Section L - Instructions, Conditions and Notices to Bidders

GENERAL INSTRUCTIONS

L-1. NOTICE TO OFFERORS

A. Funds are not currently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation either before or after the closing date for receipt of proposals. The Government has no obligation to reimburse an offeror for any proposal costs.

B. This acquisition will utilize the Lowest Price Technically Acceptable (LPTA) source selection procedure in accordance with FAR 15.101-2 and 15.3 as supplemented by the DoD Source Selection Procedures referenced in DFARS 215.300 to make an integrated assessment for a best value award decision. The Government intends to award one contract, Repair Roof & Upgrade UPS/HVAC System B328, as a result of this solicitation. A decision on the technical acceptability of each offeror's proposal will be made. Among those offerors who are determined to be technically acceptable, award will be made to the offeror having the lowest total evaluated price.

C. The following instructions cover the preparation and submittal of the offeror's proposal for this solicitation.

Offerors must follow the instructions contained herein. Offerors are cautioned that any noncompliance with the terms and conditions of the RFP may cause their proposal to be determined to be unacceptable and therefore not considered eligible for award. Offerors shall submit only one proposal for the Repair Roof & Upgrade UPS /HVAC , as the Government will review only one proposal per offeror.

D. Exchanges of source selection information of the initial proposal package and subsequent information between the Government and offerors will be controlled by the Contracting Officer. Email may be used to

FA309920R00080001

transmit such information only if the email can be sent encrypted, and must include "Source Selection Information - See FAR 2.101 and 3.104" in the subject line of the email. Otherwise, source selection information will be transmitted via direct mailing. In order to facilitate the sending and receiving of encrypted emails, offerors must use MS Outlook email configured to support encryption or a different email product that is S/MIME compatible and configured to support encryption. If you intend to submit your proposal via encrypted email, you will need to contact the Buyer/Contracting Officer indicated on the face page of the solicitation prior to that first submittal in order to exchange certificates used for encryption. To ensure the process is working correctly, send a test encrypted message first (without including any source selection information). Otherwise, source selection information will be transmitted via direct mailing or DoD Secure Access File Exchange (SAFE) at https://safe.apps.mil/. The contractor will need to "Request a Drop-off" from the Buyer/Contracting Officer.

L-2. PROPOSAL PREPARATION INSTRUCTIONS

A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, proposal submittal instructions and representations and certifications. Failure to meet a requirement may result in an offer being ineligible for award. An exception to the solicitation terms and conditions may result in the offeror being determined non-responsive to the solicitation. Offerors must clearly identify any exception to the solicitation terms and conditions and shall submit complete accompanying rationale no later than 5 business days after RFP release.

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit cost data to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price

C. The response shall consist of three (3) separate documents, Part I - Price Proposal, Part II - Technical Proposal, and Part III - Past Performance Information.
