GENERAL REQUIREMENTS
(a) The contractor shall conduct the operation(s) under this contract in strict conformance with all FLETC, Federal, State and Local safety requirements and with all applicable provisions of 29 CFR 1910, 1925 and 1926 of the Occupational Safety and Health Act (OSHA), in addition to any additional precautions as the Contracting Officer may reasonably require for safety and accident prevention purposes while performing any work under this contract.
(b) The contractor shall be able to support the specific requirements of the FLETC Charleston Complex. These support requirements include, but are not limited to: weapon/ammunition inventory and security, Training Support, equipment issue/recovery, maintenance of the Heating, Ventilating and Air Conditioning (HVAC),air filtration system, target system, general maintenance & Janitorial services (FLETC-wide), Steam Systems, and also lead removal and lead janitorial services.
(c) Government-Required Training. The contractor shall, at no additional cost to the Government, make appropriate contract employees available for Government furnished safety and occupational training for an estimated two (2) to twenty (20) hours annually per employee. Government furnished training may include, but is not limited to: Property Management, Environmental Compliance, Hazardous Waste Management, Sexual Harassment, Forklift Operator, Lead Work, Firearms Noise, industrial noise etc.). All other safety and health training shall be proposed by the contractor to the contract employee(s). The Government shall give the contractor seven (7) workdays notice of available training and the contractor shall enforce that applicable employees attend. Additionally the contractor’s Hazardous Waste Coordinator shall be trained per EPA and DOT requirements relation to the transportation of hazardous waste, handling waste and managing a Satellite Accumulation Area (SAA), 180 day hazardous waste site by certified instruction which can be obtained by a private source/contractor/school at no additional cost to the government.

SAFETY
(a) Safety Representative. The Contractor shall designate a competent environmental/safety representative to be on-site at the FLETC or available (on call) by phone or beeper twenty-four (24) hours a day, seven (7) days a week. This representative shall have the authority to speak for and act for the contractor in all environmental & safety related matters. The Safety Representative shall have completed a basic OSHA course in 29 CFR 1910 (General Industry Safety Standards) once employed. The Environmental/Safety Representative shall have completed Resource Conservation and Recovery Act (40 CFR 260-265) and Hazardous Waste Operations (29 CFR 1910) training Before commencement of work, the Contractor shall provide the Contracting Officer, in writing, the name of the designated representative, pertinent telephone numbers, and normal area of assigned responsibility.
(b) Safety Program. Upon commencement of work under this contract, the Contractor shall implement a suitable safety program for employees performing work under this contract. This safety program shall be in writing and a copy shall be furnished to the Contracting Officer for approval, within fourteen (14) calendar days after contract award. This detailed plan shall describe how the Contractor’s safety program complies with Federal and State occupational Safety and Health Acts and any other safety provisions within this contract. This program shall clearly depict the Contractor’s safety and fire prevention and response measures in the areas of organization, methodology, and hazardous material (with emphasis on cleaning chemicals, lead, and gun power material). The safety plan shall include, but is not limited to; organization, methodology, medical surveillance/clearance, employee injuries, motor vehicle safety, lead safety, hazardous noise, heat stress, hazardous material (to include all provisions/codes addressed in 29 CFR 1910). The requirement for a safety plan addressing these areas shall be included in all subcontracts and integrated into the Emergency Response Plan.
(c) Stop Work Order. If the Contractor fails or refuses to promptly comply with safety requirements, the Contracting Officer or his designated representative may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop work order will be made the subject of a claim by the Contractor for extension of time or for reimbursement of excess costs or damages.
(d) Scope. The contractor shall furnish all personnel, supervision, equipment, management, materials, employee training, transportation and supplies necessary to perform hazard assessments, utilizing occupational safety and health statutes, regulations, manuals, directives and instructions cited herein. The contractor shall maintain files and records on all contractor personnel certificates, medical surveillances, physicals, and pertinent training. The requirements of this section shall apply to all services performed under this contract.
(e) Directives and Regulations. At a minimum, the contractor shall implement the most current versions of the Federal Occupational Safety and Health Administration (OSHA) 29 CFR 1910 and 1926; National Institute for Occupational Safety and Health (NIOSH) guidelines 42 CFR Part 84, National Fire Protection Association (NFPA); National Electrical Codes; U.S. Army Corps of Engineers Safety and Health Manual M385-1; FLETC safety and health policies and directives when performing all tasks throughout the entirety of the contract.
The publications listed below form a part of this Scope to the extent referenced and the Contractor shall comply with listed references. The publications are referred to in the text by the basic designation only.

(f) Performance Requirements
1. The contractor shall be responsible for the occupational safety and health of its personnel as established in applicable statutes, regulations, manuals, directives, and instructions. Throughout the duration of the contract, the contractor shall take all measures necessary to ensure compliance with all OSHA and other safety and health requirements pertaining to all work under this contract.
2. To ensure that an acceptable level of occupational safety and health is maintained, the contractor shall develop and implement a proactive safety program, including a medical surveillance program, which is designed to achieve a mishap and occupational illness rate as near zero incidents as is possible. See Section H.19 for additional guidance.
