Questions and Answers N00421-18-R-0020 09 May 2018
Question 1: On the Representations, Certifications and other statements of offerors (page 27 of the amendment and page 66 of the final RFP) 252.204-7007 if you are not in SAM and check (ii) Paragraph (d) does not apply and the offeror has completed the individual representations and certification in the solicitation. The rest of the certifications are missing. Meaning the rest of the section K has no certifications to check just FAR clauses the contracting officer to check as appropriate. Please clarify what the offeror is to certify to.
Response: The language in the question above ["if you are not in SAM and check (ii) Paragraph (d) does not apply and the offeror has completed the individual representations and certification in the solicitation"] is a paraphrase of paragraph b(2) of provision 252.204-7007, Annual Representations and Certifications. As stated in the beginning of paragraph b(2) of 252.204-7007, checking the block in b(2)(ii) of the provision is only an option "If the clause at 52.204-7 is not included in this solicitation....". However, clause 52.204-7, System for Award Management, which requires registration in SAM prior to award, is in fact included in Section I of this solicitation. Accordingly, per (b)(1) of 252.204-7007, paragraph (d) applies. Indicating paragraph (d) does not apply is not an option. Therefore, all representations and certifications, excepting paragraph (b) of 52.209-7, Information Regarding Responsibility Matters on page 65 and 5252.209-9511, Organizational Conflicts of Interest Representation (Services) on page 69, are to be completed in SAM. Additionally, paragraph (e) of 252.204-7007 allows offerors to incorporate any amended representation(s) and/or certification(s).
