FAR 52.212-1 Instructions to Offerors-Commercial Items.
INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS (JUN 2020)
Submission of offers. Submit signed and dated offers to the Contracting Officer Troy H. Banks, troy.banks.4@us.af.mil and the Contract Specialist, Mallory Stephenson, mallory.stephenson.1@us.af.mil, NO LATER THAN 16 February 2022, 5:00 PM, Central Time at 1600 Central Standard Time, USA.
Offers shall be submitted through email only.
Treatment of Late Offers:
Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and
1) if it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
2) there is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
3) If this solicitation is a request for proposals, it was the only proposal received.
However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
Acceptable evidence to establish the time of receipt at the Government installation includes read receipts or delivery receipts from email
If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing mailto:troy.banks.4@us.af.mil mailto:mallory.stephenson.1@us.af.mil
722d Enterprise Sourcing Squadron RFQ FA890322Q0001 date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
Potential for Negotiations:
The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
After award is made the contractor may request a debriefing within 5 days of the notification of award. The debriefing shall include the agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer; the overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror, the overall ranking of all offerors, when any ranking was developed by the agency during source selection; a summary of the rationale for award, and reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.
Basis of Award:
The award will be made to the contractor whose proposal represents the best value to the Government with Non- Cost factors considered MORE important than price due to the inherently difficult location of Thule, Air Base (AB). Due to the unique requirements of the location and the need for the foreign contractors to work with the United States Air Force (USAF) and Defense Logistics Agency (DLA), experience at Thule Air Base is a significant factor in determining the certainty of success of this contract.
Factors 1-4 will each be evaluated on a Pass/Fail Basis. Only Factor 5 will be assigned a Non-Cost Rating and will form the basis of the trade-off decision. Award will not be made to a firm that “Fails” any of Factors 1 - 4. The closer each offeror is in the assignment of the Non-Cost Factor 5 rating, the more important the Price becomes in making an award decision. The closer each offeror’s Price is to each other, the more important the Non-Cost Factor 5 rating becomes in making an award decision.

722d Enterprise Sourcing Squadron RFQ FA890322Q0001
FACTOR 6: PRICE
Factor 6 Submission Requirement: The contractor shall complete the Price Schedule at Attachment X The contractor shall provide their best price for the twelve (12) EEMUA 159/API 653 Tank Inspections to take place over the next three years in accordance with the PWS. The second and third set of four tanks are options and the Government is not obligated to exercise the options. This shall be submitted on the Proposal Summary Sheet.
Factor 6 Evaluation Method: The Price Proposal Sheet is broken down for each of the twelve (12) Tank Inspections to take place over three years.
a. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
b. Pricing will be evaluated for fairness, completeness, and reasonableness through the use of price analysis.
c. Pricing will also be checked for unbalancing of line items. Unreasonable, unbalanced, or incomplete pricing may cause a proposal to be determined unawardable. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. A price is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work.
d. The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. Some of those techniques are, but not limited to: comparison of proposed prices received in response to the solicitation and/or comparison of proposed prices with the Independent Government Estimate (IGE).
e. A proposal is complete when all price/cost data as outlined in the solicitation, in the required format, has been submitted. All items must be completed and the total must be mathematically correct and rounded to the nearest dollar. Failure to submit a price on an item or a number of items may deem the proposal unawardable.
(End of provision)
FAR 52.212-2 Evaluation-Commercial Items.
EVALUATION-COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
(b) The award will be made to the contractor whose proposal represents the best value to the Government with Non-Cost factors considered MORE important than price due to the inherently difficult location of Thule, Air Base (AB). Due to the unique requirements of the location and the need for the foreign contractors to work with the United States Air Force (USAF) and Defense Logistics Agency (DLA), experience at Thule Air Base is a significant factor in determining the certainty of success of this contract.

(c) Factors 1-4 will each be evaluated on a Pass/Fail Basis. Only Factor 5 will be assigned a Non-Cost
Rating and will form the basis of the trade-off decision.
(d) Refer to Provision FAR 52.212-1 Instructions to Offerors- Commercial Items above, for evaluation factors that are being used for the selection and award of this contract. The complete submission requirements and evaluation methods are included in the FAR 52.212-1 Provision above.
(e) A written notice of award or acceptance of an offer, emailed within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
FAR clause at 52.212-4, Contract Terms and Conditions-Commercial Items (OCT 2018), applies to this acquisition with the following Addendum: Paragraph (c) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the government.

Offers submitted in response to this solicitation shall be in the English language. Offers received in other than English shall be rejected.
52.217-5 Evaluation of Options.
As prescribed in 17.208(c), insert a provision substantially the same as the following:

I think you mean, “in descending order of importance.” That said, you’ve got “pass/fail” factors in there, so even that isn’t really true.

This says DoD.
SUMMERS, BRINDLE T NH-04 USAF AFMC 772 ESS/PKA
