Attachment 11 of the RFP provides a copy of Wage Determination TX 150052 for construction type Heavy in El Paso County of the State of Texas. We believe that work will be performed in multiple counties in Texas and New Mexico under the contract. Please clarify the requirement for the Wage Determination(s) applicable to this contract

Please clarify the requirements for the value (dollar amount) of payment and performance (P&P) bonds. Are P&P bonds issued per work plan, annually, or for the entire term of the contract?

P&P bonds are issued for the entire term of the contract.

Table 3.1.1-1. Work Area 3 Fence Quantities, Pgs. 15-16
I saw some chain link, and welded wire mesh fencing SF/ T1 Style.

Is that part of the CTIMR 3 contract, and if so can we get the quantities of the SF/ T1 type fencing per each section/sector?

The specific types of fence and quantity for each type of fence included under this contract are contained in the SOW under Table 3.1.1-2.

However, offerors are reminded that the fence types, quantities, and number of activities that are required to be priced (and included in the cost proposal) are stated in Attachment 3 (Sample Work Plan Request).

3.1.1.1

Fence and Gates - Type of Damage. Pg. 16

Can you clarify the average number of breaches per month, per section?
Section 3.1.1.1 of the SOW states that “based on historical data, CBP experiences on average over 1000 Fence breaches per year within this Work Area, predominately located in the El Paso AOR”.

However, offerors are reminded that the specific activities (including fence repairs and breaches) that are required to be priced (and included in the cost proposal) are stated in Attachment 3 (Sample Work Plan Request).

Section C.3.4

Pg. 27 CBP has developed a web site that shows the most current and up-to-date information available regarding the existing assets as well as documentation regarding the CTIMR requirements. The information is located in the section titled “Comprehensive Tactical Infrastructure Maintenance and Repair (CTIMR) Overview” on the Website (http://cbp.gov/xp/cgov/border_security/ti).

Using the link provided, the “Can’t Find Needed Content?” is presented. Is there another link that should be used?

The website is not currently operational, therefore the RFP has been revised to remove this from the SOW.

Offerors are reminded to review the SOW, Attachment 10 (CBP TI Standards Design), and the Sample Work Plan Request for information regarding CBP’s TI assets in Work Area 3.

Period of Performance Pg. 33

When does the Period of Performance (PoP) for CTIMR3 begin? Section F.2 specifies: The period of performance of this contract shall be from the date of award through 365 days. Four (1) one-year option periods, if exercised, will begin immediately following the base period on day 366.

To allow for a comprehensive response to the technical requirements of the proposal, will the government consider excluding the Past Performance Information, Client and Consent letters (Attachments 7 and 8) and Transmittal Letter from the 50 page limit of Volume I?
Section L of the RFP has been updated to exclude Past Performance Information, Client and Consent letters (Attachments 7 and 8), and the Transmittal Letter from the 50-page limit of Volume I.

Section L.12.B.a states:

How the offeror’s technical approach will benefit the CTIMR Work Area 4 Program, in terms of capability, timeliness, and the ability to meet routine or urgent M&R requirements (as needed);

Can we assume that it should be Work Area 3?

Yes. Solicitation will be corrected to state Work Area 3

Requirements state that back-up documentation shall include detailed cost/price amounts of all resources required to accomplish each work requirement (i.e., labor categories, labor hours, number of employees for each labor category, labor rates, specific equipment proposed and its usage, proposed quantities of materials and supplies, travel, proposed specific support items and their estimated costs, and a total cost breakdown (to include a summary total for each cost component, e.g., labor, overhead, or G&A), and the proposed fee..

Since this data is provided in RFP Attachment 5, does Attachment 5 satisfy this requirements with the exception of detailed buildup of the travel and materials/other direct costs (ODC) which is not in Attachment 5?

Attachment 5 does not satisfy all back-up documentation required for cost reimbursable costs. We need adequate support or basis of estimates for your labor categories, labor rates, hours, indirect rates, material rates, equipment rates, and ODC. Basically, what is the rational or support for your estimates?

Attachment 3 Sample Work Plan 3.1.1 El Paso Fences Items 2, 3, and 4

Pg. 3 Job Visit did not visit any of the types of fence listed in 3.1.1 El Paso Fences Item 2, Legacy Secondary-PF, Item 3, Legacy Tertiary –PF and Item 4 Legacy Tertiary -PF

There are several types of fence repair specified in the work plan for chain link fences. 1 X 9 Gauge, 2 X 9 Gauge, 2X6 Gauge, none of these fences were visited on the site tour.

Since all of these are Legacy fence design the Specification Standards are not addressed for example the secondary fence requires ½” mesh. Can pictures, dimensions description height width, etc. or sketches be provided?

The majority of the fence types included under the CTIMR Work Area 3 contract are outlined in Attachment 10 (CBP TI Standards Design).

For Legacy fence types (including Legacy Secondary-PF, Legacy Tertiary –PF, and Legacy Tertiary –PF), pictures of these fence types have been included in the Amendment to assist offerors with correlating the fence types to the requirements stated in the SOW and Sample Work Plan Request.

However, offerors are reminded that the specific activities (including the specific repairs for these fence types) that are required to be priced (and included in the cost proposal) are stated in Attachment 3 (Sample Work Plan Request).

P-22 Bollard Fence Perform corrosion treatment on 200 TI bollards each quarter. Number of incidents per year is 200 total. Should this yearly total be a quantity of 800?
The Sample Work Plan Request has been revised to reflect the number of incidents as 800 repairs per year.

Section L Pg.78 Amendment 1 states in box 13, item A. specifies that the proposal … THE WORK REQUIRED ARE DUE AT THE PLACE SPECIFIED IN ITEM 8 …Box 8 is blank, should we use the address in Section L.12, pg. 78 of the solicitation?

