About this file

This document is an attachment to a Request for Proposal (RFP) issued by the Kentucky Transportation Cabinet (KYTC) on May 29th, 2026, for implementation of the National Electric Vehicle Infrastructure (NEVI) Program in Kentucky. The attachment provides templates for Site Host Owner Letters of Intent that proposers must submit as part of their proposals. Template A applies when the proposer is not the property owner, while Template B applies when the proposer owns the proposed project site. Both templates require documentation of site control, either through recorded deed proof of ownership or a lease agreement with specified effective dates, terms, renewal periods, and executed signature blocks. The letter serves as a Right to Enter for KYTC and its agents to conduct field studies and NEPA-related inspections effective from the letter's date.

Upon conditional notification of intent to award by KYTC, the Site Host Owner and Proposer must execute a Site Host Agreement committing the project site for the entire Project Agreement term of approximately 5-7 years to study, acquire, construct, install, operate, and maintain an EV charging station for no less than 5 years in accordance with 23 CFR 680 and applicable laws. The proposed charging equipment must be publicly accessible 24 hours a day, 7 days a week throughout the year for the life of the Project Agreement, with KYTC maintaining continuous access for inspection and monitoring. The templates include signature blocks for authorized representatives from both the proposer and site host owner, along with required enclosures for proof of ownership documentation. In the event of default by either party that prevents continuation or operation of the EV charging station during the Project Agreement term, the provisions of Section 14 of the Project Agreement shall apply.
