• Page 116 of 228, Section C, Paragraph 1.11, states, "For all generated RCCs and GMRs the contractor shall provide a Change Order Price Analysis (COPA) proposal to the ACO within three (3) calendar days (See CDRL A002).”

• Page 209 of 228, Section L, V. Proposal Content, B. Volume II, 2. Factor 2 - Resource

Capacity & Schedule, Paragraph (4)(b)(i), states, “The Government considers the use of overtime to increase the risk of unsuccessful contract performance.”

To meet the 3 calendar day COPA requirement, Contractors will be forced to expend overtime, and in some cases, double time to comply with the requirement as written; yet the Government considers the use of overtime to increase the risk of unsuccessful contract performance. The Contractor also wishes to note that Subcontractors, many small businesses, operate with limited resources but will be subject to overtime and double time impacts from such a swift turnaround. This includes impacts to support during multiple holidays within the 550 day availability duration

1) In order to depressurize COPA turnaround, the Contractor requests the requirement be changed from “(3) calendar days” to “(3) business days”. Doing so will mitigate risk by reducing usage of overtime, limit delays, and still allow the Government sufficient time to appropriately adjudicate COPAs.

Contractor's request acknowledged. The requirement will remain unchanged.

68 243-11-001 Bulkhead Shaft Seal

Emergency Clamp Ring;

repair

The OEM listed in 1.3 for the requirements of paragraph 3.1 responded the contractor with a "no bid", stating "Mide will not be bidding on 243-11-001 in its current state, as we do not want to be bound by an inaccurate work item since the costs associated with the stated work will likely not match what is actually required at this seal location. With that being said, I fully expect the Project Manager, Mr. Casey Bressem, to issue a new work item, 243- 11-002, that better reflects the required work associated with the bulkhead seal at frame

254 on the STBD shaft aboard the PREBLE."

Will a new item be issued? if not please provide direction.

Work item 243-11-001 is cancelled via errata 6. No new work item will be issued as scope of work will be accomplished during upcoming CMAV.

72 N/A Solicitation #: N00024-20- R-4400-0001

Page 206 of 228, Factor 2, Sub-factor A, Paragraph 1(a) – Attachment S-4

The requirement is for the Attachment S-4 data to be completed for all discrete commercial, ship repair and new construction projects that are on-going or completed within the proposed shipyard and within the local Naval Station, if the shipyard is within the homeport area or fleet concentration area between 22 April 2019 and 27 December 2019.

1) There is no requirement to submit or retain all the required S-4 data for non-U.S. Navy CNO Availabilities. Please clarify if there was no requirement for this data to be generated during the contract execution, these projects are not required to be captured on the Attachment S-4, such as CMAVs.

All projects includes all "non-U.S. Navy CNO Availabilities" and CMAVs. There are three components to this requirement,

1) Actual Manning,

2) Planned Manning and

3) Planned Manning.

The Government assumes that the offeror has record of Actual Manning provided in support of projects between 22 April and 27 December 2019. As such, the Government interprets this question as focused on planned and earned manning requirements of Attachment S-4. For availabilities in which no planned manning schedules were developed by ther offeror, future manning plans may be estimated by the offeror. The offeror shall explain any assumptions in this estimating process. In this context, "future manning" is defined as availability requirements to be completed after the release date of the subject solicitation. Historical planned and earned manning requirements for "non-US Navy CNO Availabilities" and CMAVs may be assumed to be equivalent to Actual Manning on the S-4, if no plan was developed in the execution of the availability.

1) Please confirm that the data reporting period for the Attachment S-4 commences on 22 April 2019 and extends to the latest forecasted completion date for any projects that were on-going or completed between 22 April 2019 and 27 December 2019. Therefore, no data prior to 22 April 2019 is required.

