Appendix 3 – Solicitation and Award Procedures for Full Plane Domestic Charter Airlift-FAA 121

HTC711-14-R-C003

15 October 2013

1. All multiple award contractors may respond to individual orders for airlift under the Domestic Charter Airlift Services Contract by submitting offers via GOPAX (Groups Operational Passenger System) at https://www.distribute.mil. Under special circumstances, offers may be accepted by fax or by e-mail. Telephonic offers will be accepted for acquisitions outside of normal business hours. Offerors must comply with all requirements contained in the individual orders. At a minimum, offerors responding to individual requirements should include the following information:

(a) Movement Request Number (MRN);

(b) Company two letter Identifier and authorized negotiator name;

(c) A description of aircraft being offered, to include: aircraft type, maximum payload, maximum seats, maximum number of passengers to be carried, route, period of performance (POP) and schedule. Also, include any special conditions or limitations, such as airfield hours and baggage restrictions;

(NOTE: The Contracting Officer may remove from award consideration any offer submitted with qualifications concerning unresolved crewing or aircraft availability, e.g. "offer pending crew availability” if deemed in the best interest of the Government not to delay the acquisition process pending resolution.)

(d) Price and price contingencies;

(e) Expiration date and time of the offer;

(f) Cubic feet available must be listed in the Carrier Comments

(g) Specific aircraft type must be listed in the Carrier Comments (i.e., B737-300, B737-700, etc.).

2. The offeror agrees to hold the prices in its offer firm until time of award unless another time period is specified in the offer.

Price changes may be negotiated prior to award.

3. Offerors are responsible for submitting offers under individual orders via GOPAX by the deadline date and time specified in the GOPAX solicitation in order for the offer to be considered.

4. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. This paragraph provides for offers to be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

5. The Government will award task orders resulting from individual solicitations issued under this contract to the eligible offeror(s) whose offer(s) will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: price, service capability and past performance. In accordance with FAR 12.206, use of past performance, including schedule reliability and discrepancy performance rates, will be used in every evaluation and task order award under the Domestic Charter Airlift Services contract. While price is approximately equal to the other factors combined, the Government reserves the right to award to other than the low-priced offeror when doing so is most advantageous to the Government. Each order will incorporate the terms and conditions of the Domestic Charter Airlift contract by reference.

The Government is obligated only to the extent of the authorized orders actually awarded under individual solicitations issued under this contract.

6. Evaluation of offers will be conducted in accordance with FAR 15.101, Best Value Continuum. There may be instances where the Government may award to other than the lowest offeror. For instance, when the unit's critical element requires a specific travel schedule, and the lowest offeror cannot operate within the specified timeframe, the Government will award to a higher priced carrier for the unit to arrive at their destination within the specific timeframe requested in support of their mission.

7. Requirements may be combined for offer or award purposes. Only offers for chartered air transportation will be awarded under this contract.

8. The Government's request for a Commercial Air Movement (CAM) Number shall indicate acceptance of an offer, if requested within the time for acceptance specified in the offer. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a notice of withdrawal is received before award.
