SbAST RFP FA8530‐09‐R‐22309 Questions & Answers
Background: Section M‐900, Evaluation Factors for Award, paragraph 2.b.v, states the assessment will consider the extent to which the Offeror’s and critical subcontractor’s evaluated past performance demonstrates compliance with FAR 52.219‐8, pursuant to DFARS 215.305(a)(2). Neither RFP Section M‐900, Para 2.b.v, nor DFARS 215.305(a)(2) require an assessment based on whether FAR 52.219‐8 is included in the effort submitted for evaluation.
Therefore, the requirement to submit two contracts that contained FAR 52.219‐8 seems to conflict with this evaluation factor and the requirements of DFARS 215.305(a)(2).
Question # 80: If an offeror or critical subcontractor had no contracts that required the inclusion of FAR 52.219‐8, how will such FACTS sheets submitted for evaluation be assessed and what is the impact on our evaluation?
Answer # 80: FACTS sheets submitted by an offeror or critical subcontractor will not be affected by not having FAR clause 52.219‐8 in the contracts. If an offeror or critical subcontractor has no contracts containing this clause, they should so state and give the reason. Provision of the required information will be evaluated on a pass/fail basis, and will not impact either the relevancy ratings or confidence assessment ratings.