3. The contractor shall conduct employee safety orientation, training, and industrial inspections at the level of effort and at the frequencies detailed in applicable government statutes, regulations, and instructions.
4. The contractor shall ensure that safety specialists or company safety representative and safety training personnel are qualified and certified to applicable professional standards, affiliated organization certifications and government statutes, regulations, and instructions.
5. The contractor is responsible for maintaining all records, reports, logs, etc. in accordance with OSHA 300 log. Copies of OSHA 300 can be obtained from the OSHA District Office or Department of Labor.
(g) Material Handling Equipment. The contractor shall license its operators of powered industrial equipment in accordance with 29 CFR 1910 and 1926 and maintain a record of the names of those licensed, type of license, and date for a period of one year.
1. Material handling equipment operators shall be licensed in accordance with 29 CFR 1910 and 1926. One worker only should give signals to equipment operator when lifting or lowering operations are in progress. Lifting or lowering should not begin until all personnel are safely positioned.
2. The contractor shall inspect, test and label Material Handling Equipment in accordance with specifications contained in 29 CFR 1910 and 1926. Material handling equipment not specifically addressed elsewhere shall be handled in accordance with the manufacturer's specifications or guidance provided by the FLETC Environmental and Safety Program Officer.
(h) Explosive and Other Hazardous Materials
1. The contractor shall provide instructions and maintain records of its workers before beginning any operation involving the use or storage of explosives, ammunition, riot control chemicals or other hazardous materials, to include protective measures and equipment required, and symptoms of exposure. The instructions shall inform the employee of action and procedures to be followed in event of spills, leaks, fire, overexposure and any other type of emergency response action the contractor deems warranted. The contractor shall provide the appropriate personnel protection equipment (PPE) to its workers to perform the required tasks. When personnel protective equipment is required the contractor shall ensure its employees are qualified and trained in the proper use and care of the equipment.
2. A contractor’ explosive safety program shall be established in accordance with 29 CFR 1910.109, ‘Explosive and Blasting Agents.’ The program shall cover storage and handling of all shotgun, rifle, pistol, or revolver cartridges and cartridges for propellant-actuated power devices and industrial guns. The contractor shall maintain ordnance handler’s qualification and certification current and in accordance with requirements contained in 29 CFR 1910.
3. Personnel shall not be exposed to levels of toxic materials, chemicals, heat including nuisance particulate, in excess of the most stringent limits published in the latest edition of 29 CFR 1910.
4. Personnel exposed to toxic or hazardous materials or spills shall be monitored in accordance with requirements contained in 29 CFR 1910.
(i) Industrial Hygiene & Hazardous Abatement
1. Occupational Health and Industrial Hygiene functions shall be conducted by the contractor in accordance with 29 CFR 1910 of all chemical, metal, physical stressors (i.e. toxic chemicals, toxic metals, noise, heat stress, etc…). Results of inspections or test samplings shall be synopsized by the contractor in an annual written report to the FLETC Environmental and Safety Program officer. The reports shall provide recommended engineer or administrative abatement action for identified hazardous conditions. The use of Personal Protective Equipment shall be considered only when engineer or administrative abatement is not realistic or suitable. Safety and safety training records, mishap reports, and other deliverables shall be prepared and forwarded to the Charleston Safety office. Hazard abatement must include, but is not limited to:
2. Hazardous materials handling, storage, training and communications shall be prepared in accordance with applicable statues, regulations and instructions to include the FLETC Safety Manual.
3. Unsafe or unhealthful working conditions shall be documented and handled in accordance with 29 CFR 1910.
4. Mishap Investigation and Loss Prevention shall be handled in accordance with 29 CFR 1910. Copies of mishap reports shall be provided to the Contracting Officer or the COTR within 24 hours of each mishap. The Contracting Officer and/or COTR will coordinate all reports with the FLETC Environmental and Safety Program Officer.
5. Respiratory Protection Program shall meet 29 CFR 1910.134, 29 CFR 1910.1025, and Appendix D 29 CFR 1910.10001.
6. Asbestos Containing Material operations shall be conducted in accordance with 29 CFR 1910.1001.
7. Noise and Personal Protective Equipment programs shall be conducted in accordance with 29 CFR 1910. The contractor shall conduct an Annual Noise Hazard Survey of all noise producing equipment, buildings where noise is emitted and facilities. Results of surveys or test samplings shall be synopsized by the contractor in reports within a month of the survey to the FLETC Environmental and Safety Program Officer. The reports shall provide recommended engineer or administrative abatement action for identified noise hazard conditions.
8. Sight Conservation Program shall be conducted in accordance with 29 CFR 1910.
9. An explosive safety program shall be established in accordance with 29 CFR 1910.109.
10. Lead Control Program shall be conducted in accordance with 29 CFR1910.1025 and FLETC Occupational Safety and Health Manual.
(j) Compliance
1. Violations of safety statutes, regulations, manuals, directives, instructions and good safety practices by the contractor or the contractor’s employees shall not be tolerated.
