BASE SUPPORT AGREEMENT

1. Base support will be provided by the Government to the contractor in accordance with the provisions of this agreement. Failure by the contractor to comply with the provisions of this agreement will release the Government, without prejudice, from its obligation to provide base support by the dates required. If warranted and the contractor has complied with the provisions of this agreement, an equitable adjustment will be made if the Government fails to provide base support allowed by law by the dates required. Support Agreements will follow the guidance and intent of AFI 25-201.

A. Base support includes Government-controlled working space, furniture, material, equipment, services, or other support, which the Government determines, can be made available at, or through, any Air Force (AF) installation where this contract will be performed. This base support agreement is intended to provide the contractor with facilities services, certain military unique supplies and support resulting from being a tenant of the base. Standard administrative and other expendable supplies required to fulfill contractual obligations are the responsibility of the contractor. All Government Furnished Property (GFP) in the possession of the contractor, provided through the base support agreement, will be used and managed in accordance with the GFP clause of this contract.

B. The contractor agrees to immediately report any defective GFP or any inadequate support not identified in the contract to the Project Officer / Quality Assurance Representative (QAR) / Contracting Officer's Representative (COR) (with a copy to the Administrative Contracting Officer (ACO)), Also, submit a recommended plan for obtaining the required support. The Government agrees to determine (within 10 workdays) the validity and extent of the involved requirement and the method by which it will be fulfilled (e.g., purchase, rental, lease, GFP, etc.). Facilities will not be purchased under this agreement. The contractor (or authorized representative) will not purchase or otherwise furnish any base support requirements provided by this agreement, or authorize others to do so without the Contracting Officer’s (CO) prior written approval regarding price, terms and conditions of the proposed purchase, or approval of other arrangements.

C. Base support will be provided at the following installation(s):

Nellis Air Force Base (AFB), NV;

Kirtland AFB, NM;

Davis Monthan AFB, AZ;

Elmendorf AFB, AK;

Moffett Field, CA;

Gabreski Air National Guard Base (ANGB), PA;

Moody AFB, GA;

Patrick AFB, FL;

RAF Lakenheath Air Base (AB), UK; and

Duke Field, FL (for Government Development Test and Evaluation (DT&E))

D. The Government (host base) will provide a base orientation packet to contractor employees that describe/address base regulations, restrictions, and services that are available to them. The packet will include the procedures outlined in this plan and any other concerns the base deems necessary.

2. The contractor will inspect and identify any support requirements to the Air Force (AF) by official correspondence. The contractor will set up face-to-face meetings with the program office and the receiving unit to clarify requirements, including responsibilities, equipment, supplies and personnel. Typical questions to be resolved include:

How will the AF request support from the supplier?

Who will receive the support?

What type and level of support will be required?

Are there non-standard conditions related to the request for support?

What is the objective or mission supported?

When will the support be provided?

Have all support categories been considered?

Where will the support be provided?

Does the receiving unit have any existing contracts that will require an Associate Contract Agreement between contractors?

Does the receiver have an existing Requirements Contract that precludes supplier from providing requested support or duplicate services already provided in the contract?

Any doubts as to exactly what support is needed must be clarified before the support agreement is approved.

3. Access to required regulations, publications, and technical orders at:

Nellis Air Force Base (AFB), NV;

Kirtland AFB, NM;

Davis Monthan AFB, AZ;

Elmendorf AFB, AK;

Moffett Field, CA;

Gabreski Air National Guard Base (ANGB), PA;

Moody AFB, GA;

Patrick AFB, FL;

RAF Lakenheath Air Base (AB), UK; and

Duke Field, FL (for Government DT&E)

4. Official mail service to Government agencies will be handled through normal Government mail channels. Host base will provide access to the Base Information Transfer System (BITS) for receipt and delivery of official correspondence.

5. Fire Protection.

A. Through the base fire chief, inform contractor personnel (on an annual basis) of the policies and procedures necessary to assure adequate fire protection consistent with the Air Force Fire Protection Program.

B. Provide all necessary equipment and personnel to meet fire fighting needs.

C. Accomplish periodic fire hazard inspections. The contractor shall be responsible for correcting any identified fire hazards created by their operations within their assigned facilities.

D. Provide and maintain fire extinguishers at the facilities occupied by the contractor in accordance with local procedures (except those systems provided under the acquisition contract). The Air Force will be responsible for recharging the facility fire detection and suppression systems except in cases where it can be determined that contractor employees or their representatives are directly at fault or negligent.

