B and H CLIN 0004
In Section B, CLIN 0004 (Pg. 4), there is a requirement to deliver “data in accordance with the instructions in Section J, Exhibit B, OMIT Contract Data Requirements List (CDRL).” According to Section B, CLIN 0006 (Pg. 5), “The contractor hereby grants, or obtains for Government use, the license rights for the technical data (including computer software documentation) and computer software delivered under CLINs xxx4, Data - OMIT and CLINs xxx5, Data-Non OMIT, pursuant to Special Contract Requirements, ASC/WISV- H020 "Delivery and License Rights for Technical Data and Computer Software Necessary for Organizational and Depot-Level Maintenance and Training Systems" and ASC/WISV-H021 "Identification and Assertion of Restrictions on Technical Data and Computer Software".” Under ASC/WISV-H020(b), (Section H, Page 145), the contractor is required to “Delivery Requirements.
Pursuant to CLIN 0004 (and option CLINs 0304, 0404, 0504, 0604, 0704, 0804, 0904 and 1004), the contractor shall deliver all technical data and computer software necessary for organizational and depot level maintenance of the entire CRH weapon system and equipment. In addition, the contractor shall deliver all technical data and computer software necessary for Type 1 training (option CLINs 0239, 0339, 0340, 0351, 0439, 0440, and 0441).” At the same time, under ASC/WISV-H020(c), (Section H, page 146), “the Government is granted unlimited rights in all technical data (including computer software documentation) necessary for operation, maintenance (including depot level maintenance), installation, or training. However, for OMIT Data (other than commercial computer software) related to items developed exclusively or partially at private expense, the Government is willing to accept Government purpose rights. Commercial computer software to be delivered as OMIT Data shall be subject to a commercial license.” ASC/WISV-H020(c) does not specify whether the government will accept Specially License Rights or less than Government Purpose Rights where sufficient for depot level maintenance where the data relates to commercial items, items developed exclusively or partially at private expense, or software developed exclusively or partially at private expense if it results in a better value for the Air Force. Will the Air Force also be willing to accept Specially License Rights or less than Government Purpose Rights where sufficient for depot level maintenance where the data relates to commercial items, items developed exclusively or partially at private expense, or software developed exclusively or partially at private expense if it results in a better value for the Air Force?
All technical data (commercial and non-commercial) to be delivered under the OMIT CLINs (0004 and xx04 options) must be provided with at least Government purpose rights. As discussed in H-020, the applicable DFARS clauses would grant the Government unlimited rights in all technical data (commercial and noncommercial, whether developed exclusively or partially at private expense) “necessary for operation, maintenance, installation, or training purposes (other than detailed manufacturing or process data)” (see, e.g., DFARS 252.227-7015(b)(1)(iv)). In order to achieve a better value for the Air Force, the CRH program is willing to accept Government purpose rights in this data instead of unlimited rights. A specially negotiated license that provides less than Government purpose rights is not acceptable. Compliance with this requirement will be enforced during proposal evaluation (Section M, paragraph 2.3.7) and contract administration (Section H, ASC/WISV H-020 and ASC/WISV H-021).
Commercial computer software to be delivered under the contract (OMIT and Non- OMIT) will be accepted with a commercial computer software license, but the license must not contain terms and conditions inconsistent with Federal procurement law or that do not otherwise satisfy user needs. Unacceptable terms and conditions commonly found in commercial licenses are listed in Section L, paragraph 4.7.4.1.3.

Previous Question: Re: “The contractor shall use DO-178B, Software Considerations in Airborne Systems and Equipment Certification, as a guide.” Please explain the application of DO-178B for this program as it pertains to Previously Developed Software.
Previous Answer: DO-178B is prescribed as a guide only. An alternative, equivalent means to meet airworthiness requirements as defined in MIL-HDBK-516B Expanded Chapter 15 may be used.
Sikorsky Follow-Up: For modified previously developed software, is it acceptable to apply the guidelines of DO-178B specifically to changed areas of source code, rather than to entire CSCI’s?
DO-178B is not a requirement for airworthiness. The software, hardware, or other components of the air vehicle must be suitable for their application for airworthiness regardless of prior use or modification. It is the responsibility of the offeror to propose an air worthiness solution which meets the requirement of MIL-HDBK-516B.

Sikorsky Follow-Up: Does this response apply for all software on the aircraft?
Yes. Airworthiness is a requirement for the entire CRH aircraft. Software, hardware, and other components must be suitable for their application in an airworthy system. DO- 178B is a guide and the contractor is free to propose airworthiness criteria by alternative means in their airworthiness specification.

Regarding Interim Contractor Support for the Training System, please confirm that the Academic Instructor, Device Instructor, and Student Services support requirements DO NOT apply to the Maintenance Training Devices and/or Maintenance Training requirements of the CRH Program. Specifically, are Academic Instructors, Device Instructors, and Student Services desired at Sheppard, Moody, Nellis, and Davis-Monthan AFBs for the Maintenance Training Program?
Academic Instructors, Device Instructors, and Student Services do not apply at Sheppard, Moody, Nellis and Davis-Monthan AFBs for the Maintenance Training Program. The paragraphs are requirements for the FTU only.

In ref to SOW par 1.9.5.3.1 Supply Support, “ISS activities include identifying, quantifying, selecting, tracking, provisioning, cataloguing, acquiring, monitoring, collecting, storing, maintaining, repairing…” Does the use of the word “repairing” mean that the contractor will be responsible for all scheduled and unscheduled component repairs under this contract? Are we expected as part of our proposal to price repairs or will they be funded on the over and above CLIN 0006 to which we are not providing any price until after contract award?
The contractor is required to perform all repair actions during ISS. All of the repairs should be priced under the appropriate ISS CLINs. Over and Above funding will only be provided to cover repairs that are resulting from the conditions listed in Section H, ASC/WISV-H012 Over and Above Repair Procedures.

"Base Support includes Government-Controlled working space, furniture, material, equipment, services, or other support…" Does "equipment" include handling, storage, and moving equipment necessary to perform the ISS functions?
No, the Base Support Agreement does not cover handling, storage, and moving equipment necessary to perform the ISS functions.

Proposal Section L, paragraph 2.6.5, Table 1 – Proposal Organization lists a “Spares List” as an attachment to Volume ll – Technical.
Paragraph 4.7.2.2 of the same section requires comprehensive lists of spares packages, support equipment, mobility packages, and copies of completed Section J, Attachments 10, 14, 15, 16, 17, and 21.
Are all the requirements of Paragraph 4.7.2.2 to be considered as part of the generic “Spares Lists” title and therefore do not count against the page limitation?
All spares lists required under paragraph 4.7.2.2 are not included in the page count limit of the Technical volume. To clarify this, paragraph 2.6.5, under the Technical volume page exclusions revised to read "all Spares Lists under para 4.7.2.2" in lieu of "Spares list".