(a) The contractor shall be accountable for all safety hazards resulting from inappropriate actions by the contractor including faulty facilities maintenance and acts of negligence. For any such hazards created, the contractor shall be liable for all corrective action expenses, including any and all fines or fees levied.
(b) The contractor shall be held responsible for all safety hazards resulting from waste generated or spills caused by contractor personnel actions, negligence, or faulty facility maintenance. The contractor shall be liable for all cleaned up expenses, including any and all fines or fees levied.
2. The contractor shall make all premises available to the government for periodic Safety and Industrial Hygiene Inspections.

ENVIRONMENTAL
(a) Scope.
The Contractor shall establish and maintain a Hazardous Material Control and Management (HMCM) Program for total life cycle control, or “cradle to grave” management, of all hazardous materials, explosives, and hazardous wastes located at the FLETC to include all Government operations, tenant activities, etc. The required services include, but are not limited to logistic and assist functions for identifying, labeling, handling, tracking, packing, storing and transporting hazardous materials, explosives, and hazardous wastes.
(b) Performance Requirements.
1. To establish the HMCM Program, the Contractor shall develop uniform policies and procedures for effective management and control of all hazardous materials, explosives, and hazardous waste currently at or in the future located at the Charleston facility.
2. The policies and procedures shall govern all hazardous material and explosives as it is received, stored, collected, and issued (for on-site use). The policies and procedures shall also regulate the collection and handling of hazardous waste for off-site shipment and disposal.
(a) All hazardous material shall be handled at a designated Satellite Accumulation Area (SAA) and all hazardous waste shall be managed at the Less-Than-180-Day Hazardous Waste Accumulation Site.
(b) The Contractor shall ensure that all hazardous material and explosive shipments received are accompanied by a Material Safety Data Sheet (MSDS). There shall be no incident of receiving any hazardous material or explosive.
(c) The Contractor shall ensure that all Hazardous Materials and Explosive shipments for off-site transportation are properly packed, crated, marked, labeled, placarded, shall be no incident of receiving any hazardous material or explosive shipments for off-site transportation are properly packed, crated, marked, labeled, placarded, and documented on Uniform Hazardous Waste Manifest and certified by authorized personnel in accordance with applicable regulations.
(d) The Contractor shall verify the receipt and distribution of material upon arrival at the Charleston facility or designated secondary shipment point. All receipts will be routed to the Government point of contact for verification. Hazardous cargo shall be handled by trained and qualified personnel. All hazardous material shall go directly to SAA for processing. 100% of receipts shall be stored properly. 100% of issues shall be properly made.
(e) Explosives, to specifically include small arms ammunition, shall be stored at approved warehouse sites for distribution to the firing range.
(c) Personnel Protection Equipment (PPE).
The Contractor shall provide Contractor personnel with the appropriate PPE Training and monitor Contractor personnel for compliance with the proper use and integrity of the PPE and equipment used to safely perform the tasks of this contract involving hazardous material.
(d) Hazardous Substance Management System (HSMS). The Contractor shall provide Operation and Maintenance of the Hazardous Materials Control Program at the FLETC Charleston.
1. Scope Of Work. Functional requirements for a computer system that will meet the hazardous communication requirement of the OSHA and the chemical tracking and reporting requirements of the Environmental Protection Agency (EPA). The Hazardous Substance Management System (HSMS) is an automated chemical tracking system designed to provide “cradle to grave” tracking not only for the hazardous materials and waste used at the FLETC, but also the chemical constituents of those materials. The HSMS tracking system provides full functionality and legal reporting requirement to satisfy Executive Order 12856, Strengthening Federal Environmental, Energy, and Transportation Management to satisfy Executive Order 13423. The Pollution Prevention Act and the Emergency Planning and Community Right-To-Know Act (EPCRA). The Contractor shall provide the personnel and software and the Government shall provide the equipment (including telephone and pager services), necessary to conduct the tasks and sub-tasks in order to meet the requirements listed in the contract.
2. The Contractor shall provide and install Service Pack releases to HSMS within 60 days of release to ensure that the FLETC is operating the most current version of the application software.
3. The Contractor as an independent Contractor and not as an agent of the Government shall furnish all personnel, supervision, management, equipment, materials, (except those furnished by the Government), supplies and transportation to develop, operate and maintain a Hazardous Substance Management System.
4. The Contractor shall:
(a) Develop a written Hazardous Communication Program that meets the requirements of 29 CFR 1910.1200 for the Government. The written program shall be site-specific to the FLETC Charleston and be submitted to the Contracting Officer within 30 days after post award conference.
(b) Operate and maintain an automated HSMS. This will consist of loading all chemical data, to include MSDS information, chemical constituent information, algorithms, chemical usage, inventory, tracking, ordering information receipts of materials and disposal information from each function and facilities at the FLETC Charleston.
