Step 1 - Section L – Instructions, Conditions and Notices to Offerors – Prequalification of Sources Repair Cadet Chapel, USAFA, FA8903-17-R-0071
REQUEST FOR PROPOSAL
CONSTRUCTION SERVICES FOR REPAIR
USAFA CADET CHAPEL, UNITED STATES AIR
FORCE ACADEMY, CO
SOLICITATION NO. FA8903-17-R-0071
STEP ONE
PREQUALIFICATION OF SOURCES
SECTION L
INSTRUCTIONS, CONDITIONS AND NOTICES
TO OFFERORS
1.0 Program Structure and Objectives
(a) This solicitation is for Construction Services for Repair Cadet Chapel for the United States Air Force
Academy (USAFA), Colorado Springs, Colorado.
(b) The Government will utilize a two-step evaluation process to award a single contract to the Offeror who provides the best value to the Government considering cost and non-cost factors.
(1) Step 1 will be a prequalification of sources in accordance with DFARS 236.272. In Step 1, the Government will ask for qualifications/past performance in order to evaluate and prequalify sources to perform the Repair Cadet Chapel. Price will not be evaluated as part of Step 1. The Government will shortlist up to five of the most competitive Step 1 Offerors to compete for contract award in Step 2.
(2) Step 2: In Step 2 of the two step selection procedure, the Offerors that were prequalified in Step 1 will receive an Amendment to the RFP. The Amendment will request the prequalified offerors to submit proposals that include technical and price information. In Step 2, the Contracting Officer will award one contract to the Offeror who is deemed responsible in accordance with the FAR, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and who is judged, based on the evaluation factors to represent the best value to the Government. This may result in an award to a higher rated, higher priced Offeror, where the decision is consistent with the evaluation factors, and the Source Selection Authority (SSA) reasonably determines that the technical and/or overall business approach of the higher price Offeror outweighs the cost difference. Step 2 will be conducted in accordance with Federal Acquisition Regulation (FAR) Part 15, Defense Federal Acquisition Regulation Supplement (DFARS) Source Selection Procedures, Guidance and Information Subpart 215.3, and Air Force Federal Acquisition Supplement (AFFARS) Subpart 5315.3.
1.1 Budget/Funding Information
In accordance with DFARs 236.203, the magnitude of construction for this project is between $25,000,000 and $100,000,000.
2.0 General Instructions
(a) The Offeror's proposal must include all data and information requested by this ITO and must be submitted in accordance with these instructions. The offer must be compliant with the requirements as stated in the Statement of Work (SOW), Contract Data Requirements List (CDRL), Specifications, and Drawings. Non-conformance with the instructions provided in this ITO may result in an unfavorable proposal evaluation.
(b) The proposal must be clear, concise, and must include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements but rather must provide convincing rationale to address how the Offeror intends to meet these requirements. Offerors must assume that the Government has no prior knowledge of their capabilities and experience and will base its evaluation on the information presented in the Offeror's proposal.
(c) Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired.
(d) The proposal acceptance period is specified in Section A of the model contract/solicitation. The Offeror must make a clear statement in Section A of the proposal documentation volume that the proposal is valid through this date.
(e) In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the Offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.
2.1 General Information
2.1.1 Point of Contact
The Contracting Officer (CO) is the sole point of contact for this acquisition. Address any questions or concerns you may have to the CO. Written requests for clarification may be sent to the CO at the address located in Section A of the model contract/solicitation. The PCO for this acquisition is as follows:
Procuring Contracting Officer: Mrs. Sally Kite Phone (210) 395-8049 Email: sally.kite@us.af.mil
2.1.2 Notifications/Debriefings
2.1.2.1 Step 1 Prequalification of Sources (DFARs 236.272)
This is a prequalification process only. The CO will promptly notify Offerors not selected to move on to Step 2; such notice will include a written prequalification debriefing. This will be the only debriefing given to Offerors not selected for Step 2. The CO has determined that there is a need to expeditiously address issues related to an Offeror not being selected to move to Step 2 to avoid unduly disrupting or delaying the procurement process. Resolving any concerns related to an offeror being excluded from Step 2 prior to starting the Step 2 evaluation would avoid duplication of evaluation effort and delay of the acquisition process. This is fair considering that Step 1 and Step 2 have separate evaluation processes and criteria and that Step 1 criteria will not be part of the subjective tradeoff in Step 2. At a minimum, the pre-award debriefing will include --
(a) The agency’s evaluation of significant elements in the Offeror’s proposal;
(b) A summary of the rationale for Offeror not being selected for Step 2; and
(c) Reasonable responses to relevant questions about whether prequalification procedures contained in the solicitation, applicable regulations, and other applicable authorities were followed in the process of eliminating the Offeror from the Step 2 competition.
2.1.3. Discrepancies
If an Offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the Offeror must immediately notify the CO in writing with supporting rationale as well as the remedies the Offeror is asking the CO to consider as related to the omission or error. The Offeror is reminded that the Government reserves the right to make a prequalification selection for this effort based on the initial proposal, as received, without interchanges. This reservation includes matters of additional or substitute pages of the initial proposal.
2.1.4. Electronic Reference Documents
All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) website at http://www.fedbizopps.gov. Potential Offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.
