SECTION SF 30 BLOCK 14 CONTINUATION PAGE
The following items are applicable to this amendment:
1. The Contract Specialist, Ms. Tara Borntreger, may not be available from January 1, 2014 through the proposal due date of January 10, 2014. Therefore, all correspondence relative to solicitation N00024-14-R-4200 shall also be copied to the Contracting Officer, Mr. Timothy Starker, at timothy.starker@navy.mil or at TEL: (202) 781-3944.
2. Under Section C - Descriptions and Specifications, the following paragraphs have been modified:
1.1.1 PROGRAM PLAN: The Contractor shall develop and maintain a Program Plan. The Program Plan shall be based on the Integrated Management Plan from the Contractor’s proposal. The Program Plan shall include an event-based Integrated Master Schedule (IMS), reflecting how the effort will be executed, including timing of reviews.
The IMS shall be developed in a manner that reflects the Contractor’s customary way of organizing projects and logically network detailed program activities. The schedule IMS shall contain the planned events and milestones, accomplishments, exit criteria, and activities from contract award to the completion of the contract. The Contractor shall quantify risk in hours, days, or weeks of delay and provide optimistic, pessimistic, and most likely duration for each IMS activity and event. The schedule IMS shall be maintained updated and made available to the Navy electronically on a monthly basis during the execution of the effort, in both native and PDF formats on the iNAVSEA IDE. The IMS shall be provided initially as part of the Program Plan and shall be updated as an appendix to the Progress Reports. The IMS approved with the Program Plan shall be the baseline. All Progress Reports and all other schedule updates will be compared against this baseline. The Contractor shall ensure schedule integration with its subcontractors and shall verify/ensure the validity of the subcontractor’s schedule data, including demonstrating effective methods for incorporating schedule data from subcontractors into the Contractor’s IMS.
When subcontractor schedule data reflects a different status date than the prime contractor’s schedule status date, these status dates shall be described in the Progress Report. The IMS shall be statused according to the Contractor’s management control system. The schedule shall contain the contract milestones, accomplishments, and discrete tasks/activities (including planning packages where applicable) from contract award to the completion of the contract. The schedule shall be an integrated, logical network-based schedule that correlates to the contract Work Breakdown Structure (WBS). The IMS shall show relationships and dependency, which identify how predecessor and successor tasks/activities and milestones are logically linked. Key external dependencies shall also be shown.
The IMS shall be in a software package that enables capture of a baseline schedule and schedule changes over the course of time. The Contractor shall identify for Navy review the most critical milestones that are associated with significant program events and that interface to Navy activities. Upon approval of these most critical milestones by the Navy, the dates for these milestone shall not be changed in the IMS without the approval of the Navy. These most critical milestones shall be the basis for the schedule risk assessment and monthly reviews with the Navy. The data management program, including Contractor IDE structure, format, processes, and procedures, shall be documented as part of the contract Program Plan. The list of components comprising the LLTM (Section J Attachment I to this contract) shall also be included as part of the contract Program Plan. The Contractor shall detail in the Program Plan the steps taken to identify the second source described in CLIN 0018 and the process for enabling independent development of the power electronics Line Replaceable Units (LRUs).
1.1.1.2 RISK: The Contractor shall assess and track potential risks associated with achievement of technical and schedule requirements and define methods or alternatives to mitigate or minimize these risks, including the identification of criteria upon which decisions can be based. The Contractor shall maintain a risk management program to assess risks associated with achievement of technical and schedule requirements. This risk management program shall be documented in the SEMP. Specific risk management functions shall include identifying known and potential risks; assessing risks, including a relative ranking by program impact and the establishment of critical thresholds; defining methods or alternatives to mitigate or minimize these risks, including the identification of criteria upon which programmatic decisions can be based, and conducting a Schedule Risk Assessment (SRA) and a critical path analysis. The SRA shall indicate the best case, worst case, and most likely estimate of schedule performance for those items identified in the Program Plan as most critical milestones. The risk management program shall include the Information Assurance (IA) risk assessment artifacts in accordance with NAVSEA Instruction 9400.2. Plans for addressing parts obsolescence shall be included in the Program Plan. The Contractor shall identify and mitigate the risk of component obsolescence, and shall plan a technology refresh/insertion program.
