About this file

This is a Living Wage Submittal document issued by the City of Austin, Texas, applicable to the Total Waste Management Services contract. The document establishes mandatory living wage compliance requirements for all contractors and subcontractors directly assigned to City of Austin contracts under Rule R161-17.14. Contractors must certify that all employees and subcontractor personnel assigned to the contract will be compensated at or above the minimum living wage rate of $22.05 per hour. Within 30 days of contract execution, contractors must provide individual employee certifications for all assigned personnel, with annual recertification required on the contract anniversary date. The City Contract Manager reserves the right to periodically review employee records and wage data throughout the contract term to verify ongoing compliance with living wage provisions.

Contractors submitting offers on this contract must provide a comprehensive certification listing all employees and subcontractors directly assigned to the work, including their names, job titles, and current wage rates. The certification process requires contractors to maintain basic employment and wage information consistent with Fair Labor Standards Act requirements and to report any employee changes as they occur. Violations of the living wage provision, including willful or repeated breaches or fraudulent statements on certifications, may result in contract termination for cause, suspension or debarment of the violating firm, legal action, and requirement to pay affected employees the full amount of wage deficiencies for each day the violation continues. Contractors are prohibited from retaliating against employees who report non-compliance with living wage requirements.