(c) The Contractor will conduct a complete inventory of all work areas where hazardous materials are located or used. This information will be placed into an approved electronic format and update and maintained current. The Contractor will be responsible for maintaining a perpetual inventory thereafter. This will be accomplished by developing and implementing a pre-approval procedure for chemical and hazardous materials purchases and uses at the FLETC Charleston.
(d) During the workplace inventory, the Contractor will ensure proper storage of existing chemicals. The Contractor shall correct any incompatible storage (based on flash point, acids, oxidizers, corrosives) of chemicals on the spot. The Contractor shall provide the Charleston Environmental Protection Specialist (CEPS) with a list of work places that require flammable or corrosive storage lockers.
(e) The Contractor shall be responsible for labeling all chemicals that have not been labeled. This will include secondary containers. The Contractor shall establish a Material Safety Data Sheet Master File of all chemicals used on FLETC. If a MSDS is not available with the product upon receipt of the order, the Contractor shall contact the manufacturer of the product and obtain the MSDS. The product will not be introduced for use until the MSDS is received. The Contractor shall develop a MSDS binder for each work area site. Prior to ordering, receiving, or adding chemicals to the FLETC HSMS database system the Contractor will verify that the material has been approved for use by the CEPS.
(f) Contractor shall establish and maintain an Authorized Users List (AUL).
5. Database Management
(a) The Contractor shall provide an Applications Database Manager (ADBM) with a basic knowledge of hazardous substances and materials to support the continued operations of HSMS for the specified period.
(b) The ADBM is to perform duties as a technical specialist for HSMS including: data troubleshooting and analysis; installation and trouble-shooting for software upgrades; creating Crystal Reports, HSMS user data access management; Windows XP Pro system administration at the workstation level; and setup of new HSMS client application software.
(e) Material Safety Data Sheets (MSDS) and Authorized User List
1. For each work or storage site at FLETC where hazardous materials are located, the Contractor shall ensure each activity maintains an accurate MSDS binder/file. A current inventory (for a particular FLETC work/storage location) of all hazardous materials, chemical substances, or components known or suspected to contain hazardous materials, which have been authorized by CEPS for use at that FLETC location shall be maintained. Each hazardous material on the list is assigned a unique identifier that relates it to a MSDS with the same identifier.
2. The CEPS is the approving Official for use of any and all hazardous materials on the FLETC.
(f) Hazardous Material Identification, Labeling and Tracking
1. The Contractor shall be responsible for inventorying and labeling all hazardous materials per 29 CFR 1910.1200, including temporary and secondary containers.
2. The Contractor shall inventory hazardous material and label all hazardous materials per 29 CFR 1910.1200. The results of the inventory shall be entered into the HSMS database, bar-coded and tracked.
3. The Contractor shall develop and maintain procedures, which ensure that hazardous materials ordered, received, turned in, and/or transferred are recorded in HSMS. Record entries are to be made in such a way as to maintain an accurate and current inventory of all hazardous materials on a daily basis.
4. The Contractor shall ensure that all products that come onto the FLETC are on the AUL for that activity. If the material is not on the AUL the Contractor shall immediately notify the CEPS.
(g) Customer Assistance Support
1. The Contractor shall provide Customer Assistance Support to FLETC and onsite activities. Customer Assistance Support shall consist of functional and technical support in the area of HSMS operations when problems or operational questions arise.
2. The Contractor, in particularly the ADBM, shall work closely with the CEPS to ensure proper storage and segregation of hazardous materials at various work and storage sites. The Contractor shall notify the CEPS when hazardous materials storage deficiencies are observed and corrective actions needed (e.g., segregation of flammables from acids, oxidizers, corrosives, etc.).
3. The Contractor shall attend Hazardous Material Control Group meetings with the CEPS as needed.
(h) Hazardous Material Shelf-Management. In order to help reduce the quantity of expired hazardous material being disposed as waste, the Contractor will implement an aggressive shelf life management program. The Contractor will monitor expiration dates. The Center will be encouraged to use older stock first. If a product’s shelf life cannot be extended or if the product has been determined unserviceable, only then will that hazardous material be provided to CEPS to be disposed of as a hazardous waste.
(i) Hazardous Materials
1. Using the HSMS, the Contractor will track the following specific Federal Stock Classes at FLETC:

Batteries, non-rechargeable
Batteries, rechargeable florescent light bulbs only
Chemicals miscellaneous chemical specialties
Cleaners
Paints, varnishes and related materials
Preservatives and sealing compounds

Liquid propulsion and Fuels, Petrol Base
Oils and Grease
2. The above list is not a comprehensive list for all items at FLETC. The Contractor will research the hazard characteristics of newly identified or proposed products, help determine if the products should be included in the HSMS tracking system, and provide information to the CEPS as necessary for amending/updating the above list.
(j) Hazardous Waste Management
1. LESS-THAN-180-DAY HAZARDOUS WASTE ACCUMULATION SITE AND SAAs:
(a) The Resource Conservation and Recovery Act (RCRA) authorized the EPA to implement regulations for the control of hazardous waste from the point of generation through final disposal to assure that hazardous waste does not pose a threat to human health or the environment. Under authority granted by EPA, the State of South Carolina regulations contain specific requirements for identification, packaging, labeling, storing, and shipping of hazardous waste. These regulations are applicable to the FLETC Charleston.