The offeror shall provide information for all projects, including all discrete commercial, ship repair and new construction projects, that are completed, awarded, on-going, or proposed (including the proposal for the USS PREBLE DMP) between the week ending 26 April 2019 and the Contract Complete date of this solicitation, from the Contract Start and Actual / Forecast Start Dates to the Contract Completion and

Solicitation Section L, V, B, 2, a)

The proposal instructions include highly burdensome requests for manpower data for a time period not associated with performance of this solicitation. Please amend the proposal instructions to remove this instruction or provide clarification on what basis this is considered an appropriate request.

This information is a requirement of the contract.

104 CDRL A012

CDRL A012 calls for offerors to submit proprietary performance information including ACWP and ETC. Please amend the CDRL to remove this instruction or provide clarification on what basis this is considered an appropriate request.

This information is a requirement of the contract.

Solicitation Section C, para 1.4.3, CDRL A012, and CDRL A015

The requirements in paragraphs 1.4.3.1, 1.4.3.1.1, CDRL A012, and CDRL A015 to constrain production budgets to the J-4 values and only report production hours as defined by Section

B, Note B represent an irreconcilable conflict with the contractor’s existing performance management system and cost accounting system. In order to produce the reports the

Government desires, an entirely new and separate reporting process must be developed and staffed at a significant expense. Given that these reports are solely for the Government and of no value or utility to the contractor in the actual performance of the work, please remove these requirements from the solicitation.

The Government has revised the SOW to remove section 1.4.3 in its entirety via Amendment 0003.

A0003

106 CDRL A015

Please remove CDRL A015 from the solicitation as it is both highly burdensome and inappropriate for this type of contract This information is a requirement of the contract.

107 CDRL A015

This report is highly burdensome to produce yet calls for a weekly submittal whereas on cost-type contracts it is only a monthly submittal. Please remove CDRL A015 from the solicitation.

This information is a requirement of the contract.

Solicitation Section C, paragraph 1.11

Paragraph 1.11 calls for contractors to provide COPAs within 3 calendar days. As this paragraph also requires contractors to provide material pricing and subcontractor quotes with the COPA, it will be substantially impossible for contractors to comply with the three calendar day requirement, particularly when the RCC/GMR is issued on a Friday or prior to a holiday. Please amend the solicitation to revise the requirements to be seven calendar days to conform with the requirements of prior solicitations.

This information is a requirement of the contract.

Section C, paragraph 3.6 and CDRL A016

Despite claiming otherwise, by requiring reporting of actual manhours and actual material cost data, this CDRL is effectively requiring contractors to inappropriately report proprietary financial data on a fixed price contract. While contractors may report the BCWP values and negotiated material amounts, since the Government already knows the negotiated contract values for the work performed, this report imposes a new burden to report data the Government already possesses. Please remove paragraph 3.6 and CDRL A016 from the solicitation.

This information is a requirement of the contract.

110 Section L, Volume 2

At numerous locations in the solicitation offerors are directed to provide manning plans and narratives discussing staffing for currently contracted work, the work in this solicitation, and “ALL outstanding proposals”. Given the uncertain nature of the competitive bidding process contractors will out of business necessity have more proposals outstanding than they expect to be awarded. Consequently, this requirement unreasonably demands offerors provide a plan to accomplish work at a level of staffing that will never be realized. Please remove this requirement from the solicitation.

This information is a requirement of the contract.

112 CDRL A015

This CDRL is clearly derived from reporting that is only appropriate on cost type contracts and contains numerous elements which are inappropriate for a fixed priced contract, such as:

i. ESTIMATED PRODUCTION HOURS FOR AUTHORIZED, UNPRICED WORK

ii. ESTIMATED PRODUCTION HOURS

iii. OVER TARGET BASELINE (OTB)/OVER TARGET

SCHEDULE (OTS)

