SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

Response to Offeror’s Questions:

1) Question: Please clarify what it meant by “not a bona fide employee.” For example, would the employee of an engineering firm or of a business development firm who writes parts of the shipyard’s proposal under a consulting agreement with the shipyard be considered not a bona fide employee?

Answer: A bona fide employee is a person, employed by the Offeror and subject to the Offeror’s supervision and control as to time, place, and manner of perfromance. If an employee of an engineering or business development firm writes part of the Offeror’s (shipyard) proposal and that employee is NOT subject to the Offeror’s (shipyard) “supervision and control as to time, place, and manner of performance,” then the Offeror (shipyard) shall complete with the language under Section L-3 PROPOSAL PREPARATION INSTRUCTIONS paragraph 2 PROPOSAL

INSTRUCTIONS AND CONTENT (Phases I and II) which states “In the event that any portion of the proposal is written by anyone who is not a bona fide employee of the firm submitting the proposal, a certificiate to this effect shall be furnished that must be signed by an authorized official of the Offeror and shall indicate the person’s name, employment capactiy, firm name, relationship of that firm to the Offeror, and which portion of the proposal was written by that person.

2) Question: There seems to be a discrepancy between Sections C-3.1.500 and Section L-3

3regarding when to obtain the services of the Dive Air Consultant and when to provide their past performance information. Please clarify the timing of the consultant selection and issuance of their design approach and past performance information.

Answer: IAW Section C, the propulsion and SES SSVs are to be selected and services obtained by the second DR. The noise control and dive consultants are to be selected and services obtained by the first DR.

Section L, Phase I, Factor 3, paragraph 1 states "For the purposes of Past Performance, “major subcontractor” includes the design agent(s) if the Offeror is not itself the design agent, the proposed SSVs, and the proposed Noise Control and Dive Air Consultants." Section L, Phase I

Factor 3 paragraph 2 states "Offerors shall provide a description of past performance experience for themselves and any major subcontractors in design and/or construction on no more than four

(4) Offeror contracts/subcontracts and no more than two (2) subcontractor contracts/subcontracts within the last ten (10) years in the design and/or construction of ships similar in scope and complexity to the proposed NAV."

3) Question: Please confirm if any “Build USA” clause or “ registered small business reserved” clause will apply for this Solicitation.

Answer: Section I includes the clause 252.225-7001 Buy American and Balance of Payments

Program which incorporates 41 U.S.C. 8302, The Buy American Act. A large business Offeror will have comply with clause 52.219-9 SMALL BUSINESS SUBCONTRACTING PLAN

(DEVIATION 2016-O0009) (JAN 2017).