(b) General Intent.
1. The purpose of this contract and the responsibility of the contractor are to create a functional waste management and recycling systems in accordance with EPA and the FLETC Hazardous Waste Management Plan which meets regulatory requirements to ensure that the proper pick up, labeling, transportation, and storage of hazardous waste is conducted at the FLETC. The Contractor shall operate the Less-Than-180-Day Hazardous Waste Accumulation Site at the FLETC, which is used for the labeling, storage, and transportation of hazardous waste/materials in accordance with all the FLETC safety directives and federal, state, and local requirements (FLETC Hazardous Waste Plan), as well as all applicable provisions of 29 CFR 1920 and 1926 of the OSHA, 40 CFR SUBCHAPTER I of the EPA, 49 CFR SUBCHAPTERS A thru C of the Department of Transportation (DOT), and the U. S. Army Corps of Engineers Safety Manual EM 385-1-1 dated September, 1996 or most current. The contractor shall meet all qualifications and training requirements for the transportation and handling of hazardous as required by the state, Federal DOT and EPA.
2. The operator of the Less-Than-180-Day Hazardous Waste Accumulation Site at the FLETC will have the title of HAZARDOUS WASTE COORDINATOR (HWC).
(c) In general, duties and responsibilities of the HWC shall consist of but not be limited to: (Forms and Checklist are contained in the FLETC Hazardous Waste Program Manual).
1. Upon request or when daily inspections indicate the container is full, picking up waste from all SAAs and completing the following forms: SAA Inspection Checklist.
2. Daily inspections of the SAAs and weekly inspections of the Less-Than-180-Day Hazardous Waste Accumulation Site, completing a Hazardous Waste 180-Day Accumulation Site Inspection Form.
3. Delivering empty drums/containers, lever locking rings, labels, etc., upon request.
4. Properly labeling all drums/containers as they are received at the SAAs and at the Less-Than-180-Day Hazardous Waste Accumulation Site, using FLETC EPA ID NO SCR000762062 Hazardous Waste Container/Drum Label Noted in the FLETC Hazardous Waste Plan.
5. Maintaining and operating the Less-Than-180-Day Hazardous Waste Accumulation Site to include proper storage and segregation of hazardous waste and hazardous materials.
6. Coordinating with CEPS for proper transportation of material off-site and load HW onto transport vehicle. (Offsite transportation of hazardous waste is not part of this contract.)
7. Perform daily housekeeping duties at the Less-Than-180-Day Hazardous Waste Accumulation Site in accordance with industry/regulatory standards daily.
8. Maintaining a current inventory stock of empty drums/containers, labels, spill containment materials, etc, using Drum Inventory Report.
9. Documenting inspections of the Less-Than-180-Day Hazardous Waste Accumulation Site and the SAAs.
10. Inspecting and documenting inspections of such on all safety equipment at the Less-Than-180-Day Hazardous Waste Accumulation Site and SAAs.
11. Providing spill cleanup and assistance 24 hours per day. The contractor shall make available a qualified call back person who will have a beeper and phone, who will respond within 1 hour for cleanup.
12. Performing related inventories and documenting same, and etc.
13. Depressurizing aerosol cans to minimize waste disposal.
2. SPECIFIC TASKS
(a) TASK #1:
1. Operate the Less-Than-180-Day Hazardous Waste Accumulation Site during a normal work week. Provide spill response and emergency calls after these hours as explained hereafter. Contractor personnel shall be qualified and trained per 40 CFR 262 through 40 CFR 265, 49 CFR 172.700, 29 CFR1910.1200, and 29 CFR 1910.120.
2. Provide pick up of waste (both hazardous and non-hazardous) from all SAAs within four (4) hours of call notifying Contractor of need for pick up. Prior to accepting any waste from the SAAs, Contractor shall open each drum or container to confirm that the waste corresponds with the description on the label and Waste Information Document (WID) Contractor shall correct any discrepancies with the waste being picked up prior to transporting such waste to the Less-Than-180-Day Hazardous Waste Accumulation Site.
3. Conduct weekly inspections of Less-Than-180- Day Hazardous Waste Accumulation Site and document this inspection on Hazardous Waste 180-Day Accumulation Site Inspection Form.
4. Ensure that no waste exceeds the 180 day storage limit. Provide the CEPS with weekly status report of the dates of the waste. Status shall be provided on the Drum Inventory Report.
5. Weekly, inspect all emergency equipment (i.e., emergency eyewash, fire extinguishers, spill kits, etc.) located at the Less-Than-180-Day Hazardous Waste Accumulation Site and document such inspection on Hazardous Waste 180-Day Accumulation Site Inspection Form.
6. Weigh each drum, pallet, or container that is received into the Less-Than-180-Day Hazardous Waste Accumulation Site. Fill in all information on the label for drum, pallet, or container (i.e., weight, drum/pallet/container I.D., waste code, etc.). Contractor shall document all drum information on the Drum Inventory Report.
