The purpose of the amendment is to:
1. Extend the "Offer Due Date/Time” to 12:00 pm CT, 13 July 2020.
2. Change the period of performance/work shall be completed to 270 calender days.
3. Add 52.228-15 Performance and Payment Bonds-Construction (Deviation Apr 2020); removing the seal requirement.
4. Change section "G-5 Bonding Requirement" delivery method to: jennifer.johnson3@fda.hhs.gov.
5. Provide the Pre-Proposal Conference/Site Visit Minutes. *Attachment 1.

Mrs. Jennifer Johnson, convened the meeting at 9:15 am Central Standard Time (CT).
A general overview of the solicitation was conducted by Mrs. Johnson, including a review of sections B, L, and M of the solicitation including: Summary of requirement, NAICS code, requirement magnitude, proposal submission instructions, and evaluation factors. Dates to reminder were also covered:
1. Question Submission Deadline: June 23, 2020, by 10:00 am CT.
2. Question & Answer/Site Visit Overview Modification Issuance on or before June 30, 2020.
3. Proposal submission deadline is July 6, 2020, 12:00 pm CT.
A technical overview of the solicitation was conducted by Brian Young including: Specifications, work phases, and drawings. Mr. Young then conducted a site walk through.
The proposal conference/Site Visit adjourned at 11:40 am CT.

1. RFP, section 11, page 1 and subsequent mention of the 180 day period of performance throughout the RFP: Upon discussion with our Subs and our own intel gathered while at the site visit, we would like to ask for the 180 day performance period be changed to 365 days. There are several reasons for this request. The current proposal will take the project into mid‐
February. The overlaying cannot be applied unless the ambient temperature is 40 degrees (F) and rising. That is important to note as not the same as a High of 40. We would start having days as early as November that will restrict this process. These days will only grow in frequency as the performance period extends into winter. Also, rain is most common in the Winter on the warmer days. Progress will be at a crawl from Dec‐Feb. Based on the Winter accounting for almost half of the performance period; we are left with an actual Period of 75‐90 days, and that does not account for weekends, Holidays, and rain. This could be as little as 60 working days before we start losing days to temperatures being too low. The other factor of note is the increase in rain as Fall/Winter come across our calendars. The other large facet or work are grading ditches (which cannot be done satisfactorily if filled with water) and the installation of culverts (which need to be adequately compacted while back‐filling). Everyone at the Site‐visit seemed very understanding of these issues and anticipated them. However, the Performance and Payment Bonds would be issued prior to starting the work with 180 day terms. While the
Government has expressed understanding in the 180 day performance period, they would be within their rights to exercise those Bonds when outside the 180 days. This would be very unfavorable to the contractor for acquiring future bonds and financially. It would be appreciated, if this period were extended. The reason for 365 days and not 220 or something else intermediate; is that the days would be starting mid‐February and for the reasons outlined above, would not yield many productive days to the Contractor.
Answer: The Period of Performance has been increased to 270 days. After internal discussions along with input from the design engineer we feel that is adequate time to complete the project. Weather delays will be evaluated at the time they are submitted, and reasonable consideration will be given.
2. RFP, section 13, page 1 & : Part II ‐ Price Proposal Instructions, i), page 45. Would you consider extending the offeror date one week to July 13th? The reason I have asked for a week's delay in the quote submission is to fulfill the requirements of providing an Arkansas Contractor's
License. Arkansas uses the NASCLA ‐ Arkansas 6th edition as its current book for its Arkansas
Business Law Exam. In Section 3‐2, under exemptions, it states that performing "work on federal property under a contract with the federal government". Because of this exemption, we have not obtained a license.
I would like to amend my week's delay to simply asking for the removal of this requirement. If that is not the government's desire to do so, then please allow a delay in quote submission for the obtainment of the License. The Arkansas Licensing Board does not hold its next hearing till
July 10th (https://www.aclb.arkansas.gov/laws‐rules/hearing‐dates/).
Answer: We have no issue with extending the date one week to 13 July. It is important that the chosen contractor be recognized by the State of Arkansas as a licensed contractor.
