SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

Responses to Offerors’ Questions:

1. QUESTION: The 10 U.S. Code § 2534 and/or the DFARS 225-70 prohibits the acquisition of the following items unless they are manufactured in the United States:

a. Pumps

b. Powered and non-powered valves in Federal Supply Classes 4810 and 4820 used in piping for naval surface ships and submarines

c. Ball and roller bearings

Does this restriction apply to all such components, including those that are installed into larger assembled components, or does it apply only to free standing components that are not part of a larger assembly? For example, hydraulic power pack assemblies that support steering, controllable pitch propeller, bow thruster or other systems are an assembly of smaller items that will include pumps, valves and electric motors which in turn will contain ball or roller bearings. Similarly, the main propulsion diesel will also have “on engine” attached pumps and valves.

RESPONSE: As stated in Section L of the solicitation, the Contracting Officer has determined that the T- ATS is a commercial item under FAR Part 12. Because the T-ATS is considered to be a commercial item, this affects the application of the domestic source restrictions contained in DFARS 225.70

AUTHORIZATION ACTS, APPROPRIATIONS ACTS, AND OTHER STATUTORY RESTRICTIONS

ON FOREIGN ACQUISITION and DFARS 225.71 OTHER RESTRICTIONS ON FOREIGN

ACQUISITIONS

Offerors should be aware that 10 U.S.C. 2534 applies to this contract. However, Offerors are further advised to review DFARS 212.504 which identifies certain laws that are not applicable to subcontracts for commercial items; Offerors should be aware that 10 U.S.C. 2534 is included in this list.

Regarding the part of your question on pumps, if the Contractor subcontracts for commercial pumps or commercial items containing pumps for the T-ATS, the domestic source requirements for pumps in 10 U.S.C. 2534 are not applicable to those commercial pumps or commercial items containing items containing pumps. If the Contractor subcontracts for non-commercial pumps or non-commercial items containing pumps, those pumps must meet the domestic source requirements.

Regarding the part of your question on powered and non-powered valves in Federal Supply Classes 4810 and 4820 used in piping for naval surface ships and submarines, this limitation ceased to be effective on October 1, 1996 as stated in 10 U.S.C. 2534

Regarding the part of your question on ball and roller bearings, because this solicitation is acquiring T-ATS ships as the end item and the T-ATS ships are commercial items, there is no domestic source restriction for ball and roller bearings.

2. QUESTION: The 10 U.S. Code § 2534 and/or the DFARS 225-70 prohibits the acquisition of the following items unless they are manufactured in the United States:

a. Steering controls

N00024-17-R-2207

b. Propulsion and Machinery controls

Does this restriction mean that all aspects of these control systems must be manufactured in the United States, or will it allow for system component to come from foreign sources provided that the integration, assembly and software is US sourced?

RESPONSE: See the response to Question #1. If the Contractor subcontracts for commercial steering controls or propulsion and machinery controls for the T-ATS, the domestic source restrictions in 10 USC 2534 are not applicable to those subcontracts. If the Contractor subcontracts for non-commercial steering controls or propulsion and machinery controls, those controls must meet the domestic source requirements.

3. QUESTION: The RFP requires air circuit breakers to be manufactured in the US, Canada, or the UK. Does this apply to commercial air circuit breakers?

RESPONSE: Yes, this domestic source requirement applies to air circuit breakers regardless of whether the air circuit breaker is commercial-grade or military-grade. As required by the clause entitled 252.225- 7037 EVALUATION OF OFFERS FOR AIR CIRCUIT BREAKERS (JUN 2005), the offeror shall specify, in its offer, any intent to furnish air circuit breakers that are not manufactured in the United States or its outlying areas, Canada, or the United Kingdom.