7. Drain all rainwater from containment area at the Less-Than-180-Day Hazardous Waste Accumulation Site and document release in writing and submit to the FLETC Environmental Branch. Ensure there are no contaminates released during draining of the rainwater. Contractor shall ensure drain valve remains locked at all times except when draining rainwater.
8. Upon receipt of pressurized aerosol cans, depressurize such can by puncturing it and collecting residual solvents into applicable transport drums. Equipment to perform this function shall be provided by the Government.
(b) TASK #2:
1. Establish temporary SAAs and the picking up of waste at these temporary sites. (To clarify, occasionally, the FLETC will award construction contracts; some of these construction sites generate hazardous waste, which will require establishment of temporary SAAs.).
2. Pick up hazardous waste from all SAAs located at the FLETC Complex.
3. Conduct daily inspections of all SAAs, and document inspection on Hazardous Waste 180-Day Accumulation Site Inspection Form.
4. Deliver empty drums/containers, labels, lever locking rings, etc., upon request.
5. Label empty drums/containers using Hazardous Waste Container/Drum Label when making delivery to the SAAs or when receiving drums/containers in the Less-Than-180- Day Hazardous Waste Accumulation Site.
(c) TASK #3:
1. Contractor shall properly segregate all waste and ensure that each drum/container is properly secured/closed and ready for shipment in accordance with current regulations.
2. Contractor shall assist hazardous waste transporter during the loading of waste at the Less-Than-180-Day Hazardous Waste Accumulation Site for disposal off-site. Assistance shall consist of loading the transporter’s truck using fork truck/hand truck and correcting any discrepancies in labeling, container closures, paperwork, etc.
(d) TASK #4:
1. Provide the CEPS with a perpetual inventory report on Drum Inventory Report form of all waste stored at the Less-Than-180-Day Hazardous Waste Accumulation Site. The Contractor shall submit such inventory each time a container is added to the Less-Than-180-Day Accumulation Site.
2. Contractor shall maintain a file copy of all WIDs, WTDs, daily and weekly inspections of the Less-Than-180-Day Hazardous Waste Accumulation Site and SAAs. Contractor shall forward original copies to the CEPS when requested.
(e) TASK #5:
1. Contractor shall visually inspect all sway cars and roll-offs at all construction sites on the FLETC property daily. If disposal of unauthorized waste is evident, Contractor shall notify the CEPS personnel as shown on the Emergency Call-Back Report.
(f) TASK #6:
1. Contractor shall provide spill clean up and assistance 24 hours per day. The contactor shall make available a qualified call back person who will have a beeper and cell phone, who will respond within 1 hour for cleanup.
(k) SPILLS AND EMERGENCY CALLS
1. Emergency and Spill Response Plan. In accordance with CFR 29, Part 1910.120, the Contractor shall develop and implement an Emergency Response Plan. The plan shall be submitted within ten (10) days after start of full performance under the contract and must address, as a minimum, the following areas:
a) Pre-emergency planning and coordination with outside parties.
b) Personnel roles, lines of authority, and communication.
c) Emergency recognition and prevention.
d) Safe distances and places of refuge.
e) Site security and control.
f) Evacuation routes and procedures.
g) Decontamination procedures.
h) Emergency medical treatment and first aid.
i) Emergency altering and response procedures.
j) Critique of response and follow-up.
k) Personnel protective equipment and emergency equipment.
l) Personnel training and emergency drills.
2. Emergency and Spill Response Requirements. The Contractor shall, 24 hours per day, 7 days per week:
(a) Respond to all hazardous material and hazardous waste spills at the FLETC, in conjunction with emergency response services from the Local Fire Department.
(b) Clean up all spills that are over 1 gallon, but less than 25 gallons. The Contractor shall assist the CEPS, local/state/federal emergency responders for larger spills.
(c) Immediately notify the CEPS and COTR of all spills within fifteen (15) minutes of the spill reporting.
(d) The Contractor shall provide for after-hours, holidays, and weekends; emergency service manpower, equipment and materials needed on an as-needed basis in response to calls placed by authorized personnel. The Contracting Officer will provide the Contractor with a list of authorized individuals. The Contractor shall be on-site within 1 hour of receiving the initial emergency service request. The Contractor shall submit an Emergency Call Back Report to the COTR on the first workday following an emergency call back.
(l) Reports And Other Deliverables.
The Contractor shall complete all reporting requirements to satisfy Executive Order 13423, Pollution Prevention Act, Toxic Release Report (TRI), Hazardous Materials Inventory (TIER II), EPCRA for hazardous materials on-site at FLETC. Contractor shall ensure data accuracy and generate all required reports. Reporting efforts shall include:
1. On a monthly basis and at other times on demand (at no additional cost to the Government), the Contractor will develop and produce ad-hoc reports using the data maintained within HSMS via Crystal Reports and other application software as required.