E. Furnish support, as required, for training of contractor and Government personnel in fire prevention, fire alarm activation/reporting, and use of portable fire extinguishers.

F. Maintain and inspect all fire protection equipment associated with the CRH facilities.

6. Maintenance of Real Property.

A. Designate a facility manager and an alternate who shall be responsible for initiating and coordinating all facility work requests through the base civil engineer.

Responsibilities of facility managers are outlined in AFI 32-110. In addition to Real Property responsibilities, the facility manager shall be responsible for any temporary buildings provided to the contractor in support of this contract.

B. Maintain buildings (except as noted below) and provide, operate, and maintain utilities including lights and light bulb replacement for all fixtures 10 ft. or higher above the floor, excluding lights associated with training equipment. The facility manager will provide replacement bulbs for all facility lights.

C. Plan for and accomplish requests for special utility hookups, minor structural changes, etc., on a work order basis as prescribed in AFI 32-1031 within work force and budget constraints.

D. Be responsible for grounds maintenance, access roads, and parking areas around all government provided facilities. The government will provide outside trash containers/dumpsters consistent and adequate for the facilities' use. The contractor is responsible for policing and removing of trash within the authorized parking/driveways/sidewalks associated with assigned facilities.

E. Be responsible for monitoring and maintaining all facility heating, air conditioning and ventilation systems.

F. Be responsible for maintenance of all Real Property Installed Equipment (RPIE).

G. Janitorial services will be provided. The contractor shall be responsible for custodial duties. The government will provide trash removal of oversized items, i.e.

shipping crates, etc.

7. Communications:

A. Furnish base common-use telephone service for Government and contractor personnel from the base administrative system (Class B services if available).

Contractor use of DEFENSE SWITCHING NETWORK (DSN) for overseas communications will be in accordance with AFI 33-111. Provide one Class A line at each site and existing lines and phones as is (any additional requirements will be at the expense of the contractor).

B. Permit the installation of commercial telephone lines sufficient to support voice and data transmissions in contractor operational areas.

C. Advise contractor of procedures (if any) that they must follow to obtain the desired commercial communication services.

D. Provide access and support to government networking systems, e-mail and web sites when determined to be in the best interest of the government.

E. The host will provide permission for the local commercial phone company to deliver commercial phone lines to contractor occupied offices to include the installation of internal facility wiring at contractor's expense.

F. The host will provide and install communications lines to access Air Force Consolidated Engine Management System and Integrated Maintenance Data System (IMDS). The contractor will be responsible for acquiring computer terminals to access these systems.

8. Base Maintenance: On a reimbursable basis, provide services to facilities and equipment, if available, to administer minor repairs and modifications to metal fixtures, brackets, parts and pieces by cutting, bending, milling, filing, drilling, and welding within the capability of equipment and facilities available. When available these services will be scheduled IAW local procedures. The government shall assume no liability for any damage to CRH equipment resulting from performance of these services. The government will not be held responsible for delays due to shop scheduling and/or workmanship.

9. Medical Services: Brief contractor personnel on local base procedures relating to first aid and emergency medical treatment.

10. Safety:

A. Grant access to all applicable safety regulations, including Occupational Safety and Health Standards (OSHA), and AF safety directives. The contractor is responsible for compliance with all local, state and federal safety regulations and shall interface with the government on all safety issues.

B. Provide consultation on interpretation of safety directives and inspection services when applicable.

C. In coordination with the representative of the contract administration office, follow local reporting procedures for accidents that result in personal injury or damage to government property.

D. Provide traffic safety education IAW AFI 91-207 as required or requested.

11. Security and Law Enforcement:

A. Provide security education training to contractors per AFI-31-101.

B. Provide vehicle registration services and personal identification for contractor personnel IAW local procedures.

C. Provide contractors procedures for reporting on base accidents.

D. Provide normal law enforcement for government provided facilities.

12. Supply/Logistics/Transportation:

A. The government (through the host base facility manager) shall be responsible for furnishing, distributing, placement and disposal of furniture required for the performance of this contract. The government (Contracting Office or Contract Administration Office) shall be responsible for furnishing and disposal of all accountable equipment / property (as defined and covered by FAR Part 45 to include "contractor acquired property") required in the performance of this contract.

B. Assist the contractor in the handling and removal of Hazardous Wastes to include disposal utilizing existing base facilities and procedures.

C. Provide Government vehicles as required to support the mission. Contractor operator must be a qualified driver under local base policy.