1.1.2 PROGRESS REPORTS: The Contractor shall submit monthly Progress Reports that reflect the technical and schedule status of the effort. A copy of the invoices submitted shall be appended to the Progress Report (the invoices shall identify names, labor categories, hours, and rates for labor associated with CLIN 0006 and CLIN 0007 conducted during the period). The Progress Report shall include a monthly spend plan for Time and Materials CLINs on the contract showing the expenditures predicted throughout the period of performance. The Contractor shall also provide by secure electronic mail a short “weekly highlights” by close of business on Thursdays to provide a snapshot of the technical progress or performance issues to the Navy on a more immediate basis. The Progress Report shall contain the following information:
Planned efforts: The Contractor shall provide a copy of the schedule IMS established in the Program Plan that has been updated to reflect changes to planned tasks/milestones. The Contractor shall note significant accomplishments and identification of major problems/deficiencies with impact and recommended solutions.
Actual efforts: The Contractor shall have an updated schedule IMS to reflect work performed during the current reporting period. The Contractor shall maintain one schedule IMS that will be updated monthly for both planned and actual efforts. The IMS shall include a percent complete (the proportion of an activity or task that has been completed to time now) for each element. The Contractor shall detail work performed by WBS during the current reporting period and include an overall status of each milestone, task, or unit of work. The Contractor shall document significant results of conferences, trips, or directives from the Government’s representatives. The Contractor shall maintain an action list for programmatic and technical items that arise during the course of the effort and a status of deliverable items.
Future efforts: The Contractor should identify any technical risks/challenges or problems anticipated in the next reporting period. The Contractor shall provide a brief description of the work envisioned for the ensuing reporting period by WBS, highlighting any changes to the schedule IMS and the objectives of those efforts.
3.0 SCOPE: The Contractor shall fabricate, assemble, and conduct integration testing prior to delivery, of a fully integrated Arleigh Burke Class Destroyer (DDG 51) AMDR PCM ship set comprised of two PCMs suitable for forward fit onto Flight III new construction ships which meets the performance requirements specified in the Technical Performance Specification for DDG 51 AMDR Power Conversion Module and the design completed and approved from CLIN 0001. One of the two PCMs that comprise the AMDR PCM ship set (designated PCM #1) shall be delivered to Navy PHIL/CHIL test site to undergo PHIL testing in accordance with tasking provided under CLIN 0006. One of the two PCMs that comprise the AMDR PCM ship set (designated PCM #2) shall undergo environmental qualification testing described in detail under CLIN 0005. Where disagreement occurs between the referenced Technical Performance Specifications, the Technical Performance Specification for DDG 51 Class AMDR Power Conversion Module shall take precedence. The Contractor shall perform verification that the AMDR PCM performance meets the physical, functional and performance requirements specified in the Technical Performance Specification for DDG 51 Class AMDR Power Conversion Module and provide sufficient information for integration of the AMDR PCM into the Navy test sites. Details of the notional testing steps and LRIP and Production schedules are contained in AMDR PCM Delivery, Government Testing, and Ship Construction Timeline (Attachment J), which assumes options are exercised in a sequential manner. The Contractor shall conduct readiness reviews prior to the inception of fabrication to demonstrate the maturity of the design and the availability of facilities to successfully complete the fabrication process and also prior to conduct of any testing of the manufactured items. The Contractor shall provide services, materials, facilities and personnel necessary to perform the tasks identified below.
5.3 Following testing and refurbishment (if refurbishment is necessary, the refurbishment shall be conducted as part of CLIN 0006 as indicated in paragraph 6.3 below), the Contractor shall ship deliver, with all transportation charges prepaid as part of CLIN 0003, the AMDR PCM #2 hardware to AMDR land based test sites at the Surface Combat Systems Center (SCSC), Wallops Island, VA.