2. The Contractor will generate an inventory report on a monthly basis and will visually check at least 25% percent of that inventory each month in to ensure data accuracy. To ensure reporting accuracy, a visual check of all inventories throughout all storage sites must be completed at least once every 4 months.
3. The Contractor shall be able to provide at any time, an accurate, running inventory of hazardous materials that have been issued to FLETC personnel and other on-site agencies.
4. The Contractor will also generate monthly status reports on activities conducted in support of HSMS and day-to-day operations.
5. The Contractor and all sub-Contractor personnel shall safely perform all tasks as set forth in this contract and fully comply with all regulations, standards, statutes, and guidelines as applicable with federal, state, local, and FLETC mandates.
6. The Contractor shall maintain files and records on site of all Contractor personnel certificates, medical surveillances, physicals, and pertinent training necessary to comply with the applicable federal, state, local, and FLETC regulations. The Contractor is responsible for maintaining all records, reports, logs (i.e. OSHA-300 OSHA Log and Summary of Occupational Injuries and Illnesses, FTC-SSE-2 Waste Information Document, FTC-EVS-2 Waste Transfer Document , etc., and copies of all documents (i.e. MSDS’s, HW Shipping Manifests, Bills of Laden, Solid Waste Monthly Disposal Reports, SAA inspection forms, etc.), and forwarding the originals to the FLETC Environmental/Safety Specialist and a copy to the COTR no later than the following workday.
(m) Hazardous Waste Management And Daily Contractor Responsibilities
1. The Contractor and their employees are responsible for ensuring compliance with all requirements governing the handling of hazardous waste in every day task and assignments. The disposal of all hazardous/potentially hazardous materials (i.e. paints, cleaning products, solvents, thinners, rags, brushes, rollers, propellants, etc.) shall be accomplished in accordance with the FLETC Hazardous Waste Management Plan. The Contractor shall also comply with all EPA Hazardous Waste Regulations, South Carolina Environmental Protection Division for all non hazardous and hazardous waste management, disposition and disposal.
2. The Contractor shall submit a Hazardous Waste Management Plan that conforms to the FLETC Hazardous Waste Plan 14 days prior to the start of the contract for approval. The Contractor shall have an approved hazardous waste plan before the Contractor can begin
3. The Contractor shall not remove or ship hazardous waste from the FLETC. The shipping and disposal of Hazardous Waste shall be documented under the FLETC Charleston Generator EPA ID Number. Only the CEPS shall sign the Hazardous Waste Manifest as the generating activity. Hazardous waste shall be managed and collected in strict accordance with the FLETC Hazardous Waste Management Plan. The CEPS shall task the HWC to transfer and transport hazardous waste generated by the Contractor utilizing the Waste Transfer Document.
4. The Contractors’ Environmental Representative/HWC shall be responsible for the proper segregation, packaging and handling of hazardous waste in accordance with the FLETC Hazardous Waste Plan
5. The Contractor shall coordinate with the CEPS for all hazardous waste storage, transportation and disposal. A Waste Information Document (WID) shall be provided by the Government for each waste-stream per the Hazardous Waste Management Plan.
6. All containerization, labeling and storage of waste shall be in accordance with the FLETC Hazardous Waste Management Plan.
7. Hazardous waste shall be stored at a designated SAA. (Note: The CEPS will establish the SAAs.) When the waste stream exceeds 55 gallons it shall be transported, within 72 hours, to the 180-day accumulation site.
8. The Contractor shall coordinate with the CEPS, who shall provide guidance and assistance with the identification of waste streams and disposal.
9. The HWC shall assist FLETC in identifying storage location (SAA), and shall conduct daily inspections on SAA using the SAA Inspection Checklist.
10. All waste disposal accomplished through the 180-day accumulation Site shall be the responsibility of the FLETC. The Contractor shall be responsible for proper segregation, identification and classifying of his waste stream.
11. The Contractor shall contact the CEPS within 14 days of the award of the contract to schedule Hazardous Waste Training. The Hazardous Training shall take approximately one hour.
(n) Environmental Non-Conformance
1. Any time the contractor or their employees violate an EPA, South Carolina Environmental Regulations or FLETC environmental regulation the contractor is contractually bound to conform and correct any environmental discrepancies immediately. If the FLETC is fined for contractor not performing their duties, the contractor shall pay all fines, correct the violation and submit a plan of action to prevent a reoccurrence.
2. All environmental fines or violations imposed on the FLETC by South Carolina or any environmental regulatory body as a result of the Contractor’s non-compliance shall be the Contractor’s responsibility. The Contractor shall be billed by the FLETC for the full amount of the fine and billed for any administrative cost associated with the violation. The Contractor is also responsible for any corrective actions imposed by the authority.
3. Indoor Air Quality Management:
(a) The Contractor shall aggressively work to maintain clean indoor environments through best management practices (ex. Cleanness, Humidity Control, Temperature Control, Scheduled Cleaning, Scheduled Maintenance, Repair of Water Leaks, etc.).