2.1.5 Communications
Interchanges between Government and Offerors will be controlled by the CO. During the prequalification process (Step 1), interchanges with industry may be conducted. Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the Offerors that may address any aspect of the prequalification proposal. The Government intends to make a prequalification decision based on the initial proposal submissions without http://www.fedbizopps.gov/ conducting interchanges. Therefore, each offer should contain the Offeror’s best terms from a technical standpoint. Offeror responses to interchanges will be considered in making the prequalification decision. The Government is not required to conduct interchanges with any or all Offerors responding to the prequalification RFP. Interchanges with industry may be in written format via password-protected or encrypted email, and/or U.S. Postal delivery or facsimile and controls to preserve the integrity of the competitive process, as described herein.
2.1.6 Joint Ventures
A Joint Venture (JV) will be considered a sole business entity. Signed JV documentation must be provided in Volume I, Contract Documentation, and Volume II, Technical. Submit a signed copy of the Joint Venture agreement indicating the proposed participation of each Joint Venture member. Failure to submit the required Joint Venture Agreement will be considered unacceptable.
2.2 Organization/Number of Copies/Page Limits
The Offeror must prepare the proposal as set forth in the Proposal Organization Table (Table 1/Step 1 below).
The titles and contents of the volumes must be as defined in this table, all of which must be within the required page limits and with the number of copies as specified in Table 1/Step 1. The attachments identified in the table must be separately bound in three-ring, loose-leaf binders, as necessary. The contents of each proposal volume are described in the ITO paragraph as noted in the Table 1 below:

3.4 Joint Ventures, Teaming Arrangements, and/or Letters of Intent Provide all Joint Venture (JV) Agreements and Letters of Intent (LOI) for specialty scope subcontractors.
Failure to submit the required JV Agreement and/or LOI may result in an unacceptable proposal. Specialty scope subcontractors (Factor 2) are not restricted from forming teams with multiple Offerors.
3.5 Organizational Conflict of Interest (OCI) Analysis and Mitigation Plan
(a) The Offeror shall identify any potential OCI issues or appearance of any potential OCI your company, (including all Teaming Partners, subcontractors, subsidiaries and legacy companies) may have with respect to the scope of effort as outlined in this solicitation. OCIs may exist at least in the following three ways:
• Unequal access to information – access to non-public information that gives a contractor an unfair competitive advantage.
• Biased ground rules – when a contractor has in some sense set the ground rules for another procurement action creating the potential that the contractor may have tilted the playing field in the new competition (usually toward its own strengths and away from its weaknesses).
• Impaired objectivity – when the contract requires exercise of judgment and the independence of its judgment may be affected (e.g., when the contractor may be required to evaluate its own work in a way that could be adverse to its economic interests).
(b) If your company does identify a potential OCI or appearance of any potential OCI, a mitigation plan shall be submitted in Volume 1, Contract Documentation Volume to show how your company will either satisfactorily mitigate or eliminate any potential OCI issues or appearance of any potential OCI. If your firm, including all Teaming Partners, subcontractors, subsidiaries, and legacy companies, has not identified any OCIs or appearance of OCIs, then the Offeror must so state.
(c) Any submitted OCI analysis and plan will not be evaluated unless the Offeror is considered the apparent successful Offeror under the evaluation Factors listed in this RFP. OCI determination will be included as part of the responsibility determination conducted prior to award. The Government will determine if an OCI exists and whether adequate mitigation is proposed. If adequate mitigation is not proposed, the Government may engage in exchanges with the apparent successful Offeror to determine if the problems with the mitigation plan may be resolved. If an OCI exists that cannot be adequately mitigated, the Government may seek waiver of the OCI issue or may award to another Offeror who does not have an OCI, or who has an OCI and has submitted a mitigation plan that is adequate or may be made so after exchanges between the Government and the Offeror.
3.6 Financial Responsibility/Bonding
Prime must provide proof of bonding capacity to support this contract.
(a) To be considered, the Offeror must have a letter from a surety on surety letterhead that says the Offeror has a relationship with the company and required bonding capacity is available.
(b) To be considered, the Offeror must provide aggregate bonding of at least $100 million for this contract.
(c) Provide proof of bonding capacity with bonding capability letters from an approved surety listed with the Department of Treasury. The list of approved sureties can be found at http://www.fiscal.treasury.gov/fsreports/ref/suretyBnd/c570_a-z.htm. Letters must be notarized and signed by someone who can represent the surety. Letter should be dated within 30 days of Step 1 proposal submission date. Letters signed by agents are unacceptable unless accompanied by a Power of Attorney granting proper authority to the agent.
(d) Financial responsibility will not be evaluated as a separate Factor. However, it is a basic contract requirement with a pass/fail determination that will be evaluated during the prequalification process. An Offeror may only be shortlisted if they are deemed responsible in accordance with the FAR.
3.7 Exceptions to Terms and Conditions
(a) Exceptions to Terms and Conditions of the model contract are strongly discouraged and may result in the Offeror being removed from consideration for prequalification. Failure to comply with the terms http://www.fiscal.treasury.gov/fsreports/ref/suretyBnd/c570_a-z.htm and conditions of the solicitation may result in the Offeror being removed from consideration for prequalification.
(b) Exceptions taken to terms and conditions of the model contract, to any of its formal attachments, or to other parts of the solicitation must be identified.
(c) Each exception must be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken.