iv ESTIMATED PRODUCTION HOURS AT COMPLETION

This information is a requirement of the contract

Solicitation Section L, V, B, 2, c), (2), (a) and Section B, Note F

Subfactor C requires offerors to “Demonstrate how the Offeror has scheduled the performance of all work items included in the Availability work package (including both Base and Option items) so as to permit the contract scope increases described in Section B, Note F (all new and growth work identified in this solicitation) without causing delay or disruption to the work required by the aforementioned work items, to any other Government contract, or to any other work in progress for the Government.” Since growth work, by its very definition, is work which must be completed in order to finish the basic scope of work, it is physically and logically impossible to complete growth work requirements without impacted to basic work requirements. Additionally, since the Government is allotting themselves 14 calendar days to review COPAs and put growth work on contract, there will at a minimum be a 14 calendar day impact to the basic work schedule regardless of the magnitude of the requirements changed by the growth work. Likewise, as new work is wholly undefined, it is logically impossible to affirm that it may be incorporated without causing delay or disruption regardless of magnitude, scope, timing, or affect upon the critical path. Finally, as at this point there is no defined scope for these growth or new work requirements, it is technically and logically impossible to determine the schedule relationships and resource requirements necessary to integrate them into the schedule. Please remove from the solicitation the demand to accomplish what is clearly impossible to affirm or perform.

The Key Events & Milestones provided in Attachment J-3 reflect the no later than milestones that must be achieved to return the vessel to the Fleet in a timely basis.

These milestones include duration margin for expected new and growth work.

The Government expects the the Offeror to schedule performance of all work items included in the Availability work package (including both Base and Option items) in their initial IMS with sufficient duration margin to absorb new and growth work without delay or disruption to the Attachment J-3 Key Events & Milestones.

• Paragraph 3.3 states, "Remove existing and install new 10 EA, (4 Foot by 8 Foot) sheet, CRES, honeycomb sheathing panels located in 1.2.1 - Crew/CPO Galley (1-191-0-Q) as designated by the SUPERVISOR."

The contractor has found that installation of CRES honeycomb (Nomex core) sheathing panels in wet spaces, as is directed by paragraph 3.3, has led to wicking of fluids into the

(Nomex core), delamination of the core from the CRES sheathing, and has a high probability of generating black mold within the panels themselves. As a "Lessons Learned" the contractor has worked with the customer to install CRES (aluminum core) sheathing panels in lieu of the (Nomex core) panels, this alleviates the risk of wicking and the subsequent delamination and mold growth potential.

1) Will the customer revise the work item thru the issuance of an Errata to replace the CRES (Nomex core) panels identified in paragraph 3.3 with CRES (Aluminum core) panels?

Work item will not be modified. Material to be as provided.

• Paragraph 3.1.2 states, "Schedule work to ensure that a minimum of one SSGTG is operational and available for Ship's Force use at all times during the availability."

This is a 18 month Docking availability, the contractor suspects that paragraph 3.1.2 was inadvertently copied from a CMAV availability work item template.

Bidder's Question:

• Paragraph 2.6 identifies, "512-8808795 Rev A, ShipAlt DDG-51-92831 SNLWS Incr 1 (HELIOS) HVAC Mods & ML"

The drawing is an Initial Issue it is only 3 pages long (Sheet 1, 1A, and 2) and contains (46 EA) General, (1 EA) Ripout, (1 EA) Special, and (1 EA) Test Notes but NO work requirements.

Bidder's Questions:

1) Will the customer issue an errata to revise paragraph 3.4 of the work item to delete

"Work to be completed in accordance with the schedule provided in Attachment A." or will Attachment A work item schedule be provided?

2) Will a revised reference 2.6 be issued that actually contains work scope for contractor accomplishment?

Errata 10 has removed the requirements of " Work to be completed in accordance with the schedule provided in Attachment A."

In regards to ref 2.6, currently revision B is pending. Once this drawing revision is released it will be encorporated via RCC.

• Paragraph 3.1 states, "Accomplish the requirements of 009-32 of 2.1, including Table 3, Line 22, Column A, for surface preparation of deck listed in 1.3 and located in 1.2."