(b) The Contractor, Maintenance Staff and all Supervisors shall have a copy of the "Building Air Quality: A Guide for Building Owners and Facility Managers" http://www.cdc.gov/niosh/baqtoc.html published by the EPA. The Contractor and management staff shall implement the guide with strict attention to chapter 5 of the manual “Managing Buildings for Good IAQ”.
(c) The Contractor shall develop and indoor air quality management plan for all buildings under their responsibility and submit the plan fifteen (15) days after contract award.
(d) Supplies, Materials, and Equipment Provided by the Contractor:
(1) Unless otherwise specified herein, the Contractor shall furnish all supplies, materials, and equipment necessary for the performance of work under this contract. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards and, to the extent feasible and reasonable. The Contractor shall include the exclusive use of environmentally-preferable products. All cleaning soaps, liquids, etc., must meet EPA Green Seal requirements. All supplies, materials, and equipment to be used in the performance of work described herein are subject to the approval of the COTR.
(2) The Contractor shall comply with all applicable provisions of the Federal Hazard Communication Program (29 CFR 1910.1200). Within fourteen (14) days of receipt of materials or products for which a Material Safety Data Sheet (MSDS) has been promulgated by the manufacturer, the Contractor must provide the COTR with a valid copy of the MSDS for each hazardous material in use or stored on the FLETC. The contractor shall provide the COTR with the approximate quantities (i.e., ± ten percent) and the location(s) of all hazardous materials stored by the Contractor. The Contractor must update this information at least once each quarter or more frequently when quantities for any hazardous material change by more than ten percent (10%) for any single product and submit to the COTR. The Contractor shall maintain accounting for all hazardous materials used and provide the accounting in volume upon request by the COTR.
(3) Within 30 days after award, the Contractor shall submit to the COTR a list indicating the name of the manufacturer, the brand name, and the intended use of each of the materials, chemicals, and compounds proposed for use in the performance of its work. The Contractor shall not use any materials, chemicals, or compounds which the COTR determines would be unsuitable for the intended purpose or harmful to the surfaces to which applied or, as might be the case for such items as paper or soap products, unsatisfactory for use by occupants. Whenever practical and no deviation from Federal specifications or standards results, the Contractor shall utilize products and material made from recovered materials (e.g., recycled paper and paper products) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. For the recycled content products evaluation, all non-chemical products proposed for use under this contract must conform to the Environmental Protection Agency (EPA) Comprehensive Procurement Guide (CPG) if the products are CPG-designated items. It is desirable for products that meet the desired objective (e.g., ability to clean effectively) and is not CPG-designated items also to contain the highest-possible amounts (by percentage) of recovered material(s) and post-consumer content.
(4) The successful offeror’s shall be required to meet or exceed the below-listed Mandatory “Environmental Preferability” Submission criteria required and incorporated into the Contractor’s Cleaning and Maintenance Operations for all of the chemical cleaning-products, paints, solvents, chemicals etc. used during the performance of the contract. The offered products must meet the required consistencies as stated below:
a. Bathroom tissue - The bathroom tissue must contain at least 100% recovered materials and 50% post-consumer content.
b. Toilet Seat Covers - Toilet seat covers must contain at least 100% recovered materials and 50% post-consumer content.
c. Paper Towels - The paper towels must contain at least 100% recovered materials and 40% post-consumer content.
d. General Purpose industrial wipes - The general purpose industrial wipes must contain at least 100% recovered materials and 40% post-consumer content.
e. Plastic trash bags - Plastic trash bags must contain at least 25% post-consumer content.
f. Computer Toner Cartridges – Toner cartridges that contain at least 25% post-consumer content.
g. Proposed environmentally-preferable chemical or products which must be selected in accordance with the criteria of this Solicitation. At a minimum, the Plan must identify products by brand name for each of the following product types:
All-purpose cleaner
General degreaser
General disinfectant
Graffiti remover
Chrome and brass cleaner/polish
Glass cleaner
Furniture polish
Floor stripper
Floor finisher
Carpet cleaner
Solvent spotter
Gum remover
Wood floor finish
Bathroom hand cleaner/soap
Bathroom disinfectant
Bathroom cleaner
Bathroom deodorizers
Urinal deodorizers
Lime and scale remover
NOTE: Contractors may propose more than one product within a product category and/or propose a product or products addressing more than one product category.
(5) The product attributes for the proposed product brands in each of the above categories must be summarized on the form included in the Solicitation package. Once this list of products has been approved by the Contracting Officer, the Contractor is responsible for using only those approved chemical products in the building. If for some reason the product is found later to be ineffective, or the Contractor would otherwise like to propose an alternative product or, if the Contracting Officer would like to propose a more environmentally-preferable product, either the Contractor or Contracting Officer may propose for consideration an “equal” product through a joint agreement with the Contracting Officer upon approval of CEPS. The Contracting Officer is the final decision-maker for such substitutions and must approve each in writing;
(6) Any material which the COTR suspects does not meet Federal specifications or standards shall be tested at the Contractor's expense by an independent testing laboratory qualified to perform such tests as are required. A copy of the laboratory report giving the results of the test and a sample of each product, if requested, shall be submitted to the COTR.
