About this file

This is an Insurance Requirements Attachment document for the City of Austin, Texas, related to an Invitation for Bid (IFB) for Industrial Gases and Cylinders. The document establishes comprehensive insurance requirements that contractors must maintain throughout the contract term. Contractors are required to provide a Certificate of Insurance to the City prior to contract execution and within 14 calendar days of written request, with failure to provide documentation resulting in offer disqualification. The contractor must not commence work until required insurance is obtained and reviewed by the City. All insurance must be provided by companies authorized to do business in Texas with an A.M. Best rating of B+VII or better. The City reserves the right to review and adjust insurance requirements during the contract's effective period based on changes in exposure, statutory law, or other relevant factors.

The specific insurance coverage requirements include Workers' Compensation Employer's Liability Insurance with minimum limits of $1,000,000 per occurrence for bodily injury; Commercial General Liability Insurance with limits of $1,000,000 per occurrence and $2,000,000 aggregate; Business Automobile Liability Insurance with $1,000,000 combined single limit; and Umbrella/Excess Liability Insurance with minimum limits of $5,000,000 per occurrence and aggregate. The City must be named as an additional insured on all policies except workers' compensation and professional liability coverage. All policies must include waivers of subrogation, primary and non-contributory endorsements, severability of interests provisions, and provide the City with a minimum of 30 days advance written notice of cancellation. Contractors are responsible for all premiums, deductibles, and self-insured retentions, with any self-insured retentions exceeding $499,999 requiring disclosure on the Certificate of Insurance. Claims-made policies must have a retroactive date prior to or coincident with the contract date and provide continuous coverage for 24 months following contract completion. All subcontractors must maintain equivalent insurance coverage with similar endorsements in favor of the City.