The contractor notes that paragraph 3.1 directs to accomplish a "Near White Metal Blast, NACE 2/SSPC-SP 10" on (10 SF) of deck plating. The contractor suspects that the effort to accomplish a Near White Metal Blast of only (10 SF) in the confined space identified in 1.2.1 may be more efficiently accomplished as a "Power Tool Clean to Bare Metal, SSPC-SP 11

121 N/A Solicitation #: N00024-20- R-4400-0001

On page 129 of 228 of the RFP the Contractor notes the Governments inclusion of C-211-

H016 SPECIFICATION AND STANDARDS (NAVSEA) (OCT 20181994):

(a) Definitions.

(i) A "zero-tier reference" is a specification, standard, or drawing that is cited in the contract (including its attachments).

(ii) A "first-tier reference" is either: (1) a specification, standard, or drawing cited in a zero-tier reference, or (2) a specification cited in a first-tier drawing.

(b) Requirements. All zero-tier and first-tier references, as defined above, are mandatory for use. All lower tier references shall be used for guidance only unless specifically identified below.

None.

(End of text)

It is the Contractors understanding that all required references listed in paragraph 2 of a zero-tier specification (work item) are "first tier" references. However, when a zero-tier specification directs to use a first-tier reference as "guidance", bidders should not estimate

It is unclear what "estimate the reference" means in this context, given that the solicitation requires the pricing of work items. In accordance with the solicitation, the Government will assess price proposals in accordance with FAR 15.404 to determine reasonableness of proposed pricing based on the information contained in the Pricing Workbook.

120 N/A Solicitation #: N00024-20-

R-4400-0001

The contractor has reviewed the conformed RFP with Amendment 0001 and notes the following:

RFP Page 118 of 228, IAW Section C - Descriptions and Specifications, SCOPE OF WORK, 2.

LOCATION: paragraph 2.1 states, "The required place of performance for the Availabilities shall be the contractor’s facility." Additionally, Attachment J-3 Execution Milestones and Key Event Date R3 also identifies the first milestone as, "Avail Start at Contractor Facility." These appear to be generalized statements prepared for a coast wide bid for out of homeport (San

Diego) bidders.

The contractor has reviewed previously awarded contracts, both Coast wide and SDMAC, and notes that availabilities accomplished in the Port of San Diego start pierside at NAVSTA 32nd Street for the first 14 Calendar days. This allows the customer and ship's force time to prepare the ship to enter contractor’s facility. Activities listed are not all inclusive: Ship's Force movement to Berthing Barge and Ship's Force off-load of stores, material, and portable equipment. This also allows the contractor an opportunity to set-up temporary services; installation of staging, drain, disposal, and dewatering of specific water systems;

installation of the AN/SPY-1D Antenna Protective Covers and installation of deck protection prior to arrival in the contractor’s facility.

Bidder’s Question:

1) Can bidder's assume that if the contract is awarded to a bidder for accomplishment in the Port of San Diego, than the first 14 Calendar days will be accomplished pierside at NAVSTA 32nd Street prior to movement of the ship and berthing barge to the contractors facility?

Concur with Contractor's assumption.

On page 7 of 228 the RFP states, NOTE E: SPECIAL AGREEMENT FOR CHANGES WITH A PRICE OF $25,000 OR LESS

To make administration of small dollar value growth more efficient and less costly, both parties (Government and Contractor) agree to a pre-priced value for individual growth items with an estimated price of $25,000 or less. The Contract will include a firm fixed price for growth valued at $25,000.00 or less. Zero-dollar changes and administrative contract changes (for example, drawing revision change where no additional work is required) shall not be executed using the Small Dollar Value Growth procedures, but will follow the change process.

1) In NOTE e, will the Government clearly identify changes in drawings when they have determined that "no additional work is required"?

In accordance with Note E, paragraph 1, Drawing revisions where no additional work is required is defined as an administrative or zero dollar change. Each instance of these changes will be authorized/executed by the Administering Contracting Officer following the change process.