3. Under Section F - Deliveries or Performance, the following has been modified:
The Government requires delivery to be made according to the following schedule:
Item Date 0003 Hardware (with the exception of PCM #2 destined for testing under CLIN 0005) shall be delivered within 12 months after exercise of option, commissioning support shall be completed within 6 months after hardware delivery. PCM #2 shall be delivered within 1 month after CLIN 0005 Environmental Qualification Testing and CLIN 0006 refurbishment is complete or within 1 month after the Navy has provided written notice that the option to perform CLIN 0005 will not be exercised.
4. Under Section I - Contract Clauses, the following has been modified:
CLAUSES INCORPORATED BY FULL TEXT
52.209-3 FIRST ARTICLE APPROVAL -- CONTRACTOR TESTING (SEP 1989) - ALTERNATE II (SEP 1989)
[Contracting Officer shall insert details]
(a) The Contractor shall test 4 unit(s) of Lot/Item 0003 and 0004 as specified in this contract. At least 30 calendar days before the beginning of first article tests, the Contractor shall notify the Contracting Officer, in writing, of the time and location of the testing so that the Government may witness the tests.
(b) The Contractor shall submit the first article test report within (to be filled in at contract award) calendar days from the date of this contract to Adam Goldberg, PMS 320, 1333 Isaac Hull Ave SE Stop 2203, Washington Navy Yard, DC 20376-2203 [insert address of the Government activity to receive the report] marked "FIRST ARTICLE TEST REPORT: Contract No. (to be filled in at contract award) , Lot/Item No. (to be filled in at contract award) " Within 30 calendar days after the Government receives the test report, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.
(c) If the first article is disapproved, the Contractor, upon Government request, shall repeat any or all first article tests. After each request for additional tests, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall then conduct the tests and deliver another report to the Government under the terms and conditions and within the time specified by the Government. The Government shall take action on this report within the time specified in paragraph
(b) above. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule, or for any additional costs to the Government related to these tests.
(d) If the Contractor fails to deliver any first article report on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.
(e) Unless otherwise provided in the contract, and if the approved first article is not consumed or destroyed in testing, the Contractor may deliver the approved first article as part of the contract quantity if it meets all contract requirements for acceptance.

Until first article approval is granted, only costs for the first article and costs incurred under this authorization are allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government. If first article tests reveal deviations from contract requirements, the Contractor shall, at the location designated by the Government, make the required changes or replace all items produced under this contract at no change in the contract price.
(h) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. The offeror/contractor may request a waiver.
(End of clause)
5. The following questions are answered relative to Solicitation N00024-14-R-4200:
Question 30:
In the solicitation Section E Inspection and Acceptance, all supplies and services for all CLINs except 0002, 0004, 0005, 0006, and 0007 will be inspected/accepted by the Government at the Origin and provides the citation of FAR clause 52.246-2, Inspection Of Supplies--Fixed Price. Since DCMA interpretation of inspection oversight varies based on the local surveillance plan, please advise if the inspection location/acceptance can be modified as follows:
a. Supplier having Class II authority for drawings and for hardware under Material Review Board (Classification is as defined in the PMS 320 Systems Engineering Master Strategy Paragraph 5.1.4)
b. For CLINs 0001, 0003, 0004, 0005, 0018, and 0019 request inspection/acceptance shall be made at “Destination” by COR on design/documentation items and at “source” on appropriate hardware at final assembled shipment state only.
c. For CLIN 0003, 0004, and 0005 test program, request that inspection/acceptance be at “Destination” for testing and approved by COR after review of test results submitted in CDRL test reports and testing oversight by Navy program personnel.
Answer 30:
The requirements for inspection and acceptance remain as stated in the solicitation. To ensure consistency of quality standards in the design and fabrication of the AMDR PCM hardware, appropriate DCMA oversight tailored to the particular offeror location has been imposed.
