H-1. GENERAL. Prior to performance of any services hereunder, the contractor shall, at its own expense, procure and maintain during the entire performance period of this contract, with financially and legally responsible insurance company or companies, passenger and public liability insurance in accordance with paragraph H.1.1 or H.1.2.

Liability insurance purchased pursuant to the requirements of this paragraph shall cover payment to the Government, pursuant to the subrogation provision of the Medical Care Recovery Act (42 USC 2651) and within the liability limitations of this contract, of the cost of Government provided medical care to the extent that said insurance would cover payment to injured individuals of the cost of medical care in the absence of any Government obligation to provide medical care. For damages arising from injuries or death (taking place on board the aircraft or during the course of any aircraft operation, including embarking or disembarking) not exceeding $150,000 for each passenger, the carrier shall not be able to exclude or limit its liability, unless the damages were a result of an injury or death resulting from an act of war as defined in this contract. The contractor shall furnish to the Contracting Officer Evidence of Insurance, duly executed by the Insurer, of the insurance required by this paragraph. The Evidence of Insurance shall substantially conform to the form set forth in paragraph H.2. Nothing herein shall be deemed to affect the rights and liabilities of the contractor with regard to any claim brought by, on behalf of, or in respect of any person who has willfully caused damage which resulted in death, wounding, or other bodily injury of a passenger.

H-1.1. Split Limits Liability. The minimum limits of liability insurance coverage maintained by the contractor, as required by 14 Code of Federal Regulations (CFR) 205, shall be as follows:

H-1.2. Combined Single Limit Liability.

H-1.2.1. Notwithstanding the provisions of paragraph H-1.1. above, the contractor may be insured for a single limit of liability for each occurrence. In that event, coverage shall be equal to or greater than the combined required minimums set forth in paragraph H-1.1. above, for bodily injury, property damage, and/or passenger liability for the type of use to which such aircraft is put, as the case may be.

Operators of all proposed aircraft must (1) be on the DoD Approved Air Carrier Listing maintained by US Air Force, Headquarters Air Mobility Command (AMC/A3B), by the solicitation closing date, and not in a suspended or temporary non-use status at the time of proposal submission. Air carriers from Federal Aviation Administration rated Category 2 countries are not eligible for award as the Civil Aviation Authority from those countries have been determined to not comply with International Civil Aviation Organization (ICAO) standards.

ii. Subfactor 2 – Continuous Equivalent Service: (No Page Limit.) Offeror must have at least 12 months of prior continuous equivalent service for each aircraft type proposed. In accordance with 32 CFR 861, “Equivalent to the services sought by DoD” means service offered to qualify for DoD approval must be substantially equivalent to the type of service sought by DoD. “Continuous” service means the air carrier must have performed revenue-generating services of the nature for which DoD approval is sought. Offerors shall describe how they performed continuous services internationally in an environment similar to that in the Philippines by completing the information in Attachment 5, paragraph 3.

iii. Subfactor 3 – FAA and CAA Certification Documentation: (No Page Limit.)

All proposed aircraft owned by the air carrier shall be on its Operations Specification at the time of proposal submission to demonstrate the capability of providing the services. For US Flag carriers, the Government will retrieve this information from the FAA for verification. For Foreign Flag carriers, Offerors shall submit the following CAA certification documentation that is equivalent to 14 CFR Part 135 documentation:

(A) Operating Certificate,

(B) Operations Specifications Sections A and D,

(C) The applicable Flight Standards Office, as well as the point of contact to include phone number and email address.

Each foreign flag aircraft offered shall be listed in the Operations

Specification equivalent. In addition, if the aircraft has been modified, the Offeror shall provide the description of the Supplemental Type Certificate approved by or Civil Aviation Authority (CAA) and what, if any, additional capabilities are achieved with the modification.

iv. Subfactor 4 – Aircraft Operation and Control: (No Page Limit.) The Offeror shall be a DoD Approved Air Carrier. The Offeror shall identify on RFP Attachment 5 whether the aircraft are owned or leased by it or the proposed subcontracted air carrier. The Offeror shall provide proof the proposed air carrier owns or will lease the proposed aircraft identified on the Aircraft Identification Table, RFP Attachment 3. Examples of proof include a letter of intent to sell or purchase the aircraft, or an option to lease or purchase. The Offeror shall confirm, on Attachment 5, it will (1) operate its proposed aircraft,

(2) have access to commit, task, and employ the proposed subcontracted aircraft throughout the period of performance, and (3) response must be consistent with other documents submitted with the proposal. In addition, the Offeror shall submit a signed agreement(s) between it and each proposed subcontracted air carrier where the air carrier confirms it will operate its proposed aircraft and that each proposed aircraft will be available for the contract period of performance, should the Government make an award to the offeror. In the case of a lease agreement, the agreement must be current, binding upon both parties if the offeror is awarded a contract, and demonstrate the offeror’s ability to provide aircraft for the entire contract period of performance.

v. Subfactor 5 – Fly America Act Preference: On RFP Attachment 5, the Offeror shall identify the Fly America Act participant category of it and each proposed subcontracted air carrier. Fly America Act participant categories will be assigned as follows:
