About this file
This document is a Certification of Nonsegregated Facilities form for the McGhee Tyson Airport Runway 5R-23L Rehabilitation Project 1 in Alcoa, Tennessee, issued for bid on February 9, 2025. The certification is a required document for federally assisted construction contracts exceeding $10,000, which are not exempt from the equal opportunity clause. The form requires the contractor to certify that they do not maintain or provide segregated facilities for employees at any of their establishments, and that they will not permit employees to perform services in locations with segregated facilities.
The certification defines "segregated facilities" broadly, including waiting rooms, work areas, restrooms, eating areas, time clocks, locker rooms, parking lots, drinking fountains, recreation areas, transportation, and housing facilities that are segregated by explicit directives or de facto segregation based on race, color, religion, or national origin. The contractor agrees to obtain identical certifications from subcontractors prior to awarding subcontracts exceeding $10,000 and to retain these certifications in their files. A breach of this certification is considered a violation of the equal opportunity clause in the contract.