Attachment 5 – Cost Template
There are subcontractor worksheets for each CLIN that mimics the Prime worksheets for each CLIN. These subcontractor worksheets contain proprietary data.

Should the subcontractor’s labor rates be fully burdened through Fee to be included in the Prime’s submission given that the G&A is proprietary to the subcontractor and will be included in the subcontractors sealed package?

Where in the Cost Template, should the Prime apply the Prime’s loadings to the subcontractors fully burdened costs?

Yes, the subcontractor’s labor rates should be fully burdened with fee in the subcontractor worksheets in Attachment 5. The subcontractor’s total costs and hours are linked to the applicable summary tabs. The prime’s G&A and profit/fee rates would be applied in the “Summary Total Contract” tab in Attachment 5. The subcontractor should send any proprietary information or data showing the breakdown of cost elements of the fully burdened labor rates with fee as well as support for their indirect rates in a sealed package to the Government. Also note, that the prime’s labor rates in Attachment 5 should be burdened with any fringe and overhead with no G&A and fee. The prime G&A and fee rates would be applied in the “Summary Total Contract” tab in Attachment 5.

The RFP only provided Attach_11_El_Paso_Texa_Wage_Determination_TX150052_WA_3_HSBP1015R0040.docx. Is this the only WD that should be used? Will the government be providing other WD attachments for NM and other areas within Texas?

Amendment 0004 adds Wage Determination Information for New Mexico.

There are no Limitation of Liability clauses provided within the RFP. Would the Government please consider including FAR clauses 52.228-7 and 52.246-25?

Offeror are advised that the Solicitation includes clause 52.236-7 Permits and Responsibilities which applies.

Section (I) I.69 Changes-Cost Reimbursement
Pg.51

Clause 52.243-2 Changes-Cost-Reimbursement (Aug 1987) Alternate III (Apr 1984) is included however since there is a Firm Fixed Price CLIN, should Clause 52.243-4 Changes also be included?

Amendment 0004 adds clause, I-70 -Change clause 52.243-4 which applies to the Firm Fixed Price CLIN.

Wage Determination Attachment
Is NMGRT applicable to this contract given the scope of work for the Sample Work Plan crosses the Texas/New Mexico border?

On the SF1442 it states an offer guarantee is required but there is no other specification on bond amount in the solicitation. Can you clarify bond amount and where to put bond in proposal?

On the SF1442 it states original and 3 copies but on pg. 78, it states to submit Volume I and II electronically and also submit two CD copies. Can you clarify submission requirements
Amendment 0004 revises SF 1442 Cover page to state original and 1 copy. Offeror should comply with submitting Volume 1 and II electronically with two (2) CD copies.

SOW 3.1.1.3 Gates – Type of Work Pgs. 17-18
Please confirm that the Santa Teresa gate is the only gate requiring weekly maintenance. If so, please also confirm that pricing for this weekly maintenance is to be included in the “monthly” figures for the “F&G” tabs in the cost template.
Please reference Attachment 3 (Sample Work Plan Request), which includes all maintenance and repair requirements for Gates in both El Paso and Big Bend Sectors that should be included in the offeror’s cost proposal.

SOW 3.1.4.2 Lighting and Electrical Systems - Type of Work

Is contractor to include in its pricing the estimated costs for replacement parts/supplies (bulbs, ballasts, wires) that may be incurred during routine preventive maintenance of lights in the L&E tab of the Cost Template under Task 3? If so, please identify types and sizes.
Please reference Attachment 3 (Sample Work Plan Request), which includes the Lighting & Electrical maintenance requirements for El Paso Sector that should be included in the offeror’s cost proposal. Also reference Section 3.1.4.1 of Attachment 3 for lighting and electrical systems assumptions (including bulb, ballasts, and breaker types).

Tasks 1, 2, and 3 are for replacement of damaged areas. Please confirm what the term “PF” means “per foot”.
The names of Tasks 1, 2, and 3 in the costs template correspond with the names of the activities contained in the Attachment 3 (Sample Work Plan Request) under El Paso Fences (Tasks 1, 2, and 3).

Additionally, as noted in Section 3.1.1 of Attachment 3 (Sample Work Plan Request), PF stands for “pedestrian fence”.

SOW 3.1.5.2 Vegetation Control and Debris Removal – Type of Work

Pg. 20

SOW states that vegetation control includes mowing, removing and disposing of grass and other vegetation longer than 6”. It was stated during the site visit that vegetation control along fence lines occurs basically twice per year and much of the vegetation exceeded a 6” measure. Please clarify.
The requirements stated in the SOW encompass the full scope of the vegetation control requirements required for the entire Work Area 3.

The specific requirements for vegetation control within each Sector will be identified by the COR after award.

RFP Amendment 3, Section L, Volume II/Section 4 Financial Capability

Volume II Cost/Price Proposal Section 4 – Financial Capability states, “specify the financial capacity, working capital and other financial resources availability to perform the contract.”

Is the Offeror to include a statement and provide additional documentation (Bank Letter, Letters of Good Standing)? Please clarify.

Yes. Additional documentation (e. g., Projected Business expected, Current and Future cash flow, Lines of Credit, Bank Letter and Letters of Good Standing, etc.)

Volume II Cost/Price Proposal. Section 2 Solicitation, Offer, and Award- Pg. 84

The Offeror shall incorporate information described in Section M, Paragraph M.4, Factor 4.

The Offeror shall also incorporate the information required as part of Attachment 3 into this Section.

Attachment 3 is the Sample Work Plan. Could the government please clarify what information should be incorporated into this section?
