QUESTIONS AND ANSWERS #2 (revised response) and #5-#9
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
2. Q: A normal workday includes a 30 minute lunch and a 15 minute break in the morning and one in the afternoon.
Please clarify your intention and/or modify the language in this paragraph to allow for the DOL mandated breaks.
A: (REVISED RESPONSE) IAW Department of Labor: Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks as compensable work hours that would be included in the sum of hours worked during the work week and considered in determining if overtime was worked.
Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, so long as the employee is completely removed from duty for the purpose of eating a meal, are not considered work time and are not compensable.
See Amendment 0002 for revision to Section C.3.2 of the solicitation, which will be changed from "a normal workday shall be eight (8) hours long, not including lunch or breaks," to “a normal workday shall be eight (8) hours long, not including lunch.” This does not preclude the worker from taking a bona fide lunch period, but such time shall not be considered work time and is not compensable.
5. Q: The requirement for all indirect rates to be ceiling will carry increased risk, especially for the Fringe Rate. While G&A and Overhead are costs a company can control, the Fringe includes components (medical cost, tax ) with higher volatility, not in our control. By fixing all indirect rates, the contract type is moving towards a fixed price type.
Contractors responding to a virtually “fixed price” requirement will be forced into providing a cost proposal that protects from the increased risk. Please reconsider the RFP ceiling requirement for the Fringe Rate.
A: The requirement for Ceiling Rates has been removed from Section L. See Amendment 0002.
6. Q: Does the Government require the contractor to carry insurance for government property?
A: The Government clarifies that the contractor will be required to have insurance for Government vehicles provided.
See Amendment 0002, Section H – INSURANCE LANGUAGE for additional guidance.
7. Q: There are a couple of discrepancies between the Labor Categories listed on page 21 of the RFP – Level of Effort -and Attachment 21. Please clarify.
Machinist/Mechanic (RFP) vs. Marine Mechanic (Attachment 21)
Shipfitter/Welder (RFP) vs. Welder (Attachment 21)
A: The Government clarifies that the labor categories identified in the solicitation are correct. Attachment 21 is revised and provided via Amendment 0002.
8. Q: What is the smallest font size allowed for call-out boxes, charts, etc. to be used in Volume I.?
NAVAL SEA SYSTEMS COMMAND

A: The Government clarifies that the smallest font size allowed for call-out boxes, charts, etc. to be used in Volume I is
10-point font; however, IAW the Section L of the solicitation, the narrative shall be no smaller than 12-point font.
9. In Attachment 21, the G&A formula provided by the Government does not capture Subcontractor and ODC costs. The calculation should include these costs as well, in addition to the Labor, Fringe and Overhead costs. This inaccuracy is present in all sheets. (For example cell D61 in the Base-Philly tab).
A: The instructions under the General Tab state "Offerors may only change formulas to appropriately apply indirect rates according to its cost accounting standard. The allocation must be identified in the "Labor&Ind Rates" tab." Thus the G&A formula can be changed to account for other costs or additional lines can be added under D61 where it states
"Insert line(s) & titles for any other G&A rates.