13. Weather Forecasting: Advise contractor of all weather warnings and meteorological watch advisories for the occurrence/ending of lightning in accordance with local operating procedures.

14. Morale, Welfare, and Recreation (MWR)/Club Membership and Base Exchange Dining Facilities IAW local procedures:

A. Allow contractor personnel use of MWR facilities, equipment, and services as is available to Federal General Schedule employees.

B. Allow contractor personnel the privilege to join the Service clubs if the individual desires to obtain membership.

C. Allow contractor personnel the use of the base restaurants/snack bars as is available to Federal General Schedule Employees.

15. Support Agreements

A. Support agreements administered by the Air Force are normally documented on DD Form 1144 and fall into the following principal categories:

Air Force to Air Force, known as Intra-service Agreements (to include Air Force Reserve Command (AFRC) and Air National Guard (ANG)).

Air Force to other Service or DoD components, known as Inter-service Agreements.

Air Force to other non-DoD Federal activities, known as Intra-governmental Agreements.

Air Force to other non-Federal activities, excluding private or commercial enterprises.

B. To ensure the maintenance of a comprehensive logistics record, all significant recurring support provided by the Air Force shall be recorded on DD Form 1144, whether reimbursable or non-reimbursable. Also, record all such support on DD Form 1144 when the Air Force is the receiver.

C. Policy and procedures for Inter-service, Intra-governmental and Air Force to non- Federal activities are governed by the DoDI 4000.19. In addition, the DoDI 4000.19 provides general guidance for the administration of support agreements within the DoD community.

D. If there is conflict with any other guidance, information in agreements will not supersede any other DoD or Air Force directive or instruction. The agreement itself should not prescribe detailed procedures for performing any particular support function.

Such guidance is usually in other DoD or Air Force directives, instructions, manuals, etc., which apply to the particular type of support being performed. If such information is not in the DoD or Air Force directive in enough detail for local use, a local-level operational procedure/directive should be prepared and referenced in the agreement.

See AFI 25-201 for guidance and examples.

16. Memorandums of Agreement/Understanding (MOA/MOUs)

A. Most MOAs and MOUs are used to define areas of broad agreement between two or more parties. MOAs are memorandums that define general areas of conditional agreement between two or more parties – the actions of the other party depend on what the other party does (e.g., one party agrees to provide support if the other party provides the materials). MOUs are memorandums that define general areas of understanding between two or more parties – explains what each party plans to do; however, what each party does is not dependent on the actions of the other party (e.g., does not require reimbursement or other support from receiver).

B. MAJCOM/Numbered Air Force (NAF) Level MOA/MOUs. Most internal Air Force MOA/MOUs are broad agreements between or among MAJCOMs or NAFs to identify parameters for developing support agreements between subordinate units. At the installation level, these MOA/MOUs are then used as a source document in addressing the provision of services, funding and reimbursement arrangements. However, the actual transfer of funds or other resources is affected by the relevant established functional procedure and not by MOA/MOUs alone.

C. Functional Area MOA/MOUs. MOA/MOUs can be used between functional areas to document mutually agreed areas of responsibility, such as:

Statement of facts.

Intentions.

Procedures.

Policies for future actions.

D. The functional Office of Primary Responsibility (OPR) (e.g. Civil Engineers, Security Forces) will usually draft, sign and maintain these documents, which are procedural or technical in nature and will not initiate the obligation of funds or manpower for recurring support. Refer to AFI 25-201 for MOA/MOU guidance

17. EQUIPMENT AND SUPPLIES.

A. The host will provide the following items for each field service technical representative. All other investment and expense material shall be the responsibility of the contractor. Examples of common use items listed below should be included in the BSA agreements:

B. The host will provide workspace, equipment, and supplies for up to 50 contractor personnel at Duke Field, FL in support of the Government DT&E program.

CONCLUSION: This baseline agreement is an adequate statement of discussions and coordination of those support requirements and responsibilities for each base. These above support requirements and responsibilities will cover those functions necessary for the contractor to execute technical representative and/or engineering and/or contractor field team duties during the designated time frame.

Performance of this contract is at multiple sites. It is anticipated that all provisions of this document will not be appropriate for all sites. Therefore; the local Government Project Officer/Quality Assurance Representative is authorized to supplement this agreement to facilitate the needs of the particular site. It is understood that additional agreements shall not result in any increase in contract price or obligation without written authorization by a Warranted Contracting Officer.
