identifiying the same primary contract reference and including the applicable DO/TO.
For instance, if entry P1 includes Task Orders 0001, 0002, and 0003, Attachment L-3 (CE-1) should have three separate tabs labeled as such (P1 TO 0001, P1 TO 0002, and P1 TO 0003).
