QUESTIONS 26 - 28

QUESTION NO.
REFERENCE
QUESTION
RESPONSE
26
Proposal Instructions, Section (2) Part II Basic Eligibility, PWS Page 44 of 54.

States “Offeror must have at least 12 months of prior equivalent service for each aircraft type proposed.”

Question 1 - In an example teaming arrangement of Prime and a Subcontractor, is it a requirement for both the Prime and subcontractor to maintain the 12 months of prior continuous equivalent service or can one teaming partner meet this basic eligibility requirement to be found acceptable in the evaluation?

Question 2 - In the Offeror providing 12 months of prior continuous equivalent service for each aircraft type proposed in Attachment 5, Paragraph 3. What is the Government’s definition of type of aircraft proposed? For example, the type of Fixed Wing (CASA-212) and the type of Rotary Wing (Sikorsky S61N) proposed both showing 12 months of prior continuous equivalent service.

Question 3 – In a Prime and Subcontractor teaming arrangement, are both team members required to complete Attachment 5, Paragraph 3?

Question 4 - If a prime contractor meets the basic eligibility for providing 12 months of prior continuous equivalent service for each aircraft type proposed in Attachment 5, Paragraph 3. Would the Government be amendable to removing or tailoring the 12 months of prior continuous equivalent service for subcontractors to allow for greater competition?

Response 1 - Yes. Experience from one certificate cannot be extended to another certificate, the CARB views each certificate separately. Each certificate performing a service must have 12 months prior continuous experience. Either a prime or sub not having 12 months prior experience IAW 32 CFR 861 would be found unacceptable.

Response 2 - Type refers to a specific make and basic model of aircraft. Also includes similar in design.

Response 3 – No, however all proposed aircraft shall be listed in the attachment.

Response 4 - No, to meet 32 CFR 861 requirements and be CARB approved, each certificate holder will need to possess their own equivalent service.

Section M, Page 48 of 54, Paragraph M-1.3 (Evaluation: Award Eligibility)
In order to be evaluated as a Small Business which ‘conform(s) to the required terms and conditions’, regarding a Small Business Prime subcontracting a Large Business for a portion of the work, and the related requirement for >50% of labor to be provided by the Small Business, is the percentage determined based on FTE Head Count or Labor Revenue?
See answer to question no. 6 posted on 15 June 2018.

Attachment 5, Paragraph 3
Please confirm that if an offeror is already CARB approved, the "Continuous Equivalent Service" (subfactor 2) basic eligibility requirement is superseded by the offeror's DoD Approval. Further, please confirm that the "12 months of continuous service equivalent to the service sought by DoD" is only relevant to carriers who do not currently possess CARB approval, per 32 CFR 861 (e)(1), which applies only to "U.S. and foreign air carriers applying for DoD approval in order to conduct air transportation services for or on behalf of DoD under a contract or agreement with DoD."
No, current CARB approval does not supersede a carriers obligation to maintain "continuous equivalent service." Not only is a carrier required to possess 12 months equivalent service prior to obtaining initial CARB approval, once approved by the CARB, if an air carrier fails to maintain continuous operations of the type for which approval was granted, it may be grounds for the CARB to place the carrier in nonuse or suspension. Or, the CARB could determine the carrier is not eligible for operations requiring that specific experience. Reference 32 CFR 861.4(e)(1)(iv).