Question 31:
In solicitation Section F - Deliveries or Performance and FAR 52.217-7 OPTION FOR INCREASED QUANTITY-- SEPARATELY PRICED LINE ITEM, please advise if it is the Navy’s intent to award options such that the entire program (for whatever CLINs are awarded) is contiguous and not interrupted by a significant time gap (greater than
3 months). Since this is a FFP proposal, a stop and delayed restart may have significant resource assignment implications and therefore impact costs and schedule.
Answer 31:
The period of performance of each CLIN is as specified in Section F - Deliveries or Performance and the Latest Option Exercise Dates as specified in FAR 52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM remain unchanged. Offerors shall not presume an earlier exercise date than specified, but an earlier exercise of any option may be possible, at the discretion of the Government. Provisions are made in the DETERMINATION OF PERFORMANCE INCENTIVE clause for any prolonged timeframe between option exercise and prior CLIN completion.
Question 32:
In solicitation Section F - Deliveries or Performance, delivery of PCM #1 is shown as being delivered to Florida State University - Center for Advanced Power Systems at the conclusion of CLIN 0003 and PCM #2 being shipped to Surface Combat Systems Center, Wallops Island. Since PCM #2 unit will need to be refurbished subsequent to Environmental Qualification Testing of CLIN 0005, shipment to the selected test site would not reasonably occur under CLIN 0003 as stated in SOW (“Item 0003. If options exercised shall be delivered with all transportation charges prepaid…), which has only a 12 month period of performance. Can PCM #1 and PCM #2 be shipped under CLIN 0006 as identified in paragraph 5.3.
Answer 32:
No. Delivery of PCM #1 and PCM #2, both fabricated and assembled under CLIN 0003, have been clarified by this Amendment.
Question 33:
In Amendment 0002, Answer #8 identified RDD2 as 44 months after contract award based on 12 months for CLIN 0001, 12 months for CLIN 0003, 6 months for CLIN 0005 and 14 months for CLIN 0009. In the solicitation SOW, page 18, Section B, Note C states “…CLINs 0009 through 0015 will not be exercised unless the required LLTM for the quantities ordered are available (as initially populated by CLIN 0008)…. The exercise of SLIN 0008AA will occur no less than 90 days prior to the exercise of CLIN 0009 option.” Can the calculation for RDD2 be modified to accommodate the 6 months for CLIN 0008AA LLTM material to be available after completion of CLIN 0005 and prior to award of option CLIN 0009?
Answer 33:
No. The intent is for the long lead time materials required by CLIN 0008AA in support of CLIN 0009 to be procured in parallel with the testing conducted under CLIN 0005. Risks associated with the overlap shall be mitigated by analysis activities conducted under CLIN 0001 and shall be documented as part of the Request for Approval to Procure Long Lead Time Materials (LLTM) required under Section C paragraph 1.1.3.3.1 of the solicitation. Solicitation Attachment I Identification of Long Lead Time Materials shall include the estimated lead time in terms of months before the exercise of CLIN 0009 for each item as required in Section L of the solicitation.
Question 34:
Under Section I Clause FAR 52.209-3 First Article Approval, Sub-paragraph a) identifies one “1” first article unit of Lot 0001, 0003, 0004, 0005. Attachment C, Technical Performance Specification for the Power Conversion Module (PCM) 4160 VAC To 1000 VDC Supplying Air and Missile Defense Radar (AMDR), in paragraph 4.1 it identifies First Article units that will be used to verify Table X Verification Matrix requirements. The amount and duration of tests would necessitate all four LRIP units be First Article Units to test all requirements listed. Will the Navy modify paragraph a) to list “4” units of Lot 0001, 0003, 0004, 0005?
Answer 34:
Yes, Section I Clause FAR 52.209-3 First Article Approval is modified by this Amendment.
6. Except as amended herein, all other terms and conditions of this solicitation remain unchanged.
