ORDERING INSTRUCTIONS
POTENTIAL TASK SCENARIOS
NOTE: Task Orders may be issued under this contract based on one of three (3) potential scenarios described in paragraphs (1), (2) (a), and (2) (b) below:
(1) STANDARD PRE-PRICED TASKS: A task order may be issued for recurring refurbishment tasks at the firm-fixed price set forth in Section B, Schedule and associated attached exhibits (Section J) without prior notification to the awardee.
(2) UNIQUE SEPARATELY-NEGOTIATED TASKS: When the Government has a requirement for a unique noise suppressor repair/refurbishment or relocation, one of two approaches may be utilized dependent on the anticipated complexity and magnitude of the effort.
(a) For relatively discrete efforts, a Statement of Objectives (SOO) describing the desired outcome and pertinent details (work scope/problem description, noise suppressor configuration, location, pictures of the affected area or equipment in the noise suppressor, required data deliverables, desired delivery schedule, etc.) and the applicable Department of Labor wage determination will be provided to the awardee, through the Task Order. In addition, an on-site point of contact will be identified for the awardee to contact to obtain additional insight into the nature of the problem.
In response to the Task Order, the awardee will provide a Repairable Item Inspection Report (RIIR), a detailed Performance-based Statement of Work (PWS) to satisfy the SOO requirement, and a corresponding cost proposal in the time specified in Table 1 below:
(b) For more complex efforts, the Government will request an estimate of travel for contractor personnel to travel to the site and return for the purpose of assessing the required effort. Upon receipt of travel estimate, a Task Order will be issued to authorize the travel and site evaluation.
The Task Order will additionally include a SOO describing the desired outcome and pertinent details (work scope/problem description, noise suppressor configuration, location, required data deliverables, desired delivery schedule, etc.) and the applicable Department of Labor wage determination. In response, the awardee will provide a RIIR, a detailed PWS to satisfy the SOO requirement, and a corresponding cost proposal in the time specified in Table 1 above.
UNIQUE SEPARATELY- NEGOTIATED TASK ORDERING INSTRUCTIONS
NOTE: paragraphs A. – F. below apply to cost proposals provided by the contractor for UNIQUE TASKS as described in (2)(a), and (2)(b) above.
A. (Labor): With respect to the cost proposal supporting the proposed PWS -
(1) The contractor shall utilize the proposal rates for labor categories not subject to adjustment in accordance with a Service Contract Labor Standards wage determination.
(2) The contractor shall utilize the adjusted proposal rates for labor categories subject to adjustment in accordance with a Service Contract Labor Standards wage determination for effort proposed to be performed by permanent employees (e.g. “home office” personnel).
(3) If a unique repair/refurbishment or a relocation necessitates utilization of a labor category for which a labor rate has not been established, the proposed wage rate will be subject to negotiation prior to issuance of the task order.
(4) If the proposal for a unique task order is based on a period of performance anticipated to span multiple contract periods, the proposal/adjusted proposal rates corresponding to the anticipated period of performance shall be utilized in the proposal; for those circumstances where the wage determination impacts the proposal, the current wage determination applicable to the period of performance will apply. Period of Performance begins at issuance of Task Order.
(5) Each proposal for a unique task order shall include a breakout of labor hours by labor category.
B. (Material/Subcontracting): The proposal for unique tasks shall include an itemized list of materials and subcontracts (e.g. type, quantity, unit price, and total) and explanation for the basis of reasonableness of material and subcontract prices (e.g. competitive quotes, catalog price, cost or price analysis etc.). The applicable add-on factor may be applied to material and subcontract totals.
C. (Data Requirements): are specified in the schedule as “Not Separately Priced” (NSP) or “To Be Negotiated” (TBN). The awardee shall provide an individual cost breakout for each TBN data requirement specified for inclusion in a task order (CLIN X019).
D. (Travel and Per Diem) – Travel costs shall be proposed IAW FAR 31.205-46 (CLIN X018).
E. With respect to cost elements that are not pre-priced, cost proposals for unique tasks shall comply with FAR Part 15 (including Table 15-2), as supplemented. Cost proposals shall be submitted in hard copy and in electronic (Microsoft Excel) format. The Excel worksheets provided shall contain mathematical formulas. The awardee shall not provide “values only” or limit/protect the files to “read only” format. The paper and electronic copies shall be identical in all respects. Scanned PDF files are not acceptable as worksheets, but may be utilized to provide supporting documentation or narrative explanations. Electronic submittals shall comply with the following:
(1) E-mail transmission of proposals is preferred; however, this may not be practical depending on file size. For exceptionally large electronic submissions, the proposal shall be submitted on a CD-R (Write once/read only. CR-R/W and DVD-R/W are not acceptable. All media must be virus scanned by the offeror prior to submittal) or through the AMRDEC SAFE website (https://safe.amrdec.army.mil/safe/About.aspx).
(2) Data files/CD-Rs should be accessible by a computer running Microsoft Windows 7 or later.
(3) Worksheets should be .xls or .xlsx file format (Microsoft Excel 2007 or later) https://safe.amrdec.army.mil/safe/About.aspx
F. Material and subcontract costs, labor hours, and any proposed hourly cost exceeding the certified cost or pricing data threshold shall be subject to certification per FAR 15.403-4(a)(1) and negotiation prior to issuance of the task order. The contractor shall also submit a separate completed proposal adequacy checklist in accordance with DFARS 252.215-7009 with the proposal package.
