Painting and Coatings Solicitation FA9301-17-R-0008

Solicitation & Pre-Proposal Conference/Site Visit

Questions & Answers (Q&As) 02

Statement of Work (Basic Contract)

1. Question: All abatement work requires monitoring by a certified third party, however, there is no line item for the monitoring of the abatement work in this template. Please advise if contractor is also responsible for the monitoring of the abatement work, and if so, where to include the unit price for the monitoring.

Government’s Answer: Yes, the Prime Contractor has overall responsibility for ensuring that monitoring of abatement work is accomplished. The unit price for monitoring of abatement work is covered under

ELIN X015 (Lead Based Paint Abatement), which includes prep, abatement, monitoring, air sampling, etc. Please note that the Contractor who performs the abatement work (whether it is the Prime Contractor or a Subcontractor) should not do their own monitoring, as this is a conflict of interest. Abatement monitoring should be performed by a third party who is qualified/certified. In accordance with

Attachment 1 to the solicitation, Basic Contract Statement of Work (SOW), para. 2.2.2, “It is the

Contractor’s responsibility to ensure that all subcontractors have proper permits, notifications, manufacturer certifications/agreements, and appropriate general and state licenses required to fulfill requirements described in this SOW.” Further, para. 3.2 states “The Contractor shall ensure that all employees and subcontractor employees have current, valid licenses and certifications necessary to perform their functions” and para. 3.6.2 states “The Contractor is responsible for any subcontractor work performed.”

Solicitation – Section L

1. Question: We plan on hand delivering our bid submission for the referenced solicitation this Friday.

Will we need to fill out a site visit sheet to be able to provide a hand delivery?

Government’s Answer: If an Offeror does not currently have Base access, they will need to contact the

Government points of contact (POCs) identified within the solicitation (SF 1442) to be sponsored on

Base. Note: Please contact the Government POCs at least one business day in advance.

2. Question: Page 39 of 47 of Solicitation, TECHNICAL PROPOSAL Part II Subfactor 1 ii is requesting a "bonding capacity of $2,000,000.00 and a minimum aggregate bonding capacity of

$10,000,000.00

The following sections throughout Solicitation are stating different contract amounts. It was mentioned at the site visit on June 29, 2017 that task orders, would be issued at no more than $2,000,000.00 per year, with a total Contract amount of $l0,000,000.00 for the 5 years.

Standard form 1442 states "The assigned NAICS code is 238320, Painting and Wall Covering

Contractors, with a corresponding small business size standard of $15M".

Page 3 of 47 wherein item f IAW DFARS 236.204, the magnitude of construction for this basic contract is between $25,000,000.00 and 100,000,000.00

Page 5 of 47 under Contract Value section states: minimum amount $25,000 Maximum Amount

$28,000,000.00

Our bonding company is concerned about the $28,000,000.00. Please clarify that Contract amount will not exceed more than 10,000,000.00 for all 5 years as we interpreted at the site visit.

Questions & Answers (Q&As) 02

Government’s Answer: Bonding capacity is not the same as the basic ID/IQ contract value. Bonds are only required at the task order level, as stated in the solicitation in Section A, Continuation of Block 10, para. i. where it states that “Performance and Payment Bonds will not be required for the basic ID/IQ contract, but will be required at the task order level.” Bonds are only required for on-going/active task orders, not completed task orders, so the awarded Contractor would only be expected to obtain and maintain bonds for all active task orders. The Government’s estimated maximum amount of active task orders at any given time is $10M (estimate only), which is why this amount was requested for the aggregate bonding capacity. The contractor would not be required to obtain bonds in the amount of the total basic ID/IQ contract maximum of $28M, as this value represents the total amount of work expected on the basic ID/IQ contract over the life of the contract of five years.

The dollar values stated in Section L-001 of the solicitation para. 3.b.ii. under Technical Subfactor 1 are meant to ensure that the offeror has the ability to obtain bonding in the minimum single project amount of $2M and the minimum aggregate bonding capacity of $10M. The $2M amount represents the highest projected amount for a single project (based on historical data), and the $10M amount represents the total amount of all projects expected to be active/on-going at any given time (also based on historical data and is an estimate only). As stated in the Continuation of Block 10 on page 4 of the solicitation para.

i., bonds are required for task orders exceeding $35,000 IAW FAR Clause 52.228-13 and FAR 52.228-

15 (both clauses can be found in Section F of the solicitation on pages 9 and 11). IAW these clauses, performance and payment bonds are required for 100 percent of the original contract price, meaning each awarded task order’s price. Bonds are only required at the task order level, and only for active/on-going projects.

The slides from the Pre-Proposal Conference which were posted to FedBizOpps on 30 Jun 17 stated on slide 9 under Technical Subfactor 1 that proof of bonding capability is required in the amounts of $2M single project and $10M aggregate. The amount of $10M was not mentioned in any other capacity.

The maximum contract value for the Painting and Coatings ID/IQ Contract is $28M, as stated on page 5 of the solicitation in Section B. This is in keeping with the magnitude of construction for the basic ID/IQ contract as provided on page 3 of the solicitation, which was provided IAW DFARS 236.204 which calls for the disclosure of the magnitude of construction projects (the contract maximum value for the Painting and Coatings ID/IQ Contract of $28M falls within the range of $10M and $25M as provided on page 3 of the solicitation).
