Proposals Overview
Written Proposals Volume I, Executed RFP Documents (Business Proposal) Complete all necessary fill-ins SF Form 1449 (e.g., Blocks 12, 17a, and 30a-c) Clause 52.212-3, Offeror Representations and Certifications Must be registered in System for Award Management(SAM) www.acquisition.gov
Written Proposals (continued) Volume II, Technical Proposal Subfactor 1, Small Business Subcontracting Plan Submit a Small Business Subcontracting Plan IAW FAR Part 19.7, FAR Clause 52.219-9, and DFARS Clause 252.219-7003. Pursuant to aforementioned clauses failure to submit a small business subcontracting plan shall make an offeror ineligible for award.
Subfactor 2, Information Assurance & Cyber Security Subfactor 3, Operation & Service DOD Statement of Intent (Appendix 5), Maintenance Survey Checklist (Appendix 6), and Air Carrier Preparation Checklist for Operations (Appendix 7) that accurately describes their service and operation.
Current DoD approved carriers shall submit Headquarters Air Mobility Command (AMC) Survey letter demonstrating compliance with DoD Commercial Air Transportation Quality and Safety Requirements.

Evaluation Process (continued) Options:
NTE rates will be effective for the base year and all options years Option prices will be adjusted in accordance with TRANSFAR 5552.216-9006 using GII Rates.
Option year prices, located at tabs “NTE Rates – Option Period 1,” “NTE Rates - Option Period 2,” and “NTE Rates – Option Period 3” will auto populate using the proposed base period NTE rates multiplied by the TRANSFARS EPA clause.
GII Rates will apply 100.77% for Option Period 1, 101.73% for Option Period 2, 102.18% for Option Period 3, and 102.63% for Option Period 4.
Allowable adjustments will be made upward or downward if the adjustment varies by more than 3%. The adjustment shall be based on the GII Pricing and Purchasing Industry.
Period of Performance:
Base year (two months) with four one-year option year periods.

Buying Process – FAA 135 Requirements
In accordance with FAR 12.206, use of past performance, including schedule reliability and discrepancy performance rates, will be used in every evaluation and task order award under the Domestic Charter Airlift Services contract. While price is approximately equal to the other factors combined, the Government reserves the right to award to other than the low-priced offeror when doing so is most advantageous to the Government.
Evaluation of offers will be conducted in accordance with FAR 15.101, Best Value Continuum. There may be instances where the Government may award to other than the lowest offeror.
Example: When the unit's critical element requires a specific travel schedule, and the lowest offeror cannot operate within the specified timeframe, the Government will award to a higher priced carrier for the unit to arrive at their destination within the specific timeframe requested in support of their mission.
If there are no offers on requirements from awardee(s) with a contracted NTE rate in their category of performance, the government reserves the right to solicit the requirements to all other awardees with a contract under this solicitation.

Buying Process – FAA 121 Requirements
Ref Solicitation HTC711-14-R-C003 Section IV Pricing Proposal sub (a) page 23; will the NTE also be applied to the ferry miles as with USTRANSCOM Expansion missions?
A: Carriers Not-to-Exceed Rate (NTE) should include all the miles to include ferry miles.
Will USTC define the specific terms (fuel price, ferry component, origin/destination, load factor, seasonality, etc.) under which NTE rates are to be established and provided?
A: USTC will not define specific terms. NTE rates need to include any factor the individual carrier would consider will fly at the individual mile segments. However, pegged fuel price $3.73 stated in TRANSFAR clause 5552.216-9001 should be used to determine the cost of fuel.
What is the logic of averaging two different aircraft type NTEs?
A: The averaging the type NTE rate for FAA Part 121 carrier will be used only to calculate a Total Evaluated Price(TEP). The average price is for evaluated purposes only.
If submitted rates are found to be Unfair and Unreasonable, will the carriers be afforded an opportunity to revisit rates and resubmit?
A: If NTE rate is considered unfair, unreasonable or unrealistic, and the government determines a competitive range and enters into discussions, at this point the offeror may have an opportunity to revise it pricing. Offeror should make its best price at the time of proposal. If the government receives enough offerors with fair, reasonable and realistic pricing and meets all the technical requirements and past performance criteria and the government does not go into discussions, all other carriers will not be afforded and opportunity to revise its prices or be eligible for award.
